The attached ordinance approves an Amendment to the Interlocal Agreement between the City of
Omaha and Douglas County,Nebraska to allow EHPV Lottery Services,LLC("EHPV")to continue
operating Big Red keno satellite locations in unincorporated areas of Douglas County under the City
of Omaha's EHPV Lottery Operator's Agreement.
This Amendment extends the term of the Agreement for a period of five(5)years,beginning on May
15, 2016, and ending on May 14, 2021. All other provisions of the existing Interlocal Agreement
with the City of Omaha, as it has been previously amended and extended, will remain the same.

AN ORDINANCE,pursuant to Home Rule Charter Section 5.17 involving the payment of moneys
from appropriations of more than one fiscal year, to amend the Interlocal Cooperation
Agreement between the City of Omaha and Douglas County, Nebraska, controlling the
distribution of keno lottery proceeds,as previously amended and extended by Ordinance No.
38998; to extend the Agreement for five (5)years; and to provide an effective date.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
Section 1. The attached Amendment of the Interlocal Cooperation Agreement between the
City of Omaha and Douglas County, Nebraska, relating to the City's operation of a lottery within
unincorporated areas of Douglas County is hereby approved and the Mayor and City Clerk are
authorized to execute and attest the Amendment.
Section 2. This ordinance shall be in full force and take effect fifteen days from and after its
passage.

SECOND AMENDMENT OF THE INTERLOCAL COOPERATION AGREEMENT
BETWEEN THE CITY OF OMAHA AND DOUGLAS COUNTY,NEBRASKA,
RELATING TO THE OPERATION OF A LOTTERY WITHIN DOUGLAS COUNTY.
THIS SECOND AMENDMENT is made and entered into this-3 flay of ,
2016, by and between the City of Omaha, a municipal corporation, hereinafter referre to as the
"City", and Douglas County, Nebraska, hereinafter referred to as the "County", to amend the
Interlocal Cooperation Agreement currently in effect between the parties.
WHEREAS, by Ordinance No. 704, adopted April 9, 1991, the City entered into an
Interlocal Cooperation Agreement with the County to operate a lottery within the City and within
those areas of the County laying outside the City's corporate limits (hereinafter referred to as "the
Agreement"); and,
WHEREAS,the Agreement's term continued for twenty(20)years; and,
WHEREAS, by Ordinance No. 38998, adopted in May of 2011, the Agreement was
amended and extended by mutual agreement of the parties through May 14, 2016; and,
WHEREAS, the County has requested a second extension of the Agreement as amended
and the City Council finds it to be in the best interests of the City and its residents to extend the
Agreement and modify its terms in the manner set forth below.
NOW, in consideration of the premises, it is agreed by and between the parties:
Section 1. PURPOSE. This Amendment is intended to extend the Agreement as
amended and its terms only as set forth in this Amendment. This document does not alter or
otherwise affect any right or obligation of either party with respect to any matter not specifically
set out herein.

Section 2. TERM. Unless otherwise terminated pursuant to the provisions of the
Agreement as amended or by law, the Agreement shall continue for a period of five (5) years
commencing on May 15, 2016, and ending May 14, 2021.
Section 3. RECOURSE. The City and the County shall not, by this Amendment, be
deemed to have waived any rights they may have regarding any matter arising from the
Agreement, whether arising prior to or subsequent to this Amendment.y�

WHEREAS, Douglas County and the City of Omaha have entered into an
Interlocal Agreement for the operation of a keno lottery within Douglas County;and
WHEREAS, the Agreement is due to expire on May 14, 2016, and the parties
wish to extend said Agreement for an additional five-year term; and
WHEREAS, the attached Addendum amends said Agreement for an additional
five-year term.
NOW, THEREFORE, BE IT RESOLVED BY THIS BOARD OF
COMMISSIONERS, DOUGLAS COUNTY, NEBRASKA, that the attached
Addendum to the Interlocal Agreement with the City of Omaha is hereby approved and
adopted and the Chair of this Board is authorized and directed to execute said Addendum
on behalf of Douglas County.
