To whom it may concern, Especially me I suppose. I would like to submit a letter opposing our rejection that was submitted on June 9t" I forwarded the letter to our factory. They have answered all the items and requested that we oppose this rejection. The letter the factory wrote is our formal answer to each item we were given as a rejection reason. We feel these are very minor compared to the amount we were low bid. Trying to earn your business we went very aggressive on price and our opponent seeing that the bid was wrote around his unit went list. We normally are high bid! Our service center is right in Lincoln the other brand is in Des Moines and was only bid thru the local truck dealer, he knows nothing of sweepers. Please review our answers and I hope this will have some bearing on your decision. Date: June 13, 2016 Jeff Kettleson Elliott Sanitation Equipment 1245 Dawes Avenue Lincoln, NE 68521 Re: Bids for Regenerative Air Street Sweeper - Response Dear Jeff: I am in receipt of the letter from the City of Omaha regarding the rejection of our bid for a Regenerative Air Street Sweeper. Below I have provided the following response: Page 3, item 15B - Schwarze Industries, Inc. utilizes a spring type suspension in this application because of the safety factor in taking this large of a hopper in the high dump position. The spring type suspension provides the unit with better stability in this application. Additionally, this type of suspension equates less overall maintenance for the end user. Page 5, item 20B - Schwarze Industries, Inc. utilizes a magnetic stainless steel hopper in lieu of the non- magnetic stainless steel, but still supplies the hopper with a LIFETIME WARRANTY AGAINST RUST AND PERFORATION. Therefore, the fact that this is magnetic should be a non-issue as we exceed the requirements on the warranty of the hopper and the customer is 100% covered if there are any issues with the hopper during their ownership of the machine. Page 7, items 23 - Schwarze Industries, Inc utilizes a belt driven blower fan which has been an industry standard for more than 40 years. This design provides the end user with a variable blower speed control in lieu of the two speed design as specified. Our design allows the operator to adjust the fan speed based on the material encountered, plus equates to significantly more power equating to faster sweeping and better material pickup capabilities. Page 10, item 30 E&F - Schwarze Industries, Inc. provides a machine that is belt driven and as noted above utilizes an industry standard design utilized for more than 40 years. We have also provided a standardly equipped back up DC pump system that allows the hopper to be dumped without the use of the auxiliary engine nor the fan running. We do not see this as a safety feature as the blower is inaccessible during this dump sequence and therefore not a safety hazard. The specification provided by the City of Omaha for this purchase was a SOLE SOURCE PROPRIETARY specification that only one manufacturer could meet. Yes, there are exceptions from another manufacturer, but they are differences in design and have zero impact on sweeping ability nor do they contribute to any safety hazards. The fact that our bid was in the area of$20,000.00 less for a machine that historically is priced within hundreds of dollars in other competitive selling situations around the United States should open some eyes. Based on this and our previous successful demonstration of our machine with the City of Omaha, we request that Elliott Sanitation Equipment protest this award and request that a specification be re-written allowing the Schwarze A8 Twister to be bid without any exceptions. Nebraska 68521 RE: Bids for Regenerative Air Street Sweeper Dear Bidder: Section 10-1 10 of the Omaha Municipal Code allows a Departmental Director to reject "any or all bids received for any city purchase or contract." This letter is to serve as written notice that your bid for the Regenerative Air Street Sweeper has been reviewed and rejected. It was determined that this bid did not meet the following required specifications outlined in the City's request for bids: Page 3, item 1513 of our specification calls for a 23,000 lb air suspension system. The bid you submitted was for a 23,500 capacity spring suspension. Page 5, item 20B of our specifications calls for the hopper, weldment and dump door to be constructed of non-magnetic stainless steel. The bid you submitted utilizes magnetic stainless steel. Page 7, item 23 of our specification calls for the blower to be driven by a hydraulic system. The bid you submitted utilizes a belt drive. Page 10, items 30E & F of our specification calls for the blower to be inoperable during the dump sequence as a safety feature. You have indicated your belt driven design is not capable of providing this safety feature. These exceptions are not acceptable to the City; therefore, the Department is forwarding to the City Council a recommendation of award to another bidder. The Public Works Department appreciates your interest and participation in the bidding process. Section 10-110 OMC also provides that: "Within ten (10) days after a bid is rejected. any rejected bidder may appeal to the city council by filing with the city clerk a written objection stating all the reasons for the objection."
