Jean Stothert,Mayor Public Works Director Honorable President and Members of the City Council, Transmitted herewith is a Resolution approving an Interlocal Cooperation Agreement with the City of Bellevue for the resurfacing of Harrison Street from 13th Street to Railroad Avenue, as part of the project known as OPW 52928. This Agreement will allow for the City to participate, along with the City of Bellevue, in resurfacing and setting forth a cost share for Harrison Street from 13th Street to Railroad Avenue. The Agreement defines the terms and conditions for which the City of Bellevue and the City of Omaha will share the cost of this resurfacing, as it will benefit both parties. The City of Omaha will provide a cost share in the estimated amount of $20,000.00 of the project expenses and The City of Bellevue will also provide a cost share in the estimated amount of $20,304.42 of the project expenses. The cost share for the City of Omaha will be paid from the City Street Maintenance Fund 12129, Major Street Resurfacing Organization 116159. Curtiss Date Finance Director S' 1378hra AGREEMENT FOR COST SHARING PURSUANT TO THE NEBRASKA INTERLOCAL COOPERATION ACT THIS AGREEMENT (hereinafter "Agreement") is made and entered into on this day of , 20_, by and between the CITY OF BELLEVUE, NEBRASKA, a municipal corporation and political subdivision of the State of Nebraska (hereineafter "BELLEVUE"), and the CITY OF OMAHA, NEBRASKA, a municipal corporation and political subdivision of the State of Nebraska (hereinafter "OMAHA"), collectively referred to herein as "the Parties". WHEREAS, the Interlocal Cooperation Act of the State of Nebraska, Neb. Rev. Stat. § § 13-801 through 13-827 (Reissue 2012), enables separate political subdivisions of the State to cooperate on the basis of mutual advantage to provide for joint undertakings, services and facilities, in a manner and pursuant to forms of governmental organization that will accord with best geographic, economic,population, and other factors influencing the needs and developments of local communities; and WHEREAS, the Parties plan to jointly undertake a project for the resurfacing on Harrison Street from 13th Street to Railroad Avenue (hereinafter "the Project"), said segment of Harrison Street lying partially within BELLEVUE and partially within OMAHA; and WHEREAS, the Parties desire to share the cost of the Project as it will benefit both Parties. NOW, THEREFORE IT IS AGREED BY AND BETWEEN THE PARTIES HERETO THAT: 1. GENERAL PURPOSE: In consideration of these mutual promises, the Parties hereby agree to share the cost of the Project pursuant to the cost allocations specified in the Harrison Street Project Costs, a copy of which is attached hereto, consisting of one (1) page(s), marked as "Exhibit A" and is hereby incorporated to this Agreement by reference. The final project cost for BELLEVUE is Twenty Thousand Three Hundred Four Dollars and Forty-Two Cents ($20,304.42) (balance of estimate). The project final cost for OMAHA is Twenty Thousand Dollars ($20,000.00). 2. DURATION: This Agreement shall commence immediately upon the execution hereof by the Parties and shall remain in effect until terminated. This Agreement shall terminate upon completion of the Project and upon satisfaction and payment by the Parties of all contracts associated with the Project. Either Party may terminate the Agreement by providing at least ninety (90) days advance written notice to the other Party. Project costs shall continue to be shared pursuant to this Agreement until the effective date of termination. 3. NONDISCRIMINATION: The Parties shall not, in the performance of the terms of this Agreement, discriminate or permit discrimination against any Party on account of race, national origin, sex, age, sexual orientation, or political or religious affiliations in violation of federal or state laws or local ordinances. 1 4. NO SEPARATE ENTITY: This Agreement does not create a separate legal or administrative entity under Neb. Rev. Stat. Section 13-804(3). No other party or entity is a party to this Agreement, either directly or as a third party beneficiary. 5. INTERLOCAL AGREEMENT COORDINATION: This Agreement shall be administered primarily through the Public Works Director for BELLEVUE and the Public Works Director for OMAHA. The aforementioned directors shall be reasonably available to consult with each other and/or their representatives to discuss performance of this Agreement. 6. AMENDMENTS: This Agreement may not be amended except by mutual agreement of the Parties and then only in writing. Clarifications of this Agreement not inconsistent with its terms may be made in writing administratively between the Parties.
