ORD 41800 - Amendment to MUD agmt for Waterford Crossing Replat 27 C10-05-144 C12-05-145 ORDINANCE NO. gig-co AN ORDINANCE to approve a Major Amendment to a Mixed Use District Development Agreement for Waterford Crossing Replat 27,Lots 1-4 and.Outlots A-B,located northeast of 156th and Ida Streets, to incorporate into the table for the Mixed Use District Development Agreement the approved building permit and development of Lots 27 and 28, Waterford Crossing, between the City of Omaha and Dragon Storage, LLC, providing site development standards; and to provide for an effective date. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That the City of Omaha,in the interest of maintaining public health,safety,and welfare, desires to assure the property located northeast of 156th and Ida Streets is developed in accordance with the provisions of the Major Amendment to a Mixed Use Development Agreement attached hereto and made a part hereof by reference. Section 2. That if this Ordinance, or portion thereof, is found to be invalid, any zoning ordinance applicable to such site shall not be invalidated for such reason. Section 3. That this Major Amendment to a Mixed Use Development Agreement is hereby approved. Section 4. This Ordinance shall be in full force and effect fifteen (15) days from the date of its passage. NOW,THEREFORE,the following is agreed between the parties hereto: 1. Exhibit A to the original agreement is repealed in its entirety and the attached Exhibit A is substituted in its place. 2. Exhibit B to the original agreement is amended by adding thereto the site plans of the development proposed for Waterford Crossing Replat 27,Lots 1-4 and Outlots A and B, Inclusive,attached hereto as"Exhibit B-Replat 27. 3. "Exhibit C"to the original agreement is repealed in its entirety and the attached"Exhibit C" is substituted in its place. 4. Buffer yards shall be provided as indicated on the attached Exhibit B. 5. The landscaping for Waterford Crossing Replat 27,Lot 1 shall be provided as indicated on the ' attached Exhibit B. 6. Exhibits B-3 through B-5 to the original agreement are repealed in their entirety and the attached Exhibits B-3 through B-6 are substituted in their place.
