Transmitted herewith is a proposed Ordinance to vacate the following:
That part of the 20 foot wide alley lying between the east line of the vacated west 14 feet of 21st
Street and the west line of the vacated east 14 feet of 22nd Street in block 206 1/2, original City
of Omaha, containing 5380 square feet, more or less and all that part of 22nd Street lying west of
the vacated east 14 feet of 22nd Street and east of the vacated west 23 feet of 22nd Street and
south of the north line of the 20 foot wide alley lying in blocks 206 1/2 and 207 1/2 of the original
City of Omaha and north of the north right-of-way line of Cuming Street, containing 9467 square
feet, more or less and all that part of the 20 foot wide alley lying between the west line of the
vacated east 30 feet of 21 st Street and the southerly projection of the east line of the west 22 feet
of lot 3 block 205 1/2 of the original City of Omaha, containing 2232 square feet, more or less.
The approval of the Planning Board at their meeting of April 6, 2016 is attached. A petition was
not required since Section 14-375 Reissue, Revised Statutes of Nebraska, provides, "Upon the
recommendation of the City Planning Board, the City Council may, by Ordinance or Resolution,
vacate any street or alley within any such City without any petition being filed therefore", also
"Before any such street or alley shall be vacated, the Council shall appoint a Committee of at
least three members thereof who shall faithfully and impartially and after reasonable notice to the
owners and parties interested in the property affected by such vacation, assess damages, if any, to
such owners and parties affected".
On January 24, 2017, the Committee of Appraisers held a meeting immediately following the
8:15 a.m. staff meeting in the Council Conference Room of the City of Omaha and found no
cause for any damages as a result of the vacation.
This vacation is being requested by the City of Omaha, Planning Department. Title will be
passed to the abutting property owners, if approved.
The form of the attached documents has been approved by the City Law Department.
The Public Works Department recommends approval of the proposed Ordinance.

WHEREAS, Neb. Rev. Stat. Section 14-375 provides that the City Council may vacate a street
or alley without petition upon City Planning Board recommendation; and,
WHEREAS, the Statute further provides that a Committee of Appraisers be appointed to
appraise damages, if any, to property affected by the vacation; and,
WHEREAS, Resolution No. 846 adopted July 14, 2015, appointed Pete Festersen, Chris Jerram,
and Aimee Melton, members of the City Council, to assess damages to all property
affected by the vacation; and,
WHEREAS, on January 24, 2017, the Committee of Appraisers held a meeting immediately
following the 8:15 a.m. staff meeting in the Council Conference Room, at which meeting

WHEREAS, the City Council finds there are no damages as a result of this vacation, and that

WHEREAS, due to public improvements associated with this vacation, the Fair Market Value
has been waived for the above mentioned vacation.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
Section 1. That part of the 20 foot wide alley lying between the east line of the vacated
west 14 feet of 21st Street and the west line of the vacated east 14 feet of 22nd Street in block
206 1/2, original City of Omaha, containing 5380 square feet, more or less and all that part of
22nd Street lying west of the vacated east 14 feet of 22nd Street and east of the vacated west 23
feet of 22nd Street and south of the north line of the 20 foot wide alley lying in blocks 206 1/2
and 207 1/2 of the original City of Omaha and north of the north right-of-way line of Cuming
Street, containing 9467 square feet, more or less and all that part of the 20 foot wide alley lying
between the west line of the vacated east 30 feet of 21st Street and the southerly projection of the
east line of the west 22 feet of lot 3 block 205 1/2 of the original City of Omaha, containing 2232

be, and hereby is, vacated and without further act of the City, the vacating of the property
herein described, and the reversion thereof, pursuant to applicable law, shall be subject to
the conditions and limitation that there is reserved to the City of Omaha the right to
maintain, operate, repair and renew sewers now existing therein and in the future to
construct, maintain, repair and renew additional or other sewers; and also the right to
authorize the public utilities and cable television systems to construct, maintain, repair or
renew and operate now or hereafter installed water mains and gas mains, pole lines,
conduits, electrical transmission lines, sound and signal transmission lines and other
similar services and equipment and appurtenances above, on and below the surface of the
ground for the purpose of serving the general public or abutting property; and the right so
reserved shall also include such lateral connection or branch lines as may be ordered,
desired or permitted by the'City or such other utility and to enter upon the premises to
accomplish the above purposes at any and all times. No buildings, improvements, or
other structures shall be placed in, on, over, or across said vacated right-of-way without
express written approval of the City. All vegetation upon the premises, including but not
limited to, trees, bushes, and crops, and all structures upon the premises, including but
not limited to, buildings, walls, fences, drives and walks, may be damaged or removed as
necessary in the exercise of the rights herein reserved without compensation to any
person.

Section 2. That the 15' storm sewer in the vacated area and storm inlet 0022287B will be
released to the vacation right-of-way recipient to be privately maintained.
Section 3. That this Ordinance shall be in full force and take effect fifteen (15) days from

WHEREAS, the City Planning Board, at its meeting of April 6, 2016, recommended to the City
Council that the following parcel of right-of-way be vacated, to wit:
Vacation of part of North 22nd Street adjacent to Cuming Street to the North and the
remnant alley extending from the East right-of-way line of North 22nd Street to West
right-of-way line of North 21st Street together with the 20 foot wide alley between the
East right-of-way line of 21st Street and the Southerly projection of the East line of the
West 22 feet of Lot 3, Block 205 1/2 of the Original City of Omaha.
WHEREAS, Section 14-375, Reissue Revised Statutes of Nebraska, 1943, provides that:
"Upon recommendation of the City Planning Board, the City may, by ordinance or resolution,

above said right-of-way; and,
WHEREAS, notice was given that a hearing was to be held on Tuesday, January 24, 2017, at
8:15 a.m. in the City Council Office, Omaha/Douglas Civic Center, 1819 Farnam Street,
Omaha, Nebraska, to assess damages, if any.
NOW, THEREFORE, that Councilmembers Chris Jerram, Pete Festersen and Aimee Melton
report to the City Council that it assesses no damages in favor of the owners or parties
affected.

The attached Ordinance approves the vacation of North 22nd Street adjacent to Cuming Street to
the North and the remnant alley extending from the East right-of-way line of North 22nd Street
to the West right-of-way line of North 21 st Street, together with, the 20 foot wide alley between
the East right-of-way line of 21 st Street and the Southerly projection of the East line of the West
22 feet of Lot 3, Block 205 1/2, of the Original City of Omaha. The applicant is the Planning
Board on behalf of the City of Omaha.
CASE DESCRIPTION: The purpose is to vacate the right-of-way and allow its consolidation
with the adjacent properties.
DEPARTMENT RECOMMENDATION: Approval, subject to retention of any and all
necessary easements and releasing the storm inlet and public combination sewer within the
proposed vacation to the property owner for private maintenance.
PLANNING BOARD RECOMMENDATION: Approval, by consent, as recommended by the
Planning Department, 7-0.

I. GENERAL INFORMATION:
Purpose:To vacate the right-of-way and allow its consolidation with the adjacent properties.
Adjacent Land Use and Zoning:
North: Civic DS-ACI-1(PL)
South: Civic DS-ACI-1(PL)
East: Civic DS-ACI-1(PL)
West: Transportation DS-ACI-1(PL)
Future Land Use Plan Designation:Civic to the northwest and industrial to the east.
II. SPECIAL INFORMATION:
Public Works: Public Works has reviewed this request and has no objection to the vacation with the
following conditions:
1. The Public Works Department requires that easements be retained.
2. The vacation will release the storm inlet and public combination sewer within the proposed
vacation to the property owner for private maintenance.
III. ANALYSIS:The proposed vacation is consistent with City policy regarding vacation of unneeded
and/or excess right-of-way.
IV. RECOMMENDATION: Approval,subject to retention of any and all necessary easements and
releasing the storm inlet and public combination sewer within the proposed vacation to the property
owner for private maintenance.
