WHEREAS, the City of Omaha has received funds from the Nebraska Crime Commission, FY • 2017 STOP Violence Against Women Act(VAWA)Grant,Award#17-VW-0711; and, WHEREAS, the City has agreed to administer the Nebraska Crime Commission, FY 2017. STOP Violence Against Women Act (VAWA) Grant, Award #17-VW-0711 (hereinafter referred to as "Grant Award"); and, WHEREAS, the City will issue a subaward with the Contractor as described below, to obtain the Contractor's services in the implementation of the Grant Award. NOW, THEREFORE, in consideration of the mutual covenants and agreements herein contained, the City and the Contractor mutually undertake and agree as follows: I. DUTIES OF THE CONTRACTOR The Contractor agrees to do the following, along with all other obligations expressed or implied in this Agreement: A. The Contractor will provide the services and duties as stated more fully in the Grant Award and Special Conditions, Grant Application, Revised Budget/Budget Narrative, Letter Addressing Contingencies, and any future approved budget modifications. The Contractor shall provide: one (1) full-time Domestic Violence Prosecution Unit (DVPU) Liaison to assist in the communication between the prosecuting attorney, law enforcement, victims, and victim advocacy groups; and one (1) partially full-time DVPU Misdemeanor Prosecutor to prosecute misdemeanor domestic violence cases. The Contractor will be responsible for all aspects of the project including day-to-day management, bidding, purchasing, installation, and implementation. The identity of the chief executive of the Contractor and any changes thereof shall be provided to the City. C. The Contractor shall maintain an accounting system that accurately tracks income and expenditures associated with this agreement separate from other agency funds. D. The Contractor agrees to comply with the financial and administrative requirements set forth in the City of Omaha Grants Management Handbook. E. The Contractor agrees to comply with any additional requirements that may be imposed during the grant performance period if the City determines that the Contractor is a high-risk grantee. F. The Contractor shall be in compliance with specifications outlined in the solicitation under which the approved application was submitted. The program solicitation is hereby incorporated by reference into this award. G. The Contractor understands and agrees that grant funds may be frozen if the Contractor does not respond in a timely fashion to requests to address audit findings and financial or programmatic monitoring findings. H. The Contractor shall allow the City to have access to the Contractor's records and program site for the purpose of financial and/or program audits, as may be required in the sole discretion of the City or its authorized designee. The Contractor shall retain all grant documents for a minimum of five years following the completion of this agreement. I. The Contractor will implement and enforce, as to its employees, a drug-free workplace policy. J. The Contractor will provide an executed W-9 Verification form. K. The Contractor is required and hereby agrees to use a federal immigration verification system to determine the work eligibility status of new employees physically performing services within the State of Nebraska. A federal immigration verification system means the electronic verification of the work authorization program authorized by the Illegal Immigration Reform and Immigrant Responsibility Act of 1996, 8 U.S.C. 1324a, known as the E-Verify Program, or an equivalent federal program designated by the United States Department of Homeland Security or other federal agency authorized to verify the work eligibility status of a newly hired employee. If the Contractor is an individual or sole proprietorship,the following applies: 1. The Contractor must complete the United States Citizenship Attestation Form, available on the Department of Administrative Services website at www.das.state.ne.us. 2. If the Contractor indicates on such attestation form that he or she is a qualified alien, the Contractor agrees to provide the US Citizenship and Immigration Services documentation required to verify the Contractor's lawful presence in the United States using the Systematic Alien Verification for Entitlements(SAVE)Program. -2 - 3. The Contractor understands and agrees that lawful presence in the United States is required and the Contractor may be disqualified or the contract terminated if such lawful presence cannot be verified as • required by Neb. Rev. Stat. §4-108. II. TERM This Agreement shall become effective on the date of execution and shall terminate on June 30, 2019. Permissible expenditures under this grant incurred after July 1, 2018 will be paid as if they occurred after the effective date. Either party may immediately terminate this Agreement upon mailing prior written notice thereof to the other party; provided, that in the event of such early termination, the Contractor shall immediately return to the City all unexpended funds advanced to the Contractor under this Agreement. In the event the grant award period is extended by the grant awarding agency, the Agreement shall automatically extend to the end of the approved extension. In the event the Contractor requires an extension to the terms of the grant agreement, requests must be submitted in writing to the City's Grant Administrator no later than 45 days prior to the end of the grant award period. III. COMPENSATION • The City shall compensate the.Contractor in an amount not to exceed, under any circumstances, $109,442 ("Maximum Compensation"). Following the execution of this Agreement, the Contractor must submit quarterly reimbursement requests by the due by dates outlined under IV. Reporting Requirements. Quarterly Reimbursement Requests must detail grant funds, and any match, expended during the quarter, along with clear, concise, and detailed backup documentation supporting all expenses. Quarterly Reimbursement Requests are required even if no grant funds or match funds were expended during the time period. All requests for reimbursement shall be submitted electronically to the City of Omaha, Mayor's Office, Grant Administrator. Originals shall be retained in the Contractors records and made available upon request for audit purposes. Any tangible equipment purchased by the Contractor with funds pursuant to this Agreement shall be the property of the Contractor. IV. REPORTING REQUIREMENTS The Contractor shall comply with all reporting, data collection and evaluation requirements, as prescribed by the grant awarding agency and the City of Omaha as outlined in the Grant Management Handbook. -3 - A. Quarterly Report Filling Schedule: Programmatic performance reports, and fiscal expense and reimbursement requests are due quarterly as identified below for the life of the Grant Award and during the term of this Agreement. B. Close Out Reporting: Subaward Agreements will only be closed out once all final documentation has been received from the Contractor and approved by the grant awarding agency. Final programmatic performance reports, and fiscal expense and reimbursement requests are due by the deadline identified below. Subgrant Adjustment: Grant funds must be used for the purposes identified in the Contractor's approved application. The Contractor shall not undertake any work or activities that are not described in the grant application, and that uses staff, equipment, or other goods or services paid for with grant funds, without prior written approval from the City's Grant Administrator and the grant awarding agency. The Contractor must submit an adjustment request to the City when any of the following will occur: the focus of the Contractor's funded project changes; there is a change in the start or end date of the funded project; a new project director or fiscal officer is assigned to the grant funded project by the Contractor; or a budget modification is requested by the Contractor to transfer dollars between budget line items. No budget revisions are to be made by the Contractor without prior approval from the City and the Nebraska Crime Commission. • V. INDEMNITY To the extent allowed by law, each party covenants and agrees to indemnify and hold harmless the other party, their officers, agents and employees, their successors and assigns, individually or collectively, from and against all liability for any fines, claims, suits, demands, actions or causes of action of any kind and nature, caused by the negligent acts or omissions of the Indemnifying Party, its officers, agents and employees, for personal injury or death, or property damage in any way arising out of this Agreement, and the Indemnifying Party further agrees to pay all expenses in defending against any claims made against the other party provided, however, that the other party shall give prompt and timely written notice of any claim made or suit instituted which, in any way, directly or indirectly, contingently or otherwise, affects or might affect the Indemnifying Party. -4 - • This Indemnification provision is not intended to waive a Party's sovereign immunity. A Party's liability is governed by and limited to the extent provided by the Nebraska Political Subdivision Tort Claims Act or other applicable provisions of Nebraska law. VI. EQUAL EMPLOYMENT OPPORTUNITY CLAUSE During the performance of this contract,the contractor agrees as follows: 1. The Contractor shall not discriminate against any employee applicant for employment because of race, religion, color, sex, age, sexual orientation, gender identity, disability or national origin. The Contractor shall ensure that applicants are employed and that employees are treated during employment without regard to their race, religion, color, sex, age, sexual orientation, gender identity, disability or national origin. As used herein, the word "treated" shall mean and include, without limitation, the following: recruited, whether by advertising or by other means; compensated; selected for training, including apprenticeship; promoted; upgraded; demoted; downgraded; transferred; laid off; and terminated. The Contractor agrees to and shall post in conspicuous places, available to employees and applicants for employment, notices to be provided by the contracting officers setting forth the provisions of this nondiscrimination clause. 2. The Contractor shall, in all solicitations or advertisements for employees placed by or on behalf of the Contractor, state that all qualified applicants will receive consideration for employment without regard to race, religion, color, sex, sexual orientation, gender identity or national origin, age, disability. 3. The Contractor shall send to each representative of workers with which he has a collective bargaining agreement or other contract or understanding a notice advising the labor union or worker's representative of the Contractor's commitments under the equal employment opportunity clause of the City and shall post copies of the notice in conspicuous places available to employees and applicants for employment. 4. The contractor shall furnish to the Human Rights and Relations Director all federal forms containing the information and reports required by the Federal Government for federal contracts under federal rules and regulations, including the information required by section 10-192 to 10-194, inclusive, and shall permit reasonable access to his records. Records accessible to the Human Rights and Relations Director shall be those which are related to paragraphs (1) through (7) of this subsection and only after reasonable notice is given the Contractor. The purpose of this provision is to provide for investigation to ascertain compliance with the program provided for herein. 5. The Contractor shall take such actions with respect to any subcontractor as the City may direct as a means of enforcing the provisions of paragraphs(1)through(7)herein, including penalties and sanctions for noncompliance; however, in the event the Contractor becomes involved in or is threatened with litigation as the result of such directions by the City, the City will enter into such litigation as is necessary to protect the interests of the City and to effectuate these provisions of this division; and in the case of contracts receiving federal assistance, the Contractor or the City may request the United States to enter into such litigation to protect the interests of the United States. - 5 - 6. The Contractor shall file and shall cause his subcontractors, if any to file compliance reports with the Contractor in the same form and to the same extent as required by the Federal Government for federal contracts under federal rules and regulations. Such compliance reports shall be filed with the Human Rights and Relations Director. Compliance reports filed at such times as directed shall contain information as to the employment practices, policies, programs and statistics of the Contractor and his subcontractors. 7. The Contractor shall include the provisions of paragraphs (1) through (7) of this section, "Equal employment opportunity clause," and section 10-193 in every subcontract or purchase order so that such provisions will be binding upon each subcontractor or vendor. VII. DEBARMENT OR SUSPENSION BY ANY FEDERAL AGENCY Office of Management and Budget(OMB)guidelines require that any individual or entity that has been placed on the Excluded Parties List System (EPLS - available for review through www.sam.gov) may not be a participant in a Federal Agency transaction that is a covered transaction or act as a principal of a person participating in one of those covered transactions. These guidelines apply to covered transactions under a grant award from any Federal agency for which a recipient expects to receive reimbursement for expenditures incurred or an advance on future expenditures. The Contractor providing goods and/or services to the City of Omaha, by acceptance and execution of this Agreement agrees, that neither it nor its principals is presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from participation in this transaction by any Federal department or agency. Contractor further agrees, by accepting and executing this Agreement,that it will include this clause without modification in all lower tier transactions, solicitations, proposals, contracts, and subcontracts. Where the Contractor or any lower tier participant is unable to certify this statement, it shall attach an explanation to this Agreement. VIII. INDEPENDENT CONTRACTOR It is understood and agreed by and between the parties that any and all acts that the Contractor or its employees, agents, contractors or servants perform pursuant to the terms of this Agreement shall be undertaken as independent contractors and not as employees of the City. Neither Contractor nor any of its employees or agents shall be construed to be the employee or agent of the City for any purpose whatsoever. Contractor shall not be entitled to any benefits of the City. The City shall not provide any insurance coverage to the Contractor or its respective employees including, but not limited to workers' compensation insurance. Contractor and the City shall each pay all wages, salaries and other amounts due to its respective employees and shall be responsible for all reports, obligations, and payments pertaining to social security taxation, income tax withholding, workers' compensation, unemployment compensation, group insurance coverage, collective bargaining agreements or any other such similar matters. Contractor shall have no authority to bind the City or by or with any contract or agreement, nor to impose any liability upon the City. All acts and contracts of the Contractor shall be in its own name and not in the name of the City, unless otherwise provided herein. - 6 - IX. CAPTIONS Captions used in this contract are for convenience and are not used in the construction of this contract. X. APPLICABLE LAW Parties to this contract shall conform to all existing and applicable city ordinances, resolutions, state laws, federal laws, and all existing and applicable rules and regulations. Nebraska law will govern the terms and the performance under this contract. XI. CONFLICT OF INTEREST A. No elected official nor any officer or employee of the City shall, during their tenure and one year thereafter, have a financial interest, direct or indirect, in this Agreement or in any funds transferred hereunder. Any violation of this section shall render the Agreement voidable by the City or the Contractor. B. The Contractor covenants that it presently has no interest and shall not acquire any interest, direct or indirect,which would conflict with the performance required to be performed under this Agreement; it further covenants that, in the performance of this Agreement, no person having any such interest shall be employed. XII. WARRANTY AS TO COMMISSIONS Contractor warrants that it has not employed any person to solicit or secure the Agreement upon any agreement for commission, percentage,brokerage, or contingent fee. - 7 - XIII. MERGER This Agreement shall not be merged into any other oral or written contract, lease or deed of any type. This is the complete and full agreement of the parties. XIV. MODIFICATION This Agreement contains the entire agreement of the parties. No representations were made or relied upon by either party other than those that are expressly set forth herein. No agent, employee or other representative of either party is empowered to alter any of the terms hereof unless done in writing and signed by an authorized officer of the respective parties. XV. ASSIGNMENT Neither party may assign its rights under this Agreement without the express prior written consent of the other party. XVI. CONTRACT DOCUMENTS Contractor is responsible for review of and compliance with each of the terms of this Agreement. The parties agree that this Agreement shall include, as if fully set forth herein, the Grant Award and Special Conditions, Grant Application, Revised Budget/Budget Narrative, Letter Addressing Contingencies, FFATA Reporting Form; Subaward Attachment; and Audit Certification which are attached hereto. - 8 - , XVII. All records shall be retained for five(5)years from the date of the final fiscal report unless an audit is in progress or the findings of a completed audit have not been resolved satisfactorily. 3: Acceptance of Grant Award and Special Conditions: a. Grant Award must be accepted; signed by the subrecipient's Authorized Official, the Project Point of Contact (director of the project)and the Fiscal Point of Contact;and,returned to the Crime Commission within thirty(30) days from the date the Grant Award is mailed to the subgrantee. b. Special Conditions must be accepted,signed by the subrecipient's Authorized Official,the Agency Director,the Project Point of Contact (Agency Director and Project Point of Contact are often the same individual), and the Fiscal Point of Contact,and returned to the Crime Commission within thirty(30)days from the date the Special Conditions are mailed to the subgrantee. c. VAWA Page 2 of 9 4. Accounting Procedures/Practices: • a. Subrecipients must adhere to the Uniform Administrative Requirements,Cost Principles,and Audit Requirements in 2 C.F.R. Part 200, as adopted by the DOJ and supplemented in 2 C.F.R. Part 2800. See: http://www.ecfrgov/egi-bin/text-idx?tpl=/ecfrbrowseTTitle02/2cfr200 main 02.tpl for further information regarding the standards of these requirements. b. Subrecipient shall implement and maintain an accounting system which accurately reflects income received expenditures,and documentation of expenditures.Each source of income must be accounted for separately and a clear audit trail for each source of funding must be maintained. c. Any award with matching funds,both cash or in-kind,must document match in the agency's accounting system. Match need not be applied at the exact time or in the required proportion to the obligation of Federal funds. However,the full matching share must be obligated by the end of the project period. d. A private non-profit agency awarded funds shall have two(2)members of the Board of Directors review,on a quarterly basis,all expenditures for the agency. Board minutes shall reflect this review. e. If at any time an impropriety is found in the accounting or use of any funds received by the subrecipient, the Crime Commission must be notified immediately and informed about how the agency will address the problem. f. Subrecipients will maintain time records that comply with the Office of Management and Budget(OMB)A-87 Circular to clearly document the hourly activity of each grant funded or match funded position to show the actual percentage of time charged to the funding source. Records will be maintained by the subrecipient to document any differences between budgeted and actual federal and match personnel grant costs.Timesheets for grant funded positions should include the signature of the employee and their supervisor. Program income earned by the subrecipient must be approved by the Crime Commission. Program income,as defined by 2 C.F.R. 200.80,means gross income earned by a non-Federal entity that is directly generated by a supported activity or earned as a result of the Federal award during the period of performance. Without prior approval,program income must be deducted from total allowable costs to determine the net allowable costs. In order to add program income to an award,subrecipient must seek approval from the Crime Commission prior to generating any program income. Any program income added to an award must be used to support activities that were approved in the budget and follow the conditions of the award agreement. Any approved program income must be reported to the Crime Commission so that the income can be reflected on the Crime Commission's Federal Financial Report(SF-425)in accordance with the addition alternative: If the program income amount changes(increases or decreases)during the project period,the subrecipient must receive approval prior to the end. of the project period in order to avoid possible audit findings for both the Crime Commission and the subrecipient. Subrecipient agrees that if they receive any funding that is duplicative of funding received under this award, they will notify the Crime Commission immediately to eliminate any duplication. VAWA Page 3 of 9 5. Reporting Requirements: a. Grant Activity Summary Reports are required quarterly. Reports are due by the last working day of the month for each quarter during the grant period. b. Cash Report/Cash Requests are required quarterly. Reports are due by the last working day of the month following the end of each quarter.Grant payments are on a reimbursement basis. Reimbursement cannot be made until financial documentation from the subrecipient has been approved by the Crime Commission. The final Cash Report reflecting the total grant expenditures and amount reimbursed is due no later than 45 days from the end of the grant period. c. To assure that expenditures are proper and in accordance with the terms and conditions of the award and approved project budget,Cash Reports/Cash Requests under this award must be signed by an official who is authorized to legally bind the entity and to certify to the best of their knowledge and belief that the report is true,complete and accurate,and the expenditures,disbursements and cash receipts are for the purposes and objectives set forth in the terms of conditions of the award. Any false, fictitious, or fraudulent information, or the omission of any material fact,may subject the individual to criminal,civil or administrative penalties for fraud,false statements, false claims or others(U.S.Code,Title 18,Section 1001 and Title 231,Sections 3729-3730 and 3801-3812). d. Regardless of the start date of the grant project,quarterly reports are due for normal quarters as listed. Jan.—March(due last working day of April) April—June(due last working day of July) July—Sept.(due last working day of Oct.) Oct.—Dec,(due last working day of Jan.) e. Subrecipients that are non-profits must certify their non-profit status. f. All non-profit subrecipients are required to make their financial statements available online (either on the subrecipient's website or another publically available website). Subrecipient organizations that have federal 501(c)(3)tax status will be considered as in compliance with this requirement,to the extent that such organization files IRS Form 990 or equivalent,as several sources already provide searchable online databases of such financial statements. g. Under the Government Performance and Results Act,VAWA 2000 and subsequent legislation,subrecipients are required to collect and maintain data that measure the effectiveness of their grant-funded activities.Accordingly, the subrecipient agrees to submit electronic progress reports to the Crime Commission to include any requested information required from OVW. 6. Use of Federal Grant Funds: a: The subrecipient and any subawards must promptly refer to the DOJ O1G and the Crime Commission any credible evidence that a principal, employee, agent, subrecipient, contractor, subcontractor, or other person has — I) submitted a claim for award funds that violates the False Claims Act:or 2)committed a criminal or civil violation of laws pertaining to fraud, conflict of interest, bribery, gratuity,or similar misconduct involving award funds. Potential fraud, waste, abuse or misconduct should be reported. In addition, the subrecipient must notify the Crime Commission. Federal grant funds will not be used to supplant State,local or any other funds that would otherwise be available. The agency's budget cannot decrease as a result of grant dollars. If an existing employee is assigned to this project and their salary is paid with grant funds,his or her position must be backfilled. The agency's personnel cannot decrease as a result of this grant project. c. No State/Federal grant funds shall be used for costs existing prior to or after the grant period. d. Federal and matching funds are to be used for the purpose stated in the approved grant application. Federal funds cannot be used for lobbying. If matching funds are used for lobbying,a disclosure report shall be submitted to the Crime Commission. Restrictions on"lobbying"and policy development: In general,as a matter of federal law, federal funds may not be used by any subrecipient or subawardee, either directly or indirectly, in support of the enactment, repeal, modification or adoption of any law, regulation or policy,at any level of government, in order to avoid violation of 18 U.S.C. 1913. However, federal funds may be used to collaborate with and provide information to federal,state, local, tribal and territorial public officials and agencies to develop and implement policies and develop and promote state, local, or tribal legislation or model codes designed to reduce or eliminate domestic violence,dating violence,sexual assault,and stalking when such collaboration and provision of information is consistent with the activities otherwise authorized under this grant program. Another federal law generally prohibits federal funds awarded by OVW from being used by subrecipients or . subawardees to pay any person to influence(or attempt to influence)a federal agency,a Member of Congress,or Congress with respect to awarding of a federal grant or cooperative agreement,subgrant,contract,subcontract, or loan, or with respect to actions such as renewing, extending, or modifying any such award. See 31 U.S.C. 1352. Certain exceptions to this law apply, including an exception that applies to Indian tribes and tribal organizations. Should any question arise as to whether a particular use of federal funds by a subrecipient would or might fall within the scope of these prohibitions, OVW is to be contacted for guidance, and no action taken without the expressed prior written approval from OVW. f. No other Federal funds shall be used to meet the match requirement. g. No Federal funds will be used for land acquisition. h. No Federal funds are to be used for entertainment, fines and penalties, Visa fees, passport charges, bar charges!alcoholic beverages,or membership fees, i. Crime Commission funding cannot be placed in interest bearing accounts by private non-profit agencies. j. Subrecipient and any subawardees must comply with all applicable laws, regulations,policies,and official DOJ guidance(including specific cost limits,prior-approval and reporting requirements,where applicable)governing the use of federal funds for expenses related to conferences (as that term is defined by DOJ), including the provision of food and/or beverages at such conferences,and costs of attendance at such conferences.Information on pertinent DOJ definition of conferences and rules applicable to this award are available at: http://www.justice.goviovw/grantees 7. Nondiscrimination/Civil Rights: • a. Applicable nondiscrimination statues Executive Order 13,559,amending Executive Order 13,279;Title II of the Americans with Disabilities Act(ADA)of 1990,as amended;and the Violence Against Women's Act of 1994, as amended. • b. Federal laws that apply to recipients of financial assistance from Department of Justice prohibit discrimination on the basis of race,color,national origin,religion,sex or disability in funded programs or activities,not only in employment but also in the delivery of services or benefits. Federal law also prohibits discriminating on the basis of age in the delivery of services or benefits. c. VAWA Page 5 of 9 d. Subrecipient agrees to notify employees and clients, customers, and program participants of prohibited discrimination and the procedures for filing a complaint of discrimination. The subrecipient agrees to have a procedure in place for responding to discrimination complaints that employees and clients, customers, and program participants file directly with the subrecipient. e. Subrecipient understands and agrees that award funds may not be used to discriminate against or denigrate the religious or moral beliefs of students who participate in programs for which financial assistance is provided from those funds,or of the parents or legal guardians of such students. f. The subrecipient assures it and all its contractors will comply with all applicable nondiscrimination requirements as set forth by federal and state laws. No person shall be excluded from participation in,denied the benefits of, subjected to discrimination under, or be denied employment in connection with any activities receiving funds under the Act on the basis of race;color,religion,age,sex,national origin or handicap. g. Subrecipient acknowledges that failure to submit an acceptable equal employment opportunity program(EEOP) that is approved by the Office for Civil Rights, is a violation of its Certified Assurances and may result in suspension or termination of funding, until such time as the subrecipient is in compliance. If subrecipient is required to submit an EEOP pursuant to 28 C.F.R.Section 42.302 et seq it will be submitted electronically to the OCR,and that it will electronically submit a certification to the OCR indicating that it has a current EEOP on file which meets the requirements therein or that it is exempt for the EEOP requirement. h, In the event a federal or state court or administrative agency makes a finding of discrimination after a due process hearing the subrecipient of funds will forward a copy of the finding to the Office of Civil Rights Compliance of the Office of Justice Programs in Washington,D.C. Additionally,a copy of the findings is to be sent to the Crime Commission. Subrecipients, whose projects, personnel or subawards become involved in any litigation, whether civil or criminal,shall immediately notify the Crime Commission and forward a copy of any demand notices, lawsuits, or indictments to the Commission. j. Subrecipient must comply with the Department of Justice Guidance pertaining to Title VI of the Civil Rights Act of 1964,42 U.S.C. §2000d. Subrecipients receiving Federal financial assistance must take reasonable steps to provide meaningful access to their programs and activities for persons with limited English proficiency(LEP). Information on the civil right responsibilities,see http://www.lep.gov. • k. Partnerships with Faith-Based and Other Neighborhood Organizations: Subrecipient and any subawardees must comply with all applicable requirements of 28 CFR Part 38, specially including any applicable requirements • regarding written notice to program beneficiaries and prospective program beneficiaries.Part 38 of 28 C.R.R.,a DOJ regulation, was amended effective May 4,2016.Among other things,28 C.F.R. Part 38 includes rules that prohibit specific forms of discrimination on the basis of religion,a religious belief,a refusal to hold a religious belief,or refusal to attend or participate in a religious practice. Part 38 also sets out rules and requirements that pertain to subrecipient organizations that engage in or conduct explicitly religious activities,as well as rules and requirements that pertain to subrecipients that are faith-based or religious organizations. Faith-based organizations should note that the Omnibus Crime Control and Safe Streets Act of 1968,as amended, 34 U.S.C. §§I0228(c) and 10221(a) and the Violence Against Women Act of 1994, as amended,34 U.S.C. § 12291(b)(13)contain prohibitions against discrimination on the basis of religion in employment. I. Subrecipient should be mindful that the misuse of arrest or conviction records to screen either applicants for employment or employees for retention or promotion may have a disparate impact based on race or national origin,resulting in unlawful employment discrimination. Subrecipients should consult local counsel in reviewing employment practices and if warranted, an analysis of the use of arrest and conviction records should be incorporated into the subrecipient's Equal Employment Opportunity Plan. VAWA Page 6 of 9 for the employee's disclosure of information related to gross mismanagement of a federal grant,a gross waste of federal funds,an abuse of authority relating to a federal grant,a substantial and specific danger to public health or safety,or a violation of law,rule,or regulation related to a federal grant. The subrecipient also must inform its employees, in writing (and in the predominant native language of the workforce),of employee rights and remedies under 41 U.S.C.4712. n. The subrecipient and any subawardees must comply with all applicable requirements of 28 C.F.R.Part 54,which relates to nondiscrimination on the basis of sex in certain"education programs." 8. Restrictions and certifications regarding non-disclosure agreements and related matters No subrecipient or subaward under this award may require any employee or contractor to sign an internal confidentiality agreement or statement that prohibits or otherwise restricts, or purports to prohibit or restrict, the reporting(in accordance with law)of waste, fraud,or abuse to an investigative or law enforcement representative of a federal department or agency authorized to receive such information. The foregoing is not intended to contravene requirements applicable to any form issued by a federal department or agency governing the nondisclosure of classified information. Under this award if the subrecipient does or is authorized to make subawards or contracts— a. it represents that,- 1) it has determined that no other entity that the recipient's application proposes may or will receive award funds (whether through a subaward, contract, or subcontract) either requires or has required internal confidentiality agreements or statements from employees or contractors that currently prohibit or otherwise restrict(or purport to prohibit or restrict)employees or contractors from reporting waste,fraud, or abuse as described above;and 2) it has made appropriate inquiry,or otherwise has an adequate factual basis,to support this representation; and b. certifies that,if it learns or is notified that it is or has been requiring its employees or contractors to execute agreements or statements that prohibit or otherwise restrict(or purport to prohibit or restrict),reporting of waste, fraud,or abuse as described above, it will immediately stop any further obligations of award funds, will provide prompt written notification to the agency making this award, and will resume (or permit resumption of)such obligations only if expressly authorized to do so by that agency. 9. Requirements pertaining to prohibited conduct related to trafficking in persons(including reporting requirements and authority to terminate award). Subrecipient and any subgrantees,at any tier,must comply with all applicable requirements(including requirements to report allegations)pertaining to prohibited conduct related to the trafficking of persons,whether on the part of the subrecipient or subgrantee,or individuals defined(for purposes of this condition)as"employees"of the subrecipient or of any subgrantee. Compliance with general appropriations-law restrictions on the use of federal funds(FY 2016) Subrecipient and any subgrantees,at any tier,must comply with all applicable restrictions on the use of federal funds set out in federal appropriations statutes. VAWA Page 7 of 9 1 I. The subrecipient agrees to attend Grant Management Training sponsored by the Crime Commission,as indicated by the grant program. 12. Subrecipient agrees to comply with any additional requirements that may be imposed as a result of grant performance and that the misuse of award funds may result in a range of penalties,including suspension of current and future funds, recoupment of money provided under an award,and civil and/pr criminal penalties. 13. The subrecipient understands and agrees that any training or training materials developed or delivered with funding provided under this award must adhere to the OVW Training Guiding Principles for Grantees and Subgrantees available at http://www.ovw.usdoj.gov/grantees.html 14. The subgrantee agrees that all materials and publications(written, visual, or sound)resulting from subgrant award activities shall contain the following statement:"This project was supported by subgrant No. awarded by the state administering office for the STOP Formula Grant Program(Nebraska Crime Commission). The opinions, findings,conclusions and recommendations expressed in this publication/program/exhibition are those of the author(s) and do not necessarily reflect the views of the Commission or the US Department of Justice, Office on Violence Against Women.A copy of any such material or publication is to be submitted to the Crime Commission. 15. If at any time during the grant period the subgrantee, or one of its serving Board members, is barred from doing business with the Federal Government,the Crime Commission shall be notified by the subgrantee in writing. 16. All agencies who are participants in the awarded project shall establish and maintain a drug free work-place policy. 17. Pursuant to 2 CFR §200.315(b),the Office on Violence Against Women reserves a royalty-free,nonexclusive,and irrevocable license to reproduce,publish or otherwise use,and to authorize others to use,in whole or in part(including in the creation of derivative works),for Federal Government purposes: a) Any work that is subject to copyright and was developed under this award, subaward, contract or subcontract pursuant to this award:and b) Any work that is subject to copyright for which ownership was purchased by a subrecipient, subaward or a contractor with support under this award. Subrecipient must obtain advance written approval from the Crime Commission,and must comply with all conditions specified by the Crime Commission in connection with that approval before: I) using award funds to purchase ownership of,or a license to use,a copyrighted work;or 2)incorporating any copyrighted work, or portion thereof, into a new work developed under this award. It is the responsibility of the subrecipient to ensure that this condition is included in any subaward, contract or subcontract under this award. 18. The subrecipient understand and agrees that—(a)No award funds may be used to maintain or establish a computer network unless such network blocks the viewing,downloading and exchanging of pornography,and(b)Nothing in subsection(a)limits the use of funds necessary for any Federal,State,tribal or local law enforcement agency or any other entity carrying out criminal investigations,prosecution or adjudication activities. 19. The subrecipient agrees to comply with the provisions of 42 U.S.C. I 3925(b)(2), nondisclosure of confidential or private information, which includes creating and maintaining documentation of compliance, such as policies and procedure for release of victim information. Subgrantees not covered under federal or state statute must have written confidentiality policies in place that prohibit the disclosure of a victim's name, address, telephone number, or any other identifying information without the prior voluntary written consent of the victim. This written consent must be reasonably time-limited. 20. Subrecipient understands and agrees that it cannot use any federal funds,either directly or indirectly,in support of any contract or agreement to either the Association of Community Organizations for Reform Now (ACORN) or its subsidiaries,without the express prior written approval of the Nebraska Crime Commission. 21. Pursuant to Executive Order 13513,"Federal Leadership on Reducing Text Messaging While Driving,"74 Fed. Reg. 51225(October 1,2009),the subrecipient is encouraged to adopt and enforce polices banning employees from text messaging while driving any vehicle during the course of performing work founded by this grant, and to establish .,V-S initials of Authorized Official • SUBGRANT SPECIAL CONDITIONS—S.T.O.P. VAWA Page 8 of 9 workplace safety polices and conduct education, awareness, and other outreach to decrease crashes caused by distracted drivers. 22. Subrecipients funded for$25,000 or more and,in certain circumstances,agree to comply with applicable requirements to report the names and total compensation of the five most highly compensated executives of the subrecipient.Such data will be submitted to the Federal Funding Accountability and Transparency Act of 2006 (FFATA), Subaward Reporting System (FSRS). The subrecipient agrees to comply with all relevant statutory and regulatory requirements which may include,among other relevant authorities,the Violence Against Women Act of 1994,as amended 34 U.S.C.§ 12291(bx13),and the Violence Against Women Act of 2000,P.L. 106-386,the Omnibus Crime Control and Safe Streets Act of 1968, 34 U.S.C. §§ 10228(c) & 10221(a), the Violence Against Women and Department of Justice Reauthorization Act of 2005,P.L. 109-162,the Violence Against Women Reauthorization Act of2013,P.L. 113-4,and OVW's implementing regulations at 28 CFR Part 90. 24. The subrecipient understands and agrees that misuse of award funds may result in a range of penalties, including suspension of current and future funds, recoupment of money provided under and award, and civil and/or criminal penalties. 25. The subgrantee agrees that grant funds will not support activities that compromise victim safety and recovery,such as: procedures or policies that exclude victims from receiving safe shelter,advocacy services,counseling,and other assistance based on their actual or perceived sex, age, immigration status,race,religion,sexual orientation, gender identity,mental health condition,physical health condition,criminal record,work in the sex industry,or the age and/or sex of their children; pre-trail diversion programs not approved by OVW or the placement of offenders in such programs;mediation,couples counseling,family counseling or any other manner of joint victim-offender counseling; mandatory counseling for victims, penalizing victims who refuse to testify, or promoting procedures that would require victims to seek legal sanctions against their abusers(e.g.,see a protection order, file formal complaint); the placement of perpetrators in anger management programs;or any other activities outlined in the state solicitation under which funds are received. 26. The subgrantee agrees to participate in strategic planning efforts and/or other activities necessary for the development of the state's three year implementation plan as required by the STOP Violence Against Women Act Formula Grant Program. 27. The DVIS unit is part of the Special Victims Unit(SVU),and a partner with the Sexual Assault/Child Victim Unit(CVSA). A Bureau Lieutenant commands both units,overseeing the frequent inter-unit communication necessary to address cases involving overlapping issues,offenders,and victims. The unit Sergeant and officers conduct follow-up investigations;apply for warrants for suspects;write and conduct search warrants;plan and implement warrant operations to apprehend offenders with outstanding domestic violence warrants; gather evidence sufficient to support the prosecution of offenders when the victim is unable to do so; and interact with prosecution,probation,and the courts to hold offenders accountable. The Sergeant and the officers review reports received by Adult Protective Services(APS),and coordinates support with the Nebraska Department of Health and Human Services in follow-up investigations into the legal aspects of elderly abuse. The Sergeant and officers are responsible for reviewing reports when it is believed a crime has occurred.Additionally,the Sergeant and officers will gather necessary evidence in the prosecution of offenders. Between January and November 2017,the DVPU reviewed 2,326 misdemeanor and 633 felony domestic violence reports submitted by seven(7)different law enforcement agencies within the county. The DVPU Liaison is an essential and necessary component of the DVPU and functioning with the Community Response Team(CRT). The Liaison primarily aids in the communication between the prosecuting attorney and law enforcement,victims,and victim advocacy groups. The liaison compiles new arrest reports and prepares them for review by the prosecutors to make charging decisions. This task requires the DVPU Liaison to ensure the defendant's criminal record,along with a complete set of available reports and photographs,are available to the prosecutor to form a comprehensive picture for the charging decision. The DVPU Liaison contacts law enforcement to coordinate requested follow-up investigation as requested by the prosecutor. The DVPU Liaison collects,logs,and disseminates warrant requests submitted by law enforcement. In 2017,811 misdemeanor and 165 felony warrant requests were submitted for review by law enforcement. The DVPU Liaison maintains continuous contact with victims in domestic violence cases. Following an arrest, the DVPU Liaison contacts the victim to discuss the criminal case and the process. The DVPU Liaison calls victims to inform them of the charges,the arraignment time,and to answer questions. Additionally,they inform victims of available services, including counseling,protection orders and shelters;and assist underserved populations by keeping informed of new and updated community resources available to these victims. Without the requested funding,this position would be eliminated and victim services and advocacy would suffer. The DVPU Liaison collects and maintains the statistical information on domestic violence cases,generating a monthly statistical report submitted to the Douglas County Domestic Violence Community Responses Team (CRT)Coordinator. Women's Center for Advancement(WCA) • Beginning August 2017,the WCA legal team started using an Urgent Care model with the hope that this model would enable the staff to serve more clients. The WCA receives more requests for legal services than can be met,and the number has grown substantially over the past few years.The Urgent Care model is based on a shift from full representation,to limited scope and clinic based representation for a larger number of clients. Clients who require full representation are either represented by a WCA attorney or referred to a partner in the community for ongoing representation.The first legal clinic was offered in August 2017 and are now offered regularly.The legal team has increased the number of cases they are able to accept through this model,as well as decrease the number of cases they must reject for capacity reasons. • WCA staff met with the Community Mental Health Center(CMHC)Detox to set up a collaborative protocol in which they contact the WCA if they have a client in need of domestic violence or sexual assault services. • The WCA will send an advocate to the facility.The advocate will then make a plan with the client for future contact. • Self-sufficiency and advocacy staff continue to partner with Community Alliance's(CA)street outreach team. WCA staff participate once a week in outreach with CA's team to visit homeless camps,checking parked cars,under bridges,and parks. WCA staff provide 911 phones,give WCA information and referrals to families who are homeless due to domestic violence. • The Women's Center for Advancement's Healing Warriors program is a military and veteran service program focusing on physical and mental safety,career assistance,financial education,legal services, specialized case management,counseling,advocacy,and various support groups.Participants of the program have experienced military sexual trauma(MST),domestic violence,or sexual assault. The Healing Warriors therapy team recently began offering a Beyond Trauma group in the Douglas County Correctional Center.The group help individuals work through trauma they have experienced.The WCA has obtained jail passes so staff may work with clients and hold groups. • WCA staff have started a Diversity and lnclusivity Committee to be sure that WCA services,materials, facilities and our web-based presence are welcoming to a diverse range of survivors. Every survivor has different needs;so careful planning is done to ensure clients feel comfortable accessing WCA services. Omaha Police Department(OPD) OPD's Domestic Violence(DV)Squad spent the last 12 months working to improve the services provided to victims of Domestic Violence. The DV Sergeant spent time giving presentations to the community and underserved populations. One area of need was educating college students. The DV Sergeant arranged, assisted,and performed presentations to local college students at the University of Nebraska at Omaha and the Iowa Western Community College. In June 2017,OPD moved the Domestic Violence Unit from its downtown location to Project Harmony(west Omaha). As a result,the Unit now offers more timely services to victims of domestic violence. The DV Squad was able to attend very valuable training during the last 12 months. In May 2017,officers from the DV Squad attended the 12'h Annual Conference on Crimes against Women where they learned best practices and victim centered policing,real-life tools and strategies to share with peers investigating crimes against women,sexual assault,domestic violence campus safety,and elder abuse. 01/08/2018 City of Omaha,Nebraska Page 22 of 63 FY 2017 STOP VAWA Application Douglas County Community Response Team(CRT) In June 2017,one(1)DV Sergeant and one(1)DV officer attended the Advanced Domestic and Sexual Violence Training in Las Vegas,Nevada. Officers received new behaviorally and psychologically based advanced domestic violence. Training information and outcomes were shared with the DV Squad. The DV Sergeant and one(1)unit employee attended Nebraska Commission for the Deaf and Hard of Hearing Sign Language training. Training taught participants general Sign Language skills,and,educated participants on the communities preferred methods of communication and interaction with Law Enforcement. Douglas County Attorney's Office(DCAO) The grant funded attorney prosecutes all cases of domestic violence(DV)related stalking in the domestic violence unit. The grant-funded attorney continued to charge,and successfully prosecute more stalking cases in 2017. In particular,there has been an increase in the success of prosecution of social media and technological related cases due to training and education of law enforcement on what is needed to prove these cases. 6. Contingency plan should project not receive funding. The City of Omaha would consider the following options if the Douglas County Community Response Team (CRT)project did not received funding: • • CRT agency leaders would need to go back and review their own budgets to find any additional funds that could act as stop-gap funding to temporarily sustain the program until alternative funding sources could be secured. • The City of Omaha would seek local and national philanthropic foundations with domestic violence, women,marginalized or underserved populations as a priory population,to provide bridge funding to CRT agencies until other permanent funds could be secured. • It is unlikely that all positions and activities could be maintained without this funding.Budget cuts and elimination of positions would likely be required. Describe the Problem The problem addressed by this project is domestic violence,sexual assault,and stalking in Douglas County. Specifically,this project enhances the current work of the Douglas County Domestic Violence Community Response Team(CRT)and Douglas County Sexual Assault Response Team(SART). The project ensures best practices are in place to help victims stay safe,and hold offenders accountable.The CRT has adopted Praxis International's Community Safety Assessment(CSA). The effort began in October 2013 and final recommendations were approved by agency heads in April 2015. Implementation of the majority of these recommendations is complete and a second phase CSA is scheduled to begin in 2018. 2. Provide Statistical Documentation of the Problem Intimate Partner Violence(IPV), sexual violence(SV),and stalking are some of the most serious public health problems facing the City of Omaha and Douglas County.Victims of violence suffer both the immediate effects and long-term physical,psychological,and social consequences. The private nature of these public health issues makes them particularly difficult to monitor,evaluate,and address.The need is especially acute because IPV, SV,and stalking can create a ripple effect of negative health consequences beyond the immediate injury.The U.S. Centers for Disease Control and Prevention(CDC)reports our country has only begun to understand the cumulative health and social costs of these challenges.Conservative estimates for lost productivity,direct medical care,ongoing health care,and lost earnings by IPV,SV,and stalking victims,are in the billions of dollars. According to service providers in African American, Latina and culturally specific communities in Douglas County, many victims will only seek assistance from providers in their individual communities. Immigration status, language barriers,cultural norms,and . understanding contribute to diminished and unequal access to resources. Table E compares the National Intimate Partner and Sexual Violence Survey(NISVS)Lifetime Prevalence of Rape,Physical Violence,and/or Stalking by location and gender.The prevalence rate in Nebraska is higher than . either Iowa or Kansas,and above the average U.S.rate for women. Perpetrators use violence as a strategy to gain,or maintain power and control over their victim. Lundy Bancroft, author of Why Does He Do That,has a cost-benefit theory that abuse rewards the perpetrator in ways other than, or in addition to,simply exercising power over their target.In support of his argument,Bancroft cites evidence that in most cases abusers are quite capable of exercising control over themselves,but choose not to do so for various reasons. This is supported by Duluth Domestic Abuse Intervention Project's Power and Control model and subsequent Power and Control Wheel. The National Institute of Justice Special Report:Practical Implications of Current Domestic Violence Research for Law Enforcement,Prosecutors and Judges(2009)states that the number of men killed by an intimate partner has dropped by almost three-quarters since 1976.In contrast the number of women killed has only dropped by a quarter(p.3). Douglas County numbers track similarly. The Women's Fund of Omaha has kept track of intimate partner homicides since 1997,and trends reflect a similar pattern. Intimate Partner homicides spiked in 2002 with eight(8),and has undergone a downward trend ever since.In 2004 only(1)homicide was reported; there were none in 2005;four(4) in both 2006 and 2007;and between one(1)and three(3)between 2008 and present time. • As illustrated below,between 2015 and 20178 there was a 41 percent increase in the number of arrests and over a 70 percent increase in the number of cases charged. This is largely attributed to a four-hour domestic violence in-service training provided to almost 1,000 law enforcement officers in Douglas County in 2016. This increase in both arrests and cases greatly taxes current staffing levels in the Omaha Police Department and Douglas County Attorney's Office. 01/08/2018 City of Omaha,Nebraska Pagc 27 of 63 FY 2017 STOP VAWA Application ' Douglas County Community Rcsponsc Team(CRT) • The number of calls from Law Enforcement(LE)agencies to advocates immediately after arrest continues to be low and represent all victims that were served as a result of calls. A pilot project to address issues with the referral process between Omaha Police Department(OPD)and the Women's Center for Advancement (WCA)is planned for early 2017. The intent is to identify what is preventing cases from being referred immediately after an arrest and lead to an increase in cases for future years. • Referrals from law enforcement have increased significantly,largely due to the Domestic Violence Investigators referring multiple victims daily to the WCA. The WCA started receiving electronic copies of incident reports in 2016,allowing them to receive the case information within 24 to 48 hours immediately after the incident. An attempt is made to contact every victim from those reports. Law Enforcement numbers of arrests are county wide for Douglas County.For Intimate Partner Violence, an estimate was used for Quarter 4 2017 based on the January 2017 through September 2017 numbers provided from Douglas Omaha Technology Commission(DOTComm). For Sexual Assault and Stalking, an estimate was used for December 2017 based on January through November 2017 data provided by DOTComm.The arrests do not include arrests solely for violation of probation because they are not reviewed by prosecution and handled through court the same as a new arrest would be. Prosecution section is county wide data for Douglas County.An estimate of intimate partner violence was used for Q4 2017 based on January through September 2017 data provided from DOTComm. For Sexual Assault and Stalking,an estimate was used for December 2017 based on January through November 2017 numbers provided by DOTComm. The data is presented for cases that were reviewed in 2017 and what has happened to those cases. Data does not reflect dispositions on cases that were reviewed prior to 2017. The number of cases pending is greyed out because as the years go on more cases reach disposition and comparing 2015 to 2017 on cases pending would have no meaning at this time. 4. The Women's Center for Advancement(WCA)cannot report the Advocacy section exactly as requested in this table. Please see below: Victims referred by law enforcement: 100 percent of victims are referred by law enforcement,through hotline calls,by providing the victim an information card with WCA hotline and website and through incident reports received electronically typically within 24 hours. Victims provided advocacy: The WCA does receive some calls from law enforcement at the time an incident occurs, but only a small percentage. The numbers used in these sections represent the number of victims provided advocacy from the police hotline calls and the victimization is not always known so they are reported in the intimate partner violence areas only. The WCA worked with OPD in 2016 to create a method to receive electronic police reports for DV and SA. Starting in 2017,WCA began to get reports electronically approximately one(1)to two(2)days after an incident occurs. All victims from police reports are provided attempted outreach by a WCA advocate. 5. Batter Intervention Programs(BIP)data of offenders enrolled represents all BIP attendees in 2017 regardless of their program start date(as requested by the Federal Aid Administrator).It includes anyone who attended BIP any time in 2017.The completing and terminated indicates anyone who completed or terminated regardless of start date. Current Efforts Overview of Community Response Efforts The Women's Fund of Omaha(WFO)facilitates activities of the Douglas County Domestic Violence Community Response Team(CRT)and the Sexual Assault Response Team(SART). During 2017,these teams conducted policy reviews for sitting agencies on their domestic violence and sexual assault response. Updates were recommended based on national best practices. The team created standardized protocols for Douglas County law enforcement and prosecution,for the three(3)hospital systems in Douglas County and for advocacy services,including Women's Center for Advancement,Victim Witness and campus based advocates. Recommendations from the Community Safety Assessment are approximately 80 percent implemented. The remaining recommendations are much larger projects that will take multiple years to implement and have been incorporated into the 2016-2018 CRT plan. Both CRT and SART agencies have seen an increase in domestic violence and sexual assault cases where trafficking is also present.Discussions have begun on how to merge the community response to all three(3) issues both within the CRT and SART and in the WFO. A large domestic violence data project was completed in spring 2017 to provide more accurate system response data. This project will continue in 2018 to provide the same level of data for sexual assault,stalking and sex trafficking. The high volume of cases in Douglas County does not allow for the level of needed resources to be devoted to each case.The Domestic Violence High Risk Case Review Team meets weekly and reviews cases with high indicators of lethality that are in need of immediate resources. Cases are brought back to the team after 30 to 60 days to determine if the threat to lethality has lessened and if additional resources are needed. The team has started reviewing sex trafficking cases that overlap with domestic violence. Training The City of Omaha and Women's Fund of Omaha hosted a two-day training with Russell Strand in December 2017. Approximately 75 attendees learned how trauma affects the brain and how to work with victims.The Russell Strand training was the second phase of creating a foundation for a trauma informed community response and comes after a domestic violence in-service training where over 1,000 professionals from responding agencies were trained. Plans are underway for a subsequent three-day training to build on the December 2017 training by Russell Strand,and will provide certification in trauma focused or Forensic Experiential Trauma Interviews(FETI). The target audience for this subsequent training is primarily investigators,prosecutors,Title IX Coordinators and Health and Human Services Child Protection and Safety Workers. The certification ensures sustainability as local participants will now be able to train their agencies on FETI. The Douglas County Attorney's Office(DVAO)prosecution rate for 2016 was over 88 percent(number of cases charged compared to number of cases reviewed). This exceeds the National Institute of Justice Special Report(2009)national prosecution rate of 63.8 percent.Additionally,92 percent of cases were found guilty of the original or related crime.The felony prosecutor reported that approximately 50 percent of cases are pursued without the cooperation of the victim. The Omaha Police Department(OPD)continued to prioritize mitigating high caseloads by adding two(2)DV Investigators in spring,2017. The hiring of an additional 'C' Shift Officer to work in the evenings has begun. OPD made significant leadership changes in the Sexual Assault Unit,to create a more trauma informed' environment.OPD Investigations Deputy Chief worked with the Douglas County Attorney's Office(DCAO) 01/08/2018 City of Omaha,Nebraska Page 31 of 63 FY 2017 STOP VAWA Application Douglas County Community Response Team(CRT) and the Women's Fund of Omaha(WFO)to ensure sexual assault investigations are being done in accordance with national best practices.Additionally,a working group of state and local agencies created a five-year plan for testing untested sexual assault kits in Douglas County which will be funded through a separate project. The Women's Center for Advancement(WCA)conducted a three-week pilot project with the Omaha Police Department to track and review incoming hotline referrals and assess for breakdowns. Changes have been made to hotline procedures and will continue to be assessed moving forward. In 2017,a new MOU with the OPD • provided a process for the WCA to automatically receive incident reports immediately.This enhances information sharing and ensures attempts to contact the victim occur more quickly. The WCA has continued to assess its Legal Division for opportunities to increase the number of victims served. In 2017,the Legal Division started holding regular open legal clinics to provide legal advice to victims representing themselves pro-se after finding that a greater number.of individuals could be served this way than by appointment only.The demand for WCA legal services is significant. This will continue to be assessed in order to serve as many victims as possible. 2. Project Operations Coordination: The Women's Fund of Omaha(WFO)serves as the coordinator of the Douglas County Community Response Team(CRT)and the Sexual Assault Response Team(SART).The CRT Coordinator ensures active participation of all team partners,and facilitates the work of the CRT,SART and working groups. WFO provides funding to support all team coordination activities in addition to data gathering and management needed for both grant reporting,and system improvements. A two-year domestic violence data project was completed in 2017 to provide a consistent and in-depth data assessment of Douglas County criminal justice agencies. A stand-alone data system,with online dashboard,will be completed by spring, 2018. The sexual assault and stalking components on this project will continue into 2018,as well as the addition of data from other agencies.The WFO is providing funding for an outside Data Coordinator to • manage this project. The Data Coordinator will work closely with the CRT Coordinator on the implementation of activities related to the 2016-2018 CRT Improvement Plan and on the second Community Safety Assessment(CSA), scheduled to begin in early 2018. The 2016-2018 CRT plan was reviewed and updated in November 2017. The plan includes the final CSA recommendations and grant activities in addition to other community needs.This year will continue to bring an enhanced focus on marginalized communities and underserved populations.CRT membership will continue to be enhanced to better represent these populations,and additional training will be conducted. The DV Community Response Protocol was finalized in November 2017 and will be routed for signatures of agency heads in January 2018. Currently the SART has standardized protocols for medical,advocacy,and prosecution. The law enforcement portion will be completed in 2018 and will then be routed for signatures. A working group of local and state agencies will move forward with the testing of untested sexual assault kits in Douglas County. This will also include the creation of policies and enhancement of staff to ensure any investigations opened as a result are fully investigated,prosecuted,and advocacy needs are met. Two Uniform Officers from the Omaha Police Department(OPD)respond to domestic violence calls from the Douglas County 911 Communication Center.If probable cause exists that a crime did occur,custodial arrest is mandated by current operating procedures.As part of the investigation,the officers take photographs (victim,offender,and scene)and complete the Uniform Crime Report and Domestic Violence Supplemental Report.For felony crimes,the crime lab is contacted to take additional photographs.Methodist Hospital's 01/08/2018 City of Omaha,Nebraska Page 32 of 63 FY 2017 STOP VAWA Application Douglas County Community Response Team(CRT) Sexual Assault Nurse Examiner(SANE)program provides forensic exams for domestic violence and sexual assault victims and is the primary resource for law enforcement to ensure medical treatment for victims. Arrest Made. If the offender is present at the scene,the officer will transport the offender to the Douglas County Correctional Facility,and an arrest bond of$50,000 is set for each domestic violence misdemeanor charge.All felony charges require the offender to be held until seen by a judge to set bond.If the offender left the scene prior to law enforcement arrival,the offender description is broadcast and active attempts are made to immediately locate the offender. Referral to Advocates Made. Standard operating procedure ensures a victim of domestic violence has the opportunity to work with an advocacy organization. Law enforcement provides the victim with the newly created Victim Information Card,that includes WCA hotline and website information.Law enforcement also calls the Women's Center for Advancement 24 hour crisis line to notify of DV related arrests so an immediate attempt can be made to contact the victim. Copies of incident reports are provided to the WCA, who follow-up by phone on all reports.Law enforcement will provide Ponca Tribe of Nebraska contact information if relevant.The Officer then informs the victim that information will be sent to the Victim Assistance Unit. Warrant Request.The high volume of domestic violence reports made each month creates a backlog of outstanding warrants. Through the Office on Violence Against Women's Improving Criminal Justice Responses Grant dollars OPD,Douglas County Sheriff's Office,and State of Nebraska Probation conduct warrant sweep operations of outstanding domestic violence warrants. These warrant sweeps are in line with recommendations from the National Institute of Justice(NIJ)report,stating law enforcement should attempt to aggressively serve warrants to protect victims. Investigation.The Omaha Police Department(OPD)Domestic Investigation Squad(DVIS)conducts follow-up investigation on every report received. Investigation includes interviewing victims and witnesses, evidence collection,and assisting the DVPU in building a case. The OPD Child Victim Sexual Assault(CVSA)unit conducts investigations for all adult sexual assaults. Douglas County does not have an established process for anonymous reporting,however if the victim does not want the investigation to proceed or wants it to be temporarily halted,the Child Victim/Sexual Assault Unit(CVSA)will honor their request. Douglas County Attorney's Office Prepares File. Following receipt of the investigation and reports from the Domestic Violence Investigation Squad(DVIS),the Domestic Violence Prosecution Unit(DVPU) prepares the attorney file and DV cover sheets.The DVPU,will contact the victim to make appropriate referrals for advocates during the judicial process. All sexual assaults are prosecuted by the Douglas County Attorney's Office Sexual Assault Unit,which the county assumes funding for.The unit works closely with law enforcement during sexual assault investigations to ensure charging can take place once the investigation is complete.Intimate partner sexual assaults are prosecuted in collaboration between the two(2)units. Charging Decisions.The Domestic Violence Prosecution Unit(DVPU)reviews all misdemeanor and felony domestic violence cases in Douglas County. Affidavits are reviewed,charges filed,attorney assigned,and warrants are entered.The DVPU files charges on the majority of cases they review. The Prosecutorial Liaison gathers information from CRT partners and outside agencies to assist the Judge and Prosecutor in bond setting,trial and or sentencing. The Ponca Tribe provides culturally specific services to native victims and trained WCA advocates provide services to military, Hispanic,and African American victims. Victim Immigration Services.WCA staff and Justice for Our Neighbors—Nebraska(JFON-NE)attorneys work with victims of qualifying crimes to file immigrant visa petitions under VAWA without the abuser's knowledge. Legal Services:WCA Family Law Attorney assists victims pro bono in their civil legal assistance needs. Arraignment/Preliminary Hearing and Trial/Plea.At arraignment,(misdemeanor)or preliminary hearing (felony),the offender is advised of charges and enters a plea.The Douglas County Attorney's Office will not subpoena victims to testify at preliminary hearings unless absolutely necessary.A not guilty plea is followed by bond setting and a trial date is set. If the offender pleads not guilty,DVPU attorneys will proceed to trial.Often victims are unwilling or unable to participate in prosecution and trials are not always possible without victim testimony. In these situations, prosecutors will utilize evidence available to them to induce a plea,including jail phone calls and additional charges such as tampering with a witness.OPD Investigators will provide follow-up investigation at the request of the County Attorney's Office. Pre-Sentence Investigation(PSI).A guilty or no contest plea is followed by sentencing. The State of Nebraska District 4A Probation conducts pre-sentence investigation on all felonies and most misdemeanors, as directed by the court. Sentencing If convicted at trial,or the offender at any time pleads guilty,they must be sentenced to jail, probation,fine or any combination thereof.County and District Court judges are encouraged to order batterer intervention programs to DV offenders on probation. If probation is ordered,a DV probation officer will supervise and monitor the offender.The Probation Department will always advocate for probation requirements to include participation in a batterer's intervention program.The Women's Fund of Omaha (WFO)works with partners to maintain a listing of local programs. Lists the specific results of the project's measureable outcomes achieved for the preceding 12 months. Project outcomes were met or exceeded during the last 12 months. The number of domestic violence(DV)warrant arrests was far exceeded by 30 percent(712 arrests and a projected goal of 497). This is largely due to an increase in warrants sweeps and an enhanced process. The sweeps are funded through a separate project,however a new process pushes offenders with warrants who were unable to be located during the sweep to the local precincts. With local precincts notified of these high-risk warrants,law enforcement can continue to attempt to locate offenders in the weeks leading up to the sweep. The new process has proved successful in lowering the number of domestic violence warrants. The Douglas County Attorney's Office also exceed the goals of the number of`victimless' prosecutions by 28 percent(288 with a project goals of 135)and the number of protection order violation charges resulting in plea or conviction by 10 percent. The Douglas County CRT satisfaction and confidence outcomes are measured by an annual survey done through Survey Monkey. A survey was not completed in the last 12 months;however,the survey is scheduled to go out in January 2018 and will be reported on in the next FY 2016 STOP VAWA grant quarterly report. 2. The restitution goal was difficult to maintain and was not met in FY 2015 STOP Violence Against Women Act (VAWA)grant period.The project outcome was lowered in the FY 2016 STOP VAWA grant period,which is on track to be met. Training prosecutors on the needs around requesting restitution for victims has occurred. However,this outcome is reliant on judges to award restitution. Additional conversations are taking place on how to approach judges with this issue and how probation can support this through the Presentence Investigation process. The DVIS consists of a Lieutenant Unit Commander,an administrative sergeant,and a unit sergeant who oversees seven(7)officers,one(1)part-time retired officer,and one(1)clerical support. The DVIS unit is part of the Special Victims Unit(SVU),and a partner with the Sexual Assault/Child Victim Unit(CVSA). A Bureau Lieutenant commands both units,overseeing the frequent inter-unit communication necessary to address cases involving overlapping issues,offenders,and victims. The unit Sergeant and officers conduct follow-up investigations;apply for warrants for suspects;write and conduct search warrants; plan and implement warrant operations to apprehend offenders with • outstanding domestic violence warrants;gather evidence sufficient to support the prosecution of offenders when the victim is unable to do so; and interact with prosecution,probation,and the courts to hold offenders accountable. The Sergeant and the officers review reports received by Adult Protective Services(APS),and coordinates support with the Nebraska Department of Health and Human Services in follow-up investigations into the legal aspects of elderly abuse. The Sergeant and officers are responsible for reviewing reports when it is believed a crime has occurred. Additionally,the Sergeant and officers will gather necessary evidence in the prosecution of offenders. DVIS is a vital partner in the Douglas County Community Response Team(CRT)and plays an important role in the CRT's efforts to reduce domestic violence. The Sergeant and officers of the OPD DVIS develop and participate in training programs that coordinate with community partners to provide specialized training in the area of Domestic Violence to new and current OPD officers. WCA is the only DV/SA victim service agency in the state that has attorneys on staff to provide these legal services. 0.30 FTE Client Attorney The 0.30 FTE Client Attorney is an existing,exempt full-time position currently funded by the FY 2016 STOP Violence Against Women's Act(VAWA)Grant. Under the FY 2016 STOP VAWA Grant,the position dedicates 30 percent of their time to STOP VAWA activities. The current annual salary rate for the position is$68,355,with an anticipated four(4)percent increase for 2018 to$71,089. Funding from FY 2017 STOP VAWA would allow the WCA to maintain this position. VAWA funding will be used to enable the Client Attorney to dedicate 624 hours during the grant period to perform grant funded VAWA activities. The requested salary amount is$21,327($71,089 x 0.30 FTE). This equates to approximately 26 hours per bimonthly pay period. The Douglas County Attorney's Office handles all domestic violence cases in Douglas County and the DVPU devotes itself entirely to prosecuting these cases. Between January and November 2017,the DVPU reviewed 2,326 misdemeanor and 633 felony domestic violence reports submitted by seven(7) different law enforcement agencies within the county. The DVPU Liaison is an essential and necessary component of the DVPU and functioning with the Community Response Team(CRT). The Liaison primarily aids in the communication between the prosecuting attorney and law enforcement,victims,and victim advocacy groups. The liaison compiles new arrest reports and prepares them for review by the prosecutors to make charging decisions. This task requires the DVPU Liaison to ensure the defendant's criminal record,along with a complete set of available reports and photographs,are available to the prosecutor to form a comprehensive picture for the charging decision. The DVPU Liaison contacts law enforcement to coordinate requested follow-up investigation as requested by the prosecutor. The DVPU Liaison collects,logs,and disseminates warrant requests submitted by law enforcement. In 2017, 811 misdemeanor and 165 felony warrant requests were submitted for review by law enforcement. The DVPU Liaison maintains continuous contact with victims in domestic violence cases. Following an. arrest,the DVPU Liaison contacts the victim to discuss the criminal case and the process. The DVPU Liaison calls victims to inform them of the charges,the arraignment time,and to answer questions. • Additionally,they inform victims of available services,including counseling,protection orders and shelters;and assist underserved populations by keeping informed of new and updated community • resources available to these victims. Without the requested funding,this position would be eliminated and victim services and advocacy would suffer. The DCAO will provide a match of$14,790 for a total position cost of$67,336. The Misdemeanor Prosecutor is an existing full-time salaried position funded by the FY 2016 STOP VAWA Grant at an annual rate of$57,720($27.75/hour x 2,080 hours). The Douglas County pay plan includes a four(4)percent pay increase in 2018. The annual salary for the Misdemeanor Prosecutor will therefore be$60,029. The DCAO is requesting funding for 87 percent of the Misdemeanor Prosecutor's salary($52,225)under the FY 2017 STOP VAWA Grant. The DCAO pays$18,278 for the Misdemeanor Prosecutor employer fringe benefit contributions. Fringe benefits include the employer portion of: health insurance$8,326($693.80/month x 12 months)and dental insurance$258($21.51/month x 12 months); Social Security$3,722(6.2%of salary);Medicare $870(1.45%of salary);and Pension$5,102(8.5%of salary). No Federal funds are used for the match; all fringe benefit costs will come from the Douglas County Board Budget approval from the General Fund. This is not a budget position.The DCAO will provide a match of$14,790 toward DV Prosecutor fringe benefits. The DVPU Misdemeanor Prosecutor is an essential and necessary component of the DVPU and functioning with the Community Response Team(CRT). The DVPU Misdemeanor Prosecutor prosecutes misdemeanor domestic violence cases,reviews arrests and arrest warrants daily,and makes charging decisions. The Prosecutor reviews law enforcement reports involving multiple offenders and previous victims. The Misdemeanor Prosecutor is in regular contact with victims providing updates on their case to ensure the victim is informed, given proper referrals to community resources,and to walk the victim through the legal process. The Misdemeanor Prosecutor vigorously prosecutes crimes of domestic violence and will use evidence-based prosecution so the offender may still be held accountable despite the victim's refusal to testify or cooperate in the investigation. Additionally,the DVPU Misdemeanor Prosecutor participates, along with the entire Domestic Violence Unit, in monthly mock trial training for medical students to emphasize using evidence under the medical treatment and diagnosis hearsay exception. The Domestic Violence Prosecution Unit(DVPU)Misdemeanor Prosecutor receives ongoing training in domestic violence prosecution to recognize the dynamics of domestic violence. The DVPU Misdemeanor Prosecutor prosecutes domestic violence related sexual assault,cases where there have been elements of domestic assault and sexual assault as well as cases with elements of domestic violence sexual misconduct. The Douglas County Attorney's Office is committed to the prosecution of domestic violence and sexual assault cases,holding offenders accountable.
