Re: 620 South 38th Avenue, adjacent to Jones Street (building addition)
Attached is a request of the University of Nebraska Board of Regents for a lease of City
property adjacent to 620 South 38th Avenue (adjacent to Jones Street) for approval of a building
addition.
This request has been reviewed and the recommendations of the Departments are as follows:
• City Planning Department and Public Works Department recommend approval of the lease
request, subject to the following additional conditions:
a. The applicant for this lease has, by a separate application, petitioned the City to vacate a
part of the Jones Street right-of-way ("ROW Vacation"). The ROW Vacation encompasses
the area covered under this lease. In the event that the ROW Vacation is approved by the
City Council, then this lease shall be terminated, as the area covered under this lease
would then become the property of the applicant.
b. In the event that the ROW Vacation is denied by the City Council, or on October 31,
2019 (whichever occurs first), then this lease may be terminated by the City, at which time
the applicant shall remove all private improvements from the right-of-way, including any
encroachments above, below, or at grade, and the applicant shall return the leased right-of-
way to the condition as it existed prior to the execution of this lease. The applicant agrees
that it shall be responsible for all costs associated with the removal of private improvements
and restoration of the right-of-way.
A plot plan showing the location of the building addition is attached.

Description of Intended Use A vacation application has been filed for a portion of Jones Street ROW lying
west of 38th Avenue and east of 40th Street. It is intended that the area will be used to begin the addition
to the Ronald McDonald House, while the vacation process takes place. Allowing access to the area will
allow the Ronald McDonald House to begin construction in the available window before the winter season.

to be in compliance with all City regulations - •
