Transmitted herewith is a Resolution approving Amendment No. 2 to a Professional Services
Agreement with HDR Engineering, Incorporated to perform additional project management,
design, and coordination services for OPW 52534, being the recertification of the Omaha Levee
Project. The original Agreement was approved by Council Resolution No. 1109 on September
9, 2014.
The attached Amendment to the Agreement authorizes HDR Engineering, Incorporated to
proceed with Phase 1 engineering services, as detailed in Exhibit B. HDR Engineering,
Incorporated has agreed to perform these services for a fee not to exceed $299,086.85. The
fees detailed in Exhibit C of the attached Amendment are to be paid from 2014 Environment
Bond Fund 13124, Environmental Bonds Organization 117217.
HDR Engineering, Incorporated has filed the required Contract Compliance Report, Form CC-1,
in the Human Rights and Relations Department.
The Public Works Department requests your consideration and approval of the attached
Resolution and Amendment to the Professional Services Agreement.

The purpose of this memorandum is to provide additional detail to support the additional services
included in the City of Omaha Levee Certification Phase I,Amendment 2 estimate.
1.0 Additional Services—New Tasks
One reason for the amendment is the need to break up the plan set and construction time table for the
Relief Well Improvements Project to match funding availability.A portion of this amendment covers:
• Task 100:Time associated with additional project management and client coordination time
given the delay in project bidding (construction to begin in the Summer of 2017 to allow for
drillers to begin drilling relief wells to maximize time for excavation construction during the non-
flood season).
• Task 510-Break OPCC Into Areas/Determine Future Costs:
o Time associated with splitting project costs into the various relief well areas for the
City's use in project planning.
o Time associated with projecting future project costs in future phases of analysis, design,
construction, and documentation with FEMA for the City's use in project planning.
• Task 540—Complete Utility and Stakeholder Coordination: Time associated with additional
coordination with UPRR, OPPD, Eppley Airfield, and other utilities and stakeholders associated
with completing project design.This includes verifying UPRR design allowance for open cutting
through the abandoned spur line in Area A2 and for verifying OPPD design requirements for
construction adjacent to their transmission tower in Area Al.
• Task 540- Break Out First Bid Package for Areas Al,A2, and D1:Time associated with breaking
out the plan set for the first three relief well areas that will start construction in 2017 from the
remainder of the project.
• Task 660:Additional ROW coordination is anticipated with respect to providing the City's ROW
Department with revised drawings to begin negotiations, and coordination with ROW personnel
with respect to property owner and stakeholder questions during negotiations for permanent
and temporary construction easement.
2.0 Additional Services—Unexpected Costs for Existing Tasks
A second reason for the amendment is the need to capture unexpected cost overruns and
accommodate the complexity of the project moving forward.See the items below:
• Task 200:Additional services associated with the existing site conditions versus what had been
anticipated or assumed as part of the scope and additional effort in coordinating with USACE
were encountered as part of the Project. See the items below:
i. Variable Site Conditions:The subsurface conditions encountered were significantly more
variable than anticipated at scope development stage. The variability required
additional effort to identify representative sections for geotechnical analysis and design.
ii. Inaccurate Site Elevation Data: Initial geotechnical calculations and model runs were
conducted using a new survey from our subconsultant for the levee embankment and
drainage infrastructure, a second survey of the levee embankment conducted as part of
the O&M Manual update, and LiDAR data. However,the initial geotechnical calculations
and model runs were matching the field conditions observed in the areas of the
emergency seepage berms installed during the 2011 flood. It was found that the survey
did not include the emergency seepage berms that were installed in 2011. A survey was
conducted for the anticipated relief well areas.The new survey showed a change in
elevation and site conditions in some areas which resulted in a complete re-evaluation
of the relief well reaches and the need to recalculate the relief well design.
• Task 510: Additional services associated with coordinating with USACE were encountered,
resulting in the need to perform recalculations. See the items below:
i. USACE Coordination on Questions: Additional effort was expended in coordinating with
USACE on technical issues associated with the geotechnical analysis. In the summer of
2015, a meeting was requested with USACE. USACE elected to conduct email
correspondence in lieu of a meeting due to the lack of availability of its technical staff
members. After several emails and phone calls on some of these issues, it was
determined that a document generated in 2012 by USACE regarding seepage along the
Omaha Levee had errors in the document in September 2015. An expected round of
revised calculations were completed in support of the 60% submittal.
ii. Receipt of USACE Requested Data: Documents requested from USACE near the
beginning of the project were not produced until August 2015 and early 2016.These
documents had information critical to the original relief well design and pointed out an
oversight in the USACE's original permeability derivation for the sand strata. The
information within these documents resulted in a change in relief well calculations and
ultimately the design.
iii. Coordination of Corps I-Wall Software: USACE Engineering and Construction Bulletin
(ECB) 2014-18 "Design and Evaluation of I-Walls Including Sheet Pile Walls"
recommended the use of a USACE-generated computer program titled Corps I-Wall
Version 1.0 for submittal of rotational stability and deflection analyses of I-walls. It was
not until we coordinated with USACE on the location of this program that it was
determined that funding constraints forced the termination of this free service to non-
governmental entities. It was recommended to try to obtain the program through
USACE Omaha District personnel, but local staff was not familiar with the guidance
document or the program.
iv. Additional Coordination of Numbering of/Abandoned Relief Wells: The initial
information we obtained from the as-builts on the well numbers and locations was
incorrect and had to be corrected. Many existing wells that were abandoned as part of
the Eppley Levee Relocation project were not located, the collector pipe was not found,
and their condition is unknown.
• Task 510: Additional services associated with USACE submittals. See the items below:
i. Unanticipated USACE Submittals for Bore and Jack Design: Once design began and the
proposed collector pipe and relief well route were identified,several bore and jack
locations were proposed.The design team recommended the use of bore and jack
locations to help provide geotechnical parameters for the contractor to use in planning
for the bore and jack pits.The coordination and submittal to USACE for the additional
geotechnical investigation are additional services that were unanticipated.
ii. Unanticipated USACE Submittals for Conflicts with Collector Pipe System: Due to the
depth of the existing infrastructure, excavation was carefully thought out in order to
determine limits of construction and identify adjacent conflicts.The unanticipated
additional effort included the development of cross sections,the coordination and
submittal of a USACE request for test pits to identify foundation limits(due to the lack of
as-builts), and the completion of test pits.
iii. Building Foundation Test Pit Coordination:The USACE Test Pit Section 408 submittal
required additional coordination with the City, property owners, and the subconsultant
responsible for the test pits in order to schedule the investigation.
• Task 540: Additional services associated with Right of Way (ROW) coordination was
encountered with the project. See the items below:
i. Right of Way Coordination with Railroads:We have had difficulty obtaining responses
from Canadian National and Union Pacific Railroads. Coordination is ongoing and we still
need their approval regarding some design related questions.
ii. Right of Way Coordination with City ROW: Coordination in getting the required title
work from the City to LRA for purposes of understanding existing easement boundaries
has been more extensive than assumed or budgeted.The assumptions at the start of
the project was that all title work requested would be provided at one time.
Table 1 on the next page provides a comparison in original budget (between the original contract and
Amendment No. 1) and actual hours spent, with a listing of hours and budget included for those
additional services specified above in Section 2.0.Table 2 provides a summary of hours and budget for
those new tasks included in Section 1.0 above, with a summary of all costs included in Amendment No.
2.See the attached scope and fee spreadsheet to see more detail for the hours included in Amendment
No. 2.

THIS AMENDMENT, made and entered into this_ 1 04-- day of

2017 by and between the firm of HDR Engineering, Incorporated, a corporation of the
State of Nebraska, with offices at 8404 Indian Hills Drive, Omaha,Nebraska 68114 and
hereinafter referred to as the"Consultant", and the City of Omaha,Nebraska, acting by
and through its Mayor, hereinafter, referred to as the"City".
WHEREAS,the City desires to engage the Consultant to amend the Engineering
Agreement for OPW 52534, being the City of Omaha Levee Recertification Project
which was entered into on September 9, 2014, hereinafter called existing Agreement.
NOW THEREFORE, it is hereby agreed that the existing Agreement be amended as
follows:
1. The existing agreement shall be amended to include additional data collection
and evaluation services as outlined in the attached"Exhibit B", Scope of
Services.
2. The fee will consist of a compilation of estimated direct salary costs, direct
non-salary costs, indirect salary costs, indirect non-salary costs and direct
salary payroll additives, as provided in Exhibit"C" attached.
3. This modification will increase the existing agreement by $299,086.85
This AMENDMENT shall be deemed a part of, and be subject to all terms and conditions
of the existing Agreement. Except as modified above,the existing Agreement shall
remain in full force and effect.
IN WITNESS WHEREOF, the parties hereto have caused presents to be executed
by their proper officials thereunto duly authorized as to the dates below indicated.

SCOPE OF SERVICES —AMENDMENT NO. 2
PART 1.0 AMENDMENT DESCRIPTION
The Missouri River Levee Certification Project is being conducted in four phases as follows:
I. Data Collection and Evaluation (Current phase)
II. Alternatives Analysis (Future phase)
III. Design, Permitting, and Construction of Levee System Improvements (Future phase)
IV. Levee Certification Document Preparation and Submittal (Future phase)
The CITY approved the Phase I SCOPE OF SERVICES on September 11, 2014, and Phase I
Amendment No. 1 on June 30, 2016. This amendment (Amendment No. 2) is for additional
services required to complete the Data Collection and Evaluation Phase that are not covered by
the original scope of work or Amendment No. 1.
PART 2.0 SCOPE OF SERVICES
An outline for modified tasks and new tasks to be added to the SCOPE OF SERVICES for
Amendment No. 2 is provided below:

The following scope defines the work elements associated with Amendment No. 2 of Phase I of
the Missouri River Levee Certification Project. The work described for Tasks 110, 220, and 510
is for work that has already been completed by the design team. The additional work
associated with these tasks was the result of the complexity of tasks exceeding the complexity
anticipated as part of the original scope, recalculation due to new data, additional coordination,
and extension of the project timeframe. The work described for Tasks 540 and 660 has not yet
been completed. Task 540 is the result of dividing the project documents into smaller bid

packages at the request of the City. Task 660 is a new task not previously identified in the
original scope.
TASK SERIES 100 — PROJECT MANAGEMENT AND COORDINATION
Additional project management and coordination is required to accommodate the change in
project schedule and revisions to the bid package approach. Provide management activities
over the remainder of the Project duration including planning, organizing, and monitoring Project
Team activities, preparing and monitoring design criteria, attending meetings, coordinating with
the CITY and agencies, managing subconsultants, and Project cost control.
HDR Activities: 110 — Proiect Management, Manage Subconsultants and
Coordination
The original contract was based on the assumption that work for Phase 1
would be completed in July 2017. Based on the need to limit excavation
activities to the non-flood season, and the need to repackage the plan set
to meet budgetary requirements, it is anticipated that Phase 1 will not be
completed until April 2018. This schedule change necessitates adding
time for the following tasks:
• Managing internal team.
• Coordinating with the City's PM and the City's Team.
Meetings/Travel: None
Task Deliverables: Monthly invoicing
Key Understandings
and Assumptions: - Calls will be held on once per month basis.
- This amendment assumes completion of Phase 1 by April 2018.
Extension of the project beyond this date will require an additional
amendment.

Subsurface conditions were more variable than assumed in the original scope. Additional
analyses and were required as a result of this variability and survey errors in products provided
to HDR.
HDR Activities: Task 220 —Collect and Review Available Data
• The subsurface conditions encountered were significantly more
variable than anticipated for the original scope. The result of the
increased variability of the subsurface conditions is that additional
effort was required to identify representative sections and evaluate
additional representative sections for geotechnical analysis and
design.
• Initial calculations and model runs were based on a combination of
the survey information from our subconsultant, the survey of the levee
embankment conducted as part of the O&M Manual update, and
LiDAR data. Additional survey landward of the levee in relief well
areas necessitated changing the top of grade elevations and
adjustment of subsurface soil profiles. Geotechnical calculations were
redone to account for these adjustments.
Meetings/Travel: None.
Task Deliverables: None.
Key Understandings
and Assumptions: Revisions to the subsurface profiles have already occurred. Additional
changes to the subsurface profile will not be made until Phase II.

by Others: - The CITY will provide requested data, if available.- The CITY will
request required data from the USACE.
TASK SERIES 500— RELIEF WELL REPAIR AND REHABILITATION DESIGN AND
PERMITTING
Extensive coordination was required with USACE to review collected data, review the design
approach, answer questions, and respond to comments. This level of coordination exceeded
the level anticipated in the original scope.

HDR Activities: 510— Draft(60) Percent Drawing and Specifications Development
• Coordinated with USACE on technical questions and requests
associated with the geotechnical analysis.
• Delay in receipt of requested information resulted in a relief well
design change due to the information provided.
• Coordinated with USACE on use of their I-Wall analysis tool.
• Coordinated with USACE on relief well numbering and location of
abandoned relief wells and collector pipe.
• Coordinated unanticipated USACE Section 408 submittals for design
support.
• Coordinated with USACE on identifying project excavation limits and
setting construction limitations in order to define ROW and levee
impacts. The excavation limits and construction limitations informed
the Section 408 submittal and were incorporated into contract
documents. Additional review comments from USACE resulted in the
need for additional testing for adjacent building foundation information
and submittal of additional documentation for the Section 408
submittal.
• The USACE required excavation of a test pit in support of the Section
408 submittal. This required coordination with the City, property
owners, and the subconsultant responsible for making the test pits.
• Coordinated with utility companies and stakeholders on ROW and
design questions.
• Coordination to acquire titles for our subconsultant's use in providing
CADD defined easement limits exceeded the original time anticipated.
• Divided the Opinion of Probable Construction Cost (OPCC) into the
USACE defined relief well areas to provide the City with per-area
construction costs.
• Estimated future project engineering and construction costs.
HDR Activities: 540— Prepare Bidding Documents
• Complete utility and stakeholder coordination for final construction
plans.
• Create a separate bid package for Relief Well Areas Al, A2 and D1.
Meetings/Travel: No changes to initial scope.
Task Deliverables: -Prepared and submitted the Adjacent Building Foundation Test Pit
Section 408 Submittal.
-Prepared and submitted the bore and jack Section 408 Submittal.

TASK SERIES 600—ADDITIONAL SERVICES
Revised ROW strip maps are required to assist the City with landowner negotiations as
described below prior to development of easement legal description exhibits.
HDR Activities: 660—Additional ROW Coordination
HDR will coordinate with the City and ROW Department to create ROW
strip map drawings that can assist with landowner negotiations for Areas
Al, A2, and D1. The drawings will consist of 11" x 17" exhibits to include
an aerial background, existing ROW and easement boundaries, and
proposed temporary or permanent easement or ROW boundaries. The
exhibits will be used by the City's ROW Department to begin negotiations
with property owners and to answer questions during negotiations for
permanent and temporary construction easements.
Meetings/Travel: None.
Task Deliverables: Eight (8) 11x17 General ROW strip maps
Key Understandings
and Assumptions: -The City will be responsible for providing strip maps to property owners,
coordinating with property owners on solicitation of review comments, and
will provide a single set of compiled property owner comments to HDR for
each review cycle per area.
-There will be a total of three review cycles per area coordinated by the
City. A new set of strip maps will be created based on landowner
comments and delivered electronically after each review cycle per area.
- HDR will not participate in landowner coordination or negotiations
(unless additional services are approved through a separate
amendment).
- If additional review cycles, or more frequent updates to strip maps are
requested, an Amendment for Additional Services will be required.
