The City Council of the City of Omaha recommends denial of
the license and has determined that (1) the applicant is not fit,
willing, and able to properly provide the service proposed within
the City of Omaha; (2) the applicant has not demonstrated that
the type of management and control to be exercised over the
premises will be sufficient to insure conformance with all
provisions and requirements of and rules and regulations
adopted pursuant to the Nebraska Liquor Control Act; and (3)
the issuance of the license is not and will not be required by the
present or future public convenience. In making these
determinations the City Council of the City of Omaha
considered (1) the nature of the neighborhood of the proposed
license premises, including nearby schools, churches, and
educational and youth facilities; (2) citizen protests; (3) the
nature of the neighborhood or community of the location of the
proposed license; (4) the existence of other licenses in the area
with similar privileges, and whether the type of business activity
proposed to be operated in conjunction with the proposed
license is and will be consistent with the public interest; (5) the
existence of motor vehicle and pedestrian traffic flow in the
vicinity of the proposed license; (6) the sanitation or sanitary
conditions on or about the proposed licensed premises; (7)
whether the type of business or activity proposed to be operated
in conjunction with the proposed license is and will be
consistent with the public interest; and (8) the adequacy of
existing law enforcement and the prevalence of existing criminal
activity in and around the proposed license premises.
