The area is generally bounded by alley between Lake and Ohio Street on the north, 42nd Street on the east, Military Avenue/45th Street on the west, and Patrick Avenue on the south. The Clifton Hill South Redevelopment Plan provides for the acquisition of property for residential development. The cost incurred will be paid from the FY 2015 Community Development Block Grant, Fund 12186, Organization No. 128072, Award 100276, Project 4793, and Task 10.1497. The City of Omaha will have the property appraised and will offer just compensation to the property owner. If the City is unable to negotiate the purchase price, the property will be acquired through eminent domain proceedings. Property acquisition will be done in accordance with the requirements of the Federal Uniform Relocation Act. No residential or business displacement will occur as a result of the acquisitions, consequently, and no relocation assistance will be necessary. 'y©9c9/ AN ORDINANCE declaring the necessity of appropriating, for the use of the City of Omaha, certain hereinafter described vacant and improved properties located in the Clifton Hill South Redevelopment Plan Area, an area generally defined by the alley between Lake and Ohio Street on the north, 42nd Street on the east, Military Avenue/45th Street on the west, and Patrick Avenue on the south, for acquisition, relocation as appropriate, demolition of structures, preparation of sites, and subsequent use as sites for implementing the Clifton Hill South Redevelopment Plan by the construction of new single-family houses; provided that as to each specified parcel which cannot be obtained by negotiation, proceedings in eminent domain be undertaken and completed; project costs will be paid from FY 2015 Community Development Block Grant, Fund 12186, Organization No. 128072, Award 100276, Project 4793, and Task 10.1497; and to provide the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That it is proper and necessary, pursuant to the Nebraska Community Development Law, to appropriate vacant and improved properties generally located in an area bounded by Lake and Ohio Street on the north, 42nd Street on the east, Military Avenue/45th Street on the west, and Patrick Avenue on the south, and that these vacant and improved properties necessary for such purpose are in Douglas County, Nebraska and are more particularly described as follows: 1. 4350 Lake Street The West Forty-two and one-half feet (42.5') of Lots Fourteen (14), Fifteen (15), and Sixteen (16), Block Five (5), Creighton Heights, an addition to the City of Omaha, as surveyed, platted and recorded in Douglas County,Nebraska. ORDINANCE NO. 5'096)/ PAGE TWO 2. 4346 Lake Street The West Forty feet (40') of the East Eighty feet (80') of Lots Fourteen(14), Fifteen (15), and Sixteen (16), Block Five (5), Creighton Heights, an addition to the City of Omaha, as surveyed, platted and recorded in Douglas County, Nebraska. 3. 4339 Lake Street Lot Ten (10), Block Eleven (11), Clifton Hill, an addition to the City of Omaha, as surveyed, platted and recorded in Douglas County,Nebraska. 4. 4334 Lake Street Lot Nineteen (19), Block Five (5), Creighton Heights, an addition to the City of Omaha, as surveyed, platted and recorded in Douglas County,Nebraska. 5. 4208 Erskine Street Lot Twenty-three (23), Block Ten (10), Clifton Hill, an addition to the City of Omaha, as surveyed, platted and recorded in Douglas County, Nebraska. Section 2. That the City of Omaha is authorized, empowered and directed to negotiate, through either employees of the City of Omaha or through persons employed therefore or through any combination thereof, with the owners of the above described property for the acquisition of said property by the City of Omaha for the aforesaid purposes. Upon failure to agree through negotiation with the owner of any of the above described property for the acquisition thereof by the City of Omaha, the City is authorized, empowered, and directed through the Law Department, to proceed forthwith to acquire such property not obtained by negotiation, by proceedings in accordance with the laws of the State of Nebraska, under the power of eminent domain. Any notice or notices in the name of the City of Omaha required to be given the owners or other persons having or claiming any interest in and to any of the above described property may be given by the Law Department of the City of Omaha. Funding shall be payable from FY 2015 Community Development Block Grant, Fund 12186, Organization No. 128072, Award 100276, Project 4793, and Task 10.1497. ORDINANCE NO. yC�90/ PAGE THREE Section 3.
