Bonds under this Ordinance may be issued for the purpose of providing funds for the payment of the cost of constructing, reconstructing, improving, extending and equipping of storm sewers, sanitary sewers, interceptor sewers, combined sewers, relief sewers, or combinations thereof, including necessary plans and specifications, and acquiring such lands and rights-of-way and easements as may be required, but excluding the cost of City construction equipment and payment of salaries to City employees. This bond authorization funds the projects identified in the 2018-2023 CIP, which was approved by City Council Resolution No. 979 on August 22, 2017. The approval of this Bond issue will not incur any increases in the Property Tax Levy Rate of the City of Omaha over the 2018 tax levy rate as applicable to the 2019 tax collection year. That there be, and hereby is, called a Special City Election to be held in the 17 City of Omaha, Douglas County, Nebraska, on May 15, 2018 for the purpose of submitting to 18 the qualified electors at said Special City Election, for their approval or rejection a proposal to 19 authorize the City Council of the City of Omaha, without further vote of the electorate, to issue 20 and sell General Obligation Bonds of the City of Omaha in an amount not to exceed Eleven 21 Million Four Hundred Seventy-Five Thousand and No/100 Dollars ($11,475,000) from time to 22 time, but not later than December 31, 2026, for the purpose of providing funds for the payment 23 of the cost of constructing, reconstructing, improving, extending and equipping of storm sewers, 24 sanitary sewers, interceptor sewers, combined sewers, relief sewers, or a combination thereof, ORDINANCE NO. 4) 3q5 PAGE -2- 1 and other related branch sewer main construction in the City of Omaha, as required in the 2 design and construction of sewer facilities, including necessary plans and specifications, and 3 acquiring such lands and rights-of-way and easements as may be required, but excluding the 4 cost of City construction equipment and payment of salaries to City employees. 5 Such bonds shall be payable from taxes upon all taxable property in said City, subject to 6 taxation by said City, in amount required to be levied by Section 5.07 of the Home Rule Charter 7 of the City of Omaha, 1956, as amended, for the payment of the indebtedness of said City. No 8 other election shall be required to authorize the issuance of such bonds. Bonds issued 9 pursuant to this authority shall be required to authorize the issuance of such bonds. Bonds 10 issued pursuant to this authority shall mature in such amounts and at such times as the City 11 Council shall determine but not more than twenty (20) years from the date thereof. 12 The approximate cost to the taxpayers of the City that will be incurred if this proposal is 13 approved and the City Council authorizes, issues and delivers all the bonds for the purpose 14 herein provided is Eleven Million Four Hundred Seventy-Five Thousand and No/100 Dollars 15 ($11,475,000) plus interest to be payable on such bonds and the approval of this Bond issue will 16 not incur any increase in the Property Tax Levy Rate of the City of Omaha. 17 Section 2. That said proposition shall be submitted to the qualified electors of the City 18 of Omaha in substantially the following form: 19 "STATE OF NEBRASKA 20 COUNTY OF DOUGLAS 21 CITY OF OMAHA 22 23 OFFICIAL BALLOT 24 SPECIAL CITY ELECTION 25 HELD MAY 15, 2018 26 $11,475,000 ENVIRONMENT SEWER BONDS ORDINANCE NO. 4I315 PAGE -3- 1 SHALL THE CITY OF OMAHA BE AUTHORIZED TO ISSUE AND SELL GENERAL 2 OBLIGATION BONDS IN THE AMOUNT OF ELEVEN MILLION FOUR HUNDRED SEVENTY- 3 FIVE THOUSAND AND NO/100 DOLLARS ($11,475,000) FOR THE PURPOSE OF 4 PROVIDING FUNDS FOR PAYMENT OF THE COST OF CONSTRUCTING, 5 RECONSTRUCTING, IMPROVING, EXTENDING AND EQUIPPING OF STORM SEWERS, 6 SANITARY SEWERS, INTERCEPTOR SEWERS, COMBINED SEWERS, RELIEF SEWERS, 7 OR A COMBINATION THEREOF,. Under said question and proposition on the ballot shall be printed the word 20 "Yes" and the word"No". All ballots of qualified electors cast at the aforesaid election with an 21 "X" or other clear or intelligible mark placed before the word "Yes" shall be understood to be, 22 and shall be counted, in favor of the proposition set forth in said question, an&°all ballots of 23 qualified electors cast at the aforesaid election with an "X" or other clear or intelligible mark • 24 placed before the word "No" shall be understood to be, and shall be counted, against the 25 proposition set forth in said question: 26 Section 4. That said ballots shall be white in color and printed in black ink or other color 27 designated in conformance with Section 32-806 of the Revised Statutes of Nebraska, 1943, as 28 amended. 29 Section 5. The officer having charge of General and Special Elections of the City of 30 Omaha shall conduct the election on the question herein provided in all respects the same as 31 other City elections and in the manner provided by law. The City Clerk is hereby directed to transmit a certified copy of this 2 Ordinance to the Election Commissioner of Douglas County, Nebraska, and to give public notice 3 to the electors, as provided by law. 4 Section 7. This Ordinance is declared to be administrative and not legislative in 5 character and, therefore, under the provisions of Section 2.12 of the Home Rule Charter of the 6 City of Omaha, 1956, as amended, and Rule 7 of the Rules adopted by the City Council of the 7 City of Omaha, it shall become effective from and after its adoption.
