Transmitted here within is a Resolution approving a schedule of fees for the City of Omaha's Air
Quality Control Operating Permit Program and the Area Hazardous Air Pollutant Program. This
program stems from the Federal Clean Air Act's Title V program of 1990, which was adopted by
the City Council by Ordinance No. 33102 in 1993. Title V allows fees to be charged to pollutant
sources. National Emission Standards for Hazardous Air Pollutants (NESHAP) and minor
source fees are user-based fees collected to cover City costs. A projection of the revenue shows
the budget will be met with the attached fee structure.
The EPA recommends that fees be reviewed annually. That review has resulted in this
resolution. These fees were calculated to accommodate the 2015 budget.
The Public Works Department requests your consideration and approval of the attached
Resolution and Fee Schedule.

2015 Schedule of Fees
Class I Sources(Major Sources):
Class I permits are issued by Omaha's Public Works Department. These permits are issued to companies
allowed to emit over 100 tons, of any criteria pollutant,or 10 tons of any one,or 25 tons of total Hazardous
Air Pollutants (HAPs). The fee for all facilities receiving, or scheduled to receive a class I permit is as
follows:
Each Class I facility will pay $46.10 per ton of actual regulated pollutants, except carbon monoxide,
emitted in the previous year as reported in the facility's Emission Inventory. The fees collected will be
deposited in the Air Quality Enterprise Fund(21127), specifically earmarked for organization 116811, Air
Quality Control Title V program.
1. An additional charge of$3 $$3,380 per year per facility will be charged,to be deposited in
the Air Quality Enterprise Fund(21127),$272-50$2,290 specially earmarked for organization
116811,and$-1 8$1,090 earmarked for fund 116812.
Class II Sources(SM)(Synthetic Minor Sources):
Class II (SM) permits are issued by Omaha's Public Works. These permits are issued to companies that
have the potential to emit over the Class I thresholds if un-permitted,but have agreed,through their permit,
to limit emission below those levels.
1. All Class II(SM),sources will pay a flat fee of$1-5944$1,940 per year.
All fees collected from Class II(SM) sources will be deposited in the Air Quality Enterprise Fund(21127),
$1,380$1,400 specifically earmarked for organization 116811,$330$540 earmarked for fund 116812.
Class II Sources(M)(Minor Sources):
Class II (M) permits are issued by Omaha's Public Works Department. These permits are issued to
companies that have the potential to emit over the States thresholds, but even if un-permitted would not
emit air pollution at Class I levels.
1. All Class II(M)Sources will pay a flat fee of$.8-70$880 per year.
The fees collected from Class II (M)sources will be deposited in the Air Quality Enterprise Fund(21127),
specifically earmarked for organization 116812,Air Quality Control 105 Grant program.
Asbestos Inspection program:
The Asbestos inspection program consists of receiving and reviewing the required National Emission
Standards for Hazardous Air Pollutants(NESHAP)notifications, and inspection of these projects. The fee
on all NESHAP notifications is as follows:
1) A base fee of$75 per Asbestos NESHAP Notification, of which $50 is non-refundable,.plus
the following fees(These fees will be made up initially by the base fee)
2) $0.15 per square foot of asbestos as notified to be removed.
3) $0.15 per linear foot of asbestos as notified to be removed.
4) $1.15 per cubic foot of asbestos as notified to be removed.
5) The additional per foot fee to be calculated by total square, linear, and cubic foot, or the total
square footage of all airtight temporary work areas constructed in accordance with Nebraska
Title 178,Chapter 22,012.
6) A fee for each individual NESHAP notification required shall not exceed$5,000.
7) For projects that the City agrees to grant a waiver of the 10-day notification, including
emergency situations,the project fee will be two times those calculated above.

Area Hazardous Air Pollutant Compliance Program:
The Area Hazardous Air Pollutant program consists of receiving and reviewing the required initial
notifications and annual compliance reports as per 40 CFR 61 or 63 and Nebraska Title 129.The fee for
this annual review is as follows:
Annual fee of$200 per facility required to submit a NESHAP annual compliance report.
The fees collected from the NESHAP notification projects will be deposited in the Air Quality Enterprise
Fund(21127),specifically earmarked for organization 116812,Air Quality Control 105 Grant Program.

WHEREAS, the City of Omaha's Air Quality Control (AQC) must collect fees to offset
the cost of the Operating Permit Program and the Asbestos Inspection Program required by the
1990 Clean Air Act Amendments; and,
WHEREAS, AQC is required by the Omaha Municipal Code Section 41-2 adopting Title
129, Chapter 29.007 of the regulations of the Nebraska Department of Environmental Quality, to
annually review the rate structure and make recommendations on any modifications required to
the City Council; and,
WHEREAS, the recommended rate structure for 2015, a copy of which is attached and by
this reference is made a part hereof, provides the means to offset the cost of the AQC operating
permit and asbestos inspection programs as recommended by the Public Works Department.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT, as recommended by the Mayor, the attached rate structure for 2015 permitting
Omaha's Air Quality Control (AQC) to collect fees to offset the cost of the operating permit and
asbestos inspection programs in Omaha, is hereby approved.
