Jean Stothert,Mayor Public Works Director Honorable President and Members of the City Council, The attached Resolution approves the Amendment to the Subdivision Agreement among Charleston Homes LLC, a Nebraska corporation, Arbor View Homeowners Association, Sanitary and Improvement District (S.&I.D.) 561 of Douglas County, Nebraska, Elkhorn School District, and the City of Omaha. This Amendment to the Subdivision Agreement covers the public improvement of Arbor View (Lots 128-235), a subdivision located northwest of 204th Street and Grand Avenue. This Amendment to the Subdivision Agreement provides for a change in the allowable General Obligation debt of S.&I.D. 561. This revised G.O. debt cap accommodates water line construction costs that were significantly higher than the estimate in the original Subdivision Agreement. The ultimate G.O. debt cap for when S.&I.D. 561 is fully built remains in compliance with the City's maximum allowable debt-to-value ratio. WITNESSETH WHEREAS, Subdivider is the owner of the land included with the proposed plat attached hereto as Exhibit "A", which parcel of land (hereinafter referred to as the "Area to be Developed") is outside the corporate limits of the City within the City's zoning and platting jurisdiction;and, WHEREAS,the Subdivider,the City,and the SID have previously entered into a Subdivision Agreement (hereinafter referred to as"Agreement"), adopted by the City Council on September 15,2015 with Resolution No. 1127, setting forth certain conditions; and, WHEREAS, all provisions of the original Agreement are valid and shall remain in effect except the following paragraph which is revised as follows: The second paragraph Section III of the Subdivision Agreement shall be deleted and replaced with the following: The estimated general obligation of the District for Lots 128-235 is estimated to be $872,845 ($3,457,467 for the entire project), as shown on the Source & Use of Funds, Exhibit "D". The District valuation is estimated to be $24,075,000 ($86,508,000 for entire project), as shown on Exhibit"D", for a debt ratio of 3.63% (4.00% for entire project). The General Obligation of the District shall be incurred only for costs identified as General Obligation-eligible costs in this Agreement, and shall not exceed the District engineer's estimate of probable cost of$872,845 for Lots 128-235, as shown on Exhibit"D,"by more than 10%, except either i) the City Engineer or their designee may administratively approve a corresponding increase in the General Obligation of the District, or ii) by amendment of this Agreement and approval by the Omaha City Council. Any General Obligation costs in excess of the approved amount shall be specially assessed or paid for privately. In no event shall public improvements fmanced by General Obligation debt be in excess of 4%of estimated valuations. Exhibit D shall be deleted and replaced with Exhibit D as attached hereto.
