Transmitted herewith is a, RESOLUTION authorizing the payment to RAY MARTIN COMPANY
OF OMAHA, INC. in the amount of $35,000.00 to provide ongoing service, operation and
maintenance; which includes the Ice Machine for the Ice Rink at the Motto McLean Ice Arena,
located at 5015 South 45th Street, Omaha, NE for the Parks, 'Recreation and Public Property
. Department.
RAY MARTIN COMPANY OF OMAHA, INC. is the only known vendor that can supply this
service/product. The ice rink has an extremely unique system that maintains the cooling for th3
ice rink. We are unaware of any other system of this type that is still in operation within the
continental U.S. To allow a new contractor to come in and "learn" the system to perform this
service, involves great risk since, there is over$250,000 in Freon alone in the system that could
be caused to leak out into the atmosphere; therefore, it is a sole source vendor and a firm
qualified to provide the products/services contemplated herein. In accord with the provisions of
Section 5.16, Home,Rule Charter, when there is a sole source vendor, the City Council may, by
resolution, authorize the Purchasing Division to issue a purchase order for the product and/or
services.
The Finance Department is authorized to pay the Funds in the amount of $35,000.00 to RAY
MARTIN COMPANY OF OMAHA, INC., from the General Fund No. 11111 and Organization
No. 115211, Motto McLean Ice Arena, for the 2018 fiscal year.
The Parks, Recreation and Public Property Department recommends the acceptance of the
quote from RAY MARTIN COMPANY OF OMAHA, INC. in the total amount of $35,000.00, •
attached hereto and made a part hereof, and requests your consideration and approval of this
Resolution.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Ray Martin of Omaha, Inc. has submitted a contract pricing to provide
ongoing service, operation and maintenance; which includes the Ice Machine for the Ice Rink at
the Motto McLean Ice Arena, located at 5015 South 45th Street, Omaha, NE for the Parks,
Recreation and Public Property Department;_and,
WHEREAS, Ray Martin of Omaha, Inc. is the only known vendor that can supply this
service/product; therefore, Ray Martin of Omaha, Inc. is a sole source vendor; providing a
unique and non-competitive service/product, and as provided in Chapter 5.16 of the Home Rule
Charter 1956 as amended, no competitive bidding is necessary; and,
WHEREAS, Ray Martin of Omaha, Inc. is a firm qualified to provide the product/service
contemplated herein in the amount of$35,000.00; and,
WHEREAS, Ray Martin of Omaha, Inc. has complied with the City's Contract
Compliance Ordinance No. 28885 in relation to Civil Rights - Human Relations; and,
WHEREAS, the Mayor has recommended acceptance of this pricing.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
OMAHA:
THAT, as recommended by the Mayor, the purchase based upon the contract pricing
from Ray Martin of Omaha, Inc., in the amount of $35,000.00 to provide ongoing service,
operation and maintenance; which includes the Ice Machine for the Ice Rink at the Motto
McLean Ice Arena, located at 5015 South 45th Street, Omaha, NE, for the Parks, Recreation

We hereby request that Ray Martin be considered as a Sole Source provider for
the Service, Operations, and Maintenance at the Motto McLean Ice Arena
This ice rink has an extremely unique system that maintains the cooling for the
ice rink. We are unaware of any other system of this type that is still in operation
within the continental U.S. To allow a new contractor come in and "learn"the
system to perform this service, involves great risk since, there is over$250,000
in Freon alone in the system that could be caused to leak out into the
atmosphere. A leak of this magnitude could cause environmental, as well as.
financial concerns.
Ray Martin has performed this service since 2015 on this system. They have
licensed plumbers, steam fitters, and HVAC service technicians on staff and on
call, in the event of emergencies.
To the best of our knowledge, there are no other companies that would provide
24 hours service on this type of equipment; and has performed that service for
the last (3) three years.
