Transmitted herewith is a Resolution approving Amendment No. 1 to an Interlocal Agreement
between the City of Omaha and Douglas County' detailing the reimbursement structure for the
Blondo Street from 155th Street to Eldorado Drive project, known as MAPA-5127(2), State
Control No. 22376A, and OPW 52288 (Phase I), and the 156t1i Street from Pepperwood Drive
and Corby Street project, known as MAPA-5127(1), State Control No. 22376, OPW 50677, and
C-28(464) (Phase II).
The City entered into an Interlocal Agreement with Douglas County, Nebraska, October 3, 2008
for cost share on the City's portion of improvements to 156t1i Street from Pepperwood Drive to
Corby Street, known as Project MAPA-5127(1), State Control No. 22376, OPW 50677, and C-
28(464), as detailed in the attached Amendment No. 1.
Douglas County has agreed to reimburse the City's Finance Department a sum of$1,804,823.00,
of the City's local share, to the 2010 Transportation Bond Fund 13183, Organization 117117.
The Public Works Department requests your consideration and approval of the attached
Resolution.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, the City entered into an Interlocal Agreement with Douglas County,
Nebraska, October 3, 2008 for cost share on the City's portion of improvements to 156th Street
from Pepperwood Drive to Corby Street, known as Project MAPA-5127(1), State Control No.
22376, OPW 50677, and C-28(464); and,
WHEREAS, the attached Amendment No. 1, which has been split into two phases, with
Phase I, being the Blondo Street from 155th Street to Eldorado Drive project, known as MAPA-
5127(2), State Control No. 22376A, and OPW 52288, and Phase II, being the 156th Street from
Pepperwood Drive to Corby Street project, known as MAPA-5127(1), State Control No. 22376,
OPW 50677, and C-28(464); and,
WHEREAS, Douglas County has agreed to reimburse the entire local share amount of
$925,273.00 to the City for Phase I, which will be reimbursed to the 2010 Transportation Bond
Fund 13183, Organization 117117; and,
WHEREAS, the total local share cost is $2,145,250.00 for Phase II, of which Douglas
County has agreed to reimburse the City 41% of this share, being $879,553.00 which will be
reimbursed to the 2010 Transportation Bond Fund 13183, Organization 117117.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT, as recommended by the Mayor, the Amendment No. 1 to the Interlocal
Agreement between the City of Omaha and Douglas County detailing the reimbursement
structure for the Blondo Street from 155th Street to Eldorado Drive project, known as MAPA-
5127(2), State Control No. 22376A, and OPW 52288 (Phase I), and the 156th Street from
Pepperwood Drive and Corby Street project, known as MAPA-5127(1), State Control No.
22376, OPW 50677, and C-28(464) (Phase II), is hereby approved.
BE IT FURTER RESOLVED:
THAT, the Finance Department is authorized to receive a total sum of $1,804,823.00
from Douglas County, as detailed in the attached Amendment No. 1, which is to be reimbursed
to the 2010 Transportation Bond Fund 13183, Organization 117117.

BE IT RESOLVED BY THIS BOARD OF COUNTY COMMISSIONERS THAT:
the Chairman be and is hereby authorized to execute Amendment No. One to the
Interlocal Agreement between Douglas County, Nebraska and the City of Omaha,
Nebraska, copies of which are attached hereto and incorporated herein by reference.
The Interlocal Agreement, dated October 3, 2008 was entered into to complete
engineering services on the improvements to 156th Street between Pepperwood Drive
and Corby Street—Douglas County Project No. C-28(464) and City Project OPW50677.
Amendment No. One is necessary to add work on Blondo Street from 155th
Street to Eldorado Drive, City Project OPW52288, and describes both parry's duty and
responsibility for design, construction and right-of-way on both projects.
Douglas County's share of the cost will be paid for by Arterial Street
Improvement (ASIP)funds.

AMENDMENT #1 TO INTERLOCAL AGREEMENT
This Amendment#1 to the original Interlocal Agreement is made and entered into this
day of , 2014, by and between the CITY OF OMAHA, a
Municipal Corporation of the State of Nebraska, hereinafter referred to as "Omaha" and
DOUGLAS COUNTY of the State of Nebraska, hereinafter referred to as "Douglas County".
WITNESSETH
WHEREAS, on October 3, 2008 Omaha and Douglas County entered into an Interlocal
Agreement to improve 156th Street from Pepperwood Drive to Corby Street, which is in the
jurisdiction of both entities; and,
WHEREAS, this project is known as Federal Aid Project MAPA-5127(1), State Control
No. 22376, and City Project OPW50677; and,
WHEREAS, it was necessary to add work on Blondo Street from 155th Street to
Eldorado Drive which is known as Federal Aid Project MAPA-5127(2), State Control No.
22376A, and City Project OPW52288; and,
WHEREAS, it is necessary that work not included in the Original Interlocal Agreement
be added under this Amendment; and,
WHEREAS, it is necessary to increase the limits of the October 3, 2008 Interlocal
Agreement for the additional work necessary to complete the project and for the additional
estimated cost to pay for said work; and,
WHEREAS, both Omaha and Douglas County desire to describe and define the
responsibilities of the project, to enable them to jointly undertake the project in the manner
described as follows.
NOW THEREFORE, the following is agreed between the parties hereto:
1) The parties hereby agree to the improvement of 156th Street from Pepperwood Drive to
Corby Street and Blondo Street from 155th Street to Eldorado Drive in accordance with
such design, drawings, specifications,plans, construction documents and contracts as
approved by the parties. No separate legal entity will be created to administer the Original
Interlocal Agreement, as amended herein, and no separate budget needs to be established.
2) The Interlocal Agreement as amended in the amount of$800,000.00 was for preliminary
engineering and final design only.
3) It is necessary to amend the Interlocal Agreement to include costs for design, construction
and acquisition of Right-of-Way(ROW). The total estimated cost for said work is
$15,352,617 which does not include the estimated engineering costs previously approved in
the Interlocal Agreement.
4) This amount is eligible for Federal funds in the amount of 80% of the eligible project costs.
The allocation of costs shall be as follows:
a) The estimate for Final Design, ROW and Construction for Blondo Street from 155`h
Street to Eldorado Drive is $4,626,367 which is eligible for Federal funds in the amount
of 80% of the eligible project costs. The remaining costs in the amount of$925,273
($31,773 Final Design, $81,000 ROW and $812,500 for Construction) shall be the
responsibility of Douglas County.
i) This project also includes work for Omaha Public Power District(OPPD) which
consists of moving their utility to a underground duct bank. Per agreement with
OPPD, the costs for this work will be borne by OPPD and the City.
b) The estimate for Final Design, ROW and Construction for 156th Street from
Pepperwood Drive to Corby Street is $10,726,250 which is eligible for Federal funds in
the amount of 80% of the eligible project costs. Of the remaining 20% local share, the
City will pay 59% and 41%will be paid by Douglas County. The estimated cost to
each is $1,265,698 ($73,750 Final Design, $1,118,198 Construction and$73,750 ROW)
for the City and$879,553 ($51,250 Final Design, $777,053 Construction and$51,250
ROW) for Douglas County.
c) The City will authorize Douglas County to expend Arterial Street Improvement
Program (ASIP) funds for their portion of the 20% local match in accordance with
Section 10-313 of the Omaha Municipal Code on both City Project's OPW50677 and
OPW52288.
5) Any cost sharing or participation from local property owners or Sanitary& Improvement
Districts (SID's) towards this project will be credited toward the total local share, as set
forth in paragraph 4) above.
6) All terms and conditions of the October 3, 2008 Interlocal Agreement shall remain in effect,
and continue to be binding on the parties thereto, with the exceptions of the amendments
contained herein.
7) Upon payments for ROW and for construction of the project, Omaha will bill Douglas
County for their share of the local costs as they come due pursuant to approved progress
payment requests. The bill shall be paid within thirty(30) days. If, at the completion of the
work, said payments made are more than the actual cost, Omaha shall refund the excess
payments to the Douglas County based upon the proportions set out above in paragraph 4.
8) Nothing in the Original Interlocal Agreement, as amended herein, shall modify or be
interpreted to affect the exclusive authority of each party within its corporate boundaries or
jurisdiction
IN WITNESS WHEREOF, the parties hereto have caused these presents to be executed by the
proper officials hereunto duly authorized as of the dates below indicated.
