The attached Resolution approves the First Amendment to Subdivision Agreement among Sean
J. Ns .gus, the Country Club Hills Homeowners Association, and the City of Omaha. This First
Amendment to Subdivision Agreement covers the public improvement of Country Club Hills (Lots
1-15 and Outlots A-B), a subdivision located southwest 63rd and Girard Streets.
The Public Works Department requests your consideration and approval of the attached
Resolution and First Amendment to Subdivision Agreement.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Sean J. Negus proposes to build a subdivision to be known Country
Club Hills (Lots 1-115 and Outlots A-B)which will be located southwest of 63rd and Girard Streets;
and,
WHEREAS, Sean J. Negus, the Country Club Hills Homeowners Association, and
the City entered into a Subdivision Agreement as adopted by the City Council of the City on
. December 4, 2012, by Resolution No. 1487; and,
WHEREAS, the parties wish to amend the Subdivision Agreement to include a tree
mitigation plan; and,
WHEREAS, a First Amendment to Subdivision Agreement has been prepared setting
forth all the provisions mentioned above.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
OMAHA:
THAT, the First Amendment to Subdivision Agreement among the City of Omaha,
Sean J. Negus, and the Country Club Hills Homeowners Association, as recommended by the
Mayor, providing for the tree mitigation plan, is hereby approved. The Subdivision is to be known as
Country Club Hills(Lots 1-15 and Outlots A-B)and is located southwest of 63rd and Girard Streets.

THIS FIRST AMENDMENT TO SUBDIVISION AGREEMENT, made and entered into this 27 day of
IUnie'►I�ef_ , 2017, among, SEAN J. NEGUS of OAK POINT PROPERTIES, secretary, (hereinafter
referred to as "Subdivider"), The COUNTRY CLUB HILLS HOMEOWNERS ASSOCIATION, (hereinafter
referred to as "Association") and the CITY OF OMAHA, a Municipal Corporation in the State of Nebraska
(hereinafter referred to as "City")
WITNESSETH
WHEREAS, Subdivider is the owner of the land included with the proposed plat attached hereto as Exhibit
"A", (hereinafter referred to as the "Area to be Developed"); and,
WHEREAS, the Subdivider proposes to build improvements in the area to be developed; and '
WHEREAS, the Subdivider has or will create the Country Club Hills Homeowners Association, Inc..
comprised of the property owners of Lots 1-14 and Outlots A & B; and,
WHEREAS, the parties wish to agree on the method for the installation and allocation of expenses for
improvements to be constructed in the property.
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
1. The following paragraph is hereby added to and made a part of SECTION I of the Agreement:
J. Subdivider agrees to provide and plant trees on Outlot "B" in accordance with the Tree
Mitigation Plan attached hereto as Exhibit "J"
2. Exhibit "J" entitled "Tree Mitigation", is hereby attached to and made part of this agreement.
This First Amendment to the Subdivision Agreement shall be binding upon the parties, their respective
successors and assigns and shall run with the land as shown on Exhibit "A".
Except as modified by this First Amendment, the Agreement shall remain in full force and effect.

IN WITNESS WHEREOF, we the executing parties, by our respective duly authorized agents, hereby enter
into this Agreement, effective on the day and year first above written.
