Transmitted herewith is an Ordinance creating Road Maintenance District No. 845-23, for the
improvement of Ames Avenue, bounded by North 85th Street on the south to North 87th Avenue
on the north; together with North 87th Avenue, bounded by Ames Avenue on the east to
approximately 114 feet north of Boyd Street on the south.
The enclosed Ordinance creates this Improvement District, according to the boundaries
petitioned by the respective residents. This petition directed the District be formed to undertake
asphalt improvements, which entails the application of an asphalt sealant overlay to the existing
roadway.
If approved, and upon subsequent certification of the petitions, the Public Works Department
shall undertake the improvement project, and the homeowners will be assessed back the cost of
these improvements upon completion and acceptance of the project by the Department. Such
assessment shall be reviewed and approved by the Board of Equalization and the City Council,
and will be reflective of the actual costs of the project.
The Public Works Department requests your consideration and approval of the attached
Ordinance.

AN ORDINANCE to create Road Maintenance District No. 845-23, in the City of Omaha, for
the purpose of improving Ames Avenue, bounded by North 85th Street on the south to
North 87th Avenue on the north; together with North 87th Avenue, bounded by Ames
Avenue on the east to approximately 114 feet north of Boyd Street on the south by
asphalt sealant overlay; to fix and define the boundaries of said district; to provide for the
determination and assessment of damages, if any, occasioned by reason of change of
grade; to authorize the Public Works Department, barring protest to the contrary in
accordance with OMC 26-65, to complete the associated improvement project; and to
provide for an effective date hereof
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
Section 1. That Road Maintenance District No. 845-23 is hereby created in the City
of Omaha for the improvement portions of Ames Avenue, together with portions of North 87th
Avenue. This improvement, as petitioned by the residents, includes application of an asphalt
sealant overlay to the roadway surface to seal cracks and provide a more water resistant and
longer lived driving surface.
Section 2. That Road Maintenance District No. 845-23, shall comprise Ames
Avenue, bounded by North 85th Street on the south to North 87th Avenue on the north; together
with North 87th Avenue, bounded by Ames Avenue on the east to approximately 114 feet north
of Boyd Street on the south by asphalt overlay and shall include:

Lots 1 - 4, Block 0, Inman's Replat; Lots 1 —4, Block 0, Reckard's Replat;
Lots 4,5,6,7,9,10,11, Block 0, Richland Acres; Lot 1, Block 0, Richland
Acres Replat 2; Lots 2 and 3, Block 0, Richland Acres Replat 3; Lots 1
and 2, Block 0, Keystone Replat 1; Lot 45, Block 0, Keystone Heights;
located in the SE '/4 Section 03-15-12.
The outer boundary of said District shall be the outer boundary of the lots hereinabove set forth.
Section 3 That if this project shall include a change of grade, then a committee of
three freeholders shall be appointed to assess, determine and report to the City Council the
damages, if any, to property owners which may be caused by grading or change of grade, if any,
in said District, taking into consideration in making such appraisement, the benefits accruing by
virtue of the entire improvement contemplated and set forth in this Ordinance. If any damages
may be found to have accrued to any property affected, such damages may upon finding of
special benefits, be assessed against the properties in the District so benefited.
Section 4. That the Public Works Department is authorized to create the design for
the improvements, prepare an engineer's estimate, solicit bids and carry out other associated
required actions, to complete the project for this improvement District in accordance with the
Omaha Municipal Code.
Section 5. That this Ordinance, being administrative in nature, shall take effect and
be in full force upon the date of its passage.

Petition to create a Road Maintenance District
We,the undersigned owners of lots abutting the following street segments (collectively
known as "the Project"):
Ames Avenue,bounded by N. 85th Street on the south to N. 87th Avenue on the
north;together with N. 87th Avenue, bounded by Ames Avenue on the east to
approximately 114 feet north of Boyd Street on the south,
respectfully request that the Omaha City Council create an Road Maintenance District
(RMD). The RMD will include all lots abutting the Project,for the purpose of
constructing a surface treatment on the street segments within the Project.
The surface treatment will seal cracks and provide a more water resistant driving surface.
It consists of a layer of emulsified asphalt and water,over which is spread a thin layer of
crushed gravel. The grade or curvature of the street will not be changed. Roadside
grading will be done as necessary to provide for proper drainage of the pavement. If
culverts at driveways must be replaced or provided as new,this will be done at the
expense of the property owner. This is over and above the cost estimate listed below.
Based on a proposal received last year,the cost of the project is estimated to be$600.00
per property. The actual cost will be determined on the basis of competitive bids.
This cost will be assessed against the lots abutting the Project which are specially
benefited by this surface treatment. However,the Omaha Board of Equalization and the
Omaha City Council will ultimately determine the amounts to be assessed to each lot in
the RMD. Assessments for an overlay are due once a year and are a minimum of
$500.00 per year or 1/5 of the total bill,whichever is more.
We,the undersigned,understand that this is an estimate based on past projections only.
No design has been created and no bids have been taken. The final cost of a project is
likely to be different from this estimate. In signing and presenting this petition,we agree
to grant at no cost to the City any temporary construction or grading easements that may
be necessary to complete this project.
All signatures must be in ink. No conditions may be attached to the petition.
