The Ordinance corrects an error made in the vacating ordinance which described the lots abutting on the north of the right-of-way being vacated. The Ordinance also makes it clear that the vacated property is in fact, in the opinion of the City of Omaha, right-of-way which can be vacated. The subject property is part of a conveyance made to the City of South Omaha in October, 1902 and has been shown on City maps over the years and is considered as public right-of-way. The Public Works Department requests your consideration and recommends your approval of this amending Ordinance. ORDINANCE NO. 3,2,5, "/ AN ORDINANCE amending Ordinance No. 32472, passed September 10, 1991, which provides for the vacation of the north 25 feet of "E" Street between 22nd Street and 23rd Street by correcting the legal description of property abutting on the north of the vacated right-of-way; to provide that Ordinance No. 32472 shall be repealed as heretofore existing; and to provide the effective date hereof. WHEREAS, a petition was filed by the property owner abutting on the north 25 feet of "E" Street between 22nd Street and 23rd Street requesting the vacation of said right-of-way which received favorable recommendation from the City Planning Board and approval from the City Council by its Ordinance No. 32472, passed September 10, 1991; and whereas the question has subsequently arisen as to whether the "vacated" parcel is in fact right-of-way to be vacated; and, an error was made in describing the property abutting on the right-of-way to be vacated in Ordinance No. 32472. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That Section 1 of Ordinance No. 32472, passed September 10, 1991, is hereby amended to read as follows: "Section 1. That Lots 8 and 9, Block 5, Spring Lake Park Addition, granted to the City of South Omaha by warranty deed dated October 23, 1902, and recorded in the Register of Deeds Office in Miscellaneous Book 257, Pages 50 through 54, having been annexed to the City of Omaha has been shown on City maps as public street right-of-way comprising "E" Street and that in accord with the petition filed with and considered by the City Council, the north 25 feet of "E" Street between 22nd Street and 23rd Street, immediately abutted by Lots 7 and 10, Spring Lake Park Addition, located in the Southwest Quarter Section 34-15-13 Ordinance No. 3,23T5-y Page 2 be, and hereby is, vacated; the vacating of the property herein described, and the reversion thereof, pursuant to applicable law, shall be subject to the conditions and limitation that there is reserved to the City of Omaha the right to maintain, operate, repair and renew sewers now existing therein and in the future to construct, maintain, repair and renew additional or other sewers, and also the right to authorize the public utilities and cable television systems to construct, maintain, repair or renew and operate now or hereafter installed water mains and gas mains, pole lines, conduits, electrical transmission lines, sound and signal transmission lines and other similar services and equipment and appurtenances above, on and below the surface of the ground for the purpose of serving the general public or abutting property; and the right so reserved shall also include such lateral connection or branch lines as may be ordered, desired or permitted by the City or such other utility and to enter upon the premises to accomplish the above purposes at any and all times." Section 2. That Ordinance No. 32472 is hereby repealed as heretofore existing. Section 3. That this Ordinance shall be in full force and take effect 15 days from and after the date of its passage.
