Transmitted herewith is a Resolution approving an Amendment to Agreement With College
World Series; 'Inc. (CWS), providing for improvements to the specialty signage in Downtown
Omaha surrounding the College World Series' venues.
According to the terms of this Amendment, the City is requesting that various bracket and
bracket arms in need of`repair this year are to be replaced by CWS while it is undertaking the '
installation of its specialty" banners in the downtown area. The City, in turn will provide for the
cost of the replacement Of .these bracket and bracket arms, currently eStiMated tb be
$35,000..00. This cost will be paid from the street and Highway Allocation Fund 12131, Traffic
Control Signs Organization 116188.
The Public Works Department requests your consideration and approval of the attached
Resolution and Agreement.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, the City of Omaha and College World Series, Inc. (CWS) have
entered into the agreement dated July 15, 2010 defining the roles and responsibilities of each
organization for the annual College World Series baseball tournament; and,
WHEREAS, in said agreement the City has agreed to provide for replacement
brackets and bracket arms which are installed on certain downtown street lights and used for
removable banners placed and provided by-CWS; and,
WHEREAS, the City desires to provide for CWS to complete the replacement of
specific bracket and bracket arms needing to be changed out in 2018 per the terms of the
attached Amendment to Agreement, which by this reference becomes part hereof; and,
WHEREAS, the cost of this project, currently estimated to be $35,000.00, will be
paid from the Street and Highway Allocation Fund 12131, Traffic Control Signs Organization
116188.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT, as recommended by the Mayor, the Amendment to the Agreement with
College World Series, Inc. providing for the replacement of certain brackets and bracket arms
on certain street light poles in downtown Omaha, is hereby approved.
BE IT FURTHER RESOLVED:
THAT, the Finance Department is authorized to pay the cost of this repair,
currently estimated at $35,000.00 from the Street and Highway Allocation Fund 12131, Traffic
Control Signs Organization 116188.

AMEMDMENT TO AGREEMENT
THIS AMENDMENT TO AGREEMENT is hereby made and entered into this 9 day of
MctaL, 2018, by and between the City of Omaha, a municipal corporation located in Douglas
County, Nebraska (hereinafter referred to as the "City"), and College World Series, Inc., a Nebraska
corporation (hereinafter referred to as the "CWS"), on the terms, conditions and provisions as set forth
herein below.
WHEREAS, in a July 15, 2010 Agreement ("Agreement") the parties agreed that CWS could
install, maintain, and nonexclusively use the brackets and bracket arms on certain street light poles in
downtown Omaha for the display of removable banners;and,
WHEREAS, section 7 of the Agreement provides that the City will provide any repairs to the
brackets and bracket arms;and,
WHEREAS,the said brackets and bracket arms are in need of immediate repair this year;and,
WHEREAS,the parties agree that it would be to their mutual benefit to amend the Agreement for
this year only, to provide that CWS perform the replacement of the brackets and bracket arms this year,
with the City to reimburse CWS for the cost of such work.
IT IS THEREFORE AGREED THAT THE AGREEMENT IS AMENDED AS FOLLOWS:
I. CWS agrees to install banner brackets and bracket arms on street light poles in downtown Omaha,
during 2018. The brackets and bracket arms shall be installed on all of those poles currently
equipped with such brackets and arms, as defined in the Agreement. The replacement brackets and
bracket arms shall be substantially similar in size and function to those currently in use.
II. The City agrees to pay to CWS the cost of materials and labor to install the replacement brackets
and bracket arms, during 2018. Such cost to be reimbursed to CWS shall not exceed $35,000,
unless otherwise approved in advance by the City. After completion of the work, CWS shall send
an invoice to the City for the cost. The City will reimburse CWS for such cost within 30 days
thereafter.
III.. In all other respects,the Agreement shall remain in full force and effect as initially executed.
