The attached ordinance approves an Amendment to the Interlocal Agreement between the City of
Omaha and the City of Bennington to allow EHPV Lottery Services, LLC ("EHPV") to continue
operating Big Red keno satellite locations within the City of Bennington under the City of Omaha's
EHPV Lottery Operator's Agreement.
This Amendment extends the term of the Agreement for a period of five(5)years,beginning on May
15, 2016, and ending on May 14, 2021. All other provisions of the existing Interlocal Agreement
with the City of Omaha will remain the same.

from appropriations of more than one fiscal year, to amend the Interlocal Cooperation
Agreement between the City of Omaha and the City of Bennington, controlling the
distribution of keno lottery proceeds; to extend the Agreement for five (5) years; and to
provide an effective date.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
Section 1. The attached Amendment of the Interlocal Cooperation Agreement between the
City of Omaha and the City of Bennington, relating to the City's operation of a lottery within the
City of Bennington is hereby approved and the Mayor and City Clerk are authorized to execute and
attest the Amendment.
Section 2. This ordinance shall be in full force and take effect fifteen days from and after its
passage.

AMENDMENT OF THE INTERLOCAL COOPERATION AGREEMENT
BETWEEN THE CITY OF OMAHA AND THE CITY OF BENNINGTON, RELATING
TO THE OPERATION OF A LOTTERY WITHIN THE CITY OF BENNINGTON.
THIS AMENDMENT is made and entered into this day of h , 2016,
by and between the City of Omaha, a municipal corporation, and the City of Bennington, a
municipal corporation, to amend the Interlocal Cooperation Agreement currently in effect
between the parties.
WHEREAS, by Ordinance No. 806, adopted June 30, 2015, the City of Omaha entered
into an Interlocal Cooperation Agreement with the City of Bennington to operate a lottery within
the city limits of the City of Bennington (hereinafter referred to as "the Agreement"); and,
WHEREAS, the Agreement's term continues through May 14, 2016; and,
WHEREAS, the City of Bennington has requested an extension of the Agreement and the
City Council finds it to be in the best interests of the City of Omaha and its residents to extend
the Agreement and modify its terms in the manner set forth below.
NOW, in consideration of the premises, it is agreed by and between the parties:
Section 1. PURPOSE. This Amendment is intended to amend the Agreement and its
terms only as set forth in this Amendment. This document does not alter or otherwise affect any
right or obligation of either party with respect to any matter not specifically set out in this
Amendment.
Section 2. TERM. Unless otherwise terminated pursuant to the provisions of the
Agreement or by law, the Agreement shall continue for a period of five (5) years commencing on
May 15, 2016, and ending May 14, 2021.

Section 3. RECOURSE. The City of Omaha and the City of Bennington shall not, by
this Amendment, be deemed to have waived any rights they may have regarding any matter
arising from the Agreement, whether arising prior to or subsequent to this Amendment.
