City of Omaha in the amount of$15,088.00 to be matched in-kind with City
services. The term of the Agreement is from March 1, 1995 until February 29,
1996.
This is one of a series of annual grants that the City has received for many years.
The funds are used to assist with Historic Preservation duties mandated in
Chapter 25 of the Omaha Municipal Code.

CERTIFIED LOCAL GOVERNMENT AGREEMENT
THIS AGREEMENT entered into this llth day of July 1995, between the
NEBRASKA STATE HISTORICAL SOCIETY, by and through the State
Historic Preservation Officer, and the CITY OF OMAHA hereinafter
referred to as the Grantee, relates to a project to be undertaken
by the Grantee assisted by the Nebraska State Historical Society
with grant support established under the National Historic
Preservation Act of 1966, as amended, and administered through the
National Park Service, U.S. Department of the Interior.
The Nebraska State Historical Society and the Grantee agree to
effect this Agreement in accordance with all applicable
regulations, laws, policies, guidelines, and requirements governing
federal grant support administered through the National Park
Service, U.S. Department of the Interior; all conditions of this
Agreement and requirements which are incorporated by reference and
made part of this Agreement; and any other instructions which may
be developed between the Nebraska State Historical Society and the
Grantee. The Nebraska State Historical Society and the Grantee
hereby agree as follows :
I. Project Work Program
The Grantee shall carry out project work as specified in the
"Project Work Program, " which is hereby incorporated into and made
part of this Agreement as Exhibit "A" . All project work and all
project funds, both federal share and Grantee's share, shall be
expended only for the Project Work Program in accordance with the
"Project Budget" which is hereby incorporated into and made part of
this Agreement as Exhibit "A." Any proposed changes in the Project
Work Program or the Project Budget must be submitted to the
Nebraska State Historical. Society in writing at least 30 days in
advance of the proposed effective date and approved by the Nebraska
State Historical Society in writing before such changes can then
take place.
II. Period of Performance
The term of this Agreement shall be March 1, 1995 until February
29, 1996. All project work and all funds, both federal share and
Grantee' s share shall be incurred during this term. Any proposed
changes or extensions in the term of this Agreement must be
submitted to the Nebraska State Historical Society in writing at
least 30 days in advance of the existing ending date of this
Agreement and approved by the Nebraska State Historical Society in
writing before such changes or extensions can then take place.

III . Amount of Agreement
The Nebraska State Historical Society hereby obligates to the
Grantee with this Agreement the amount of $15, 088 . 00 in federal
historic preservation grant support to be matched by the Grantee in
an equal or greater amount consistent with Exhibit "A" . The amount
of this Agreement is limited to a maximum of 60% of the allowable
costs incurred by the Grantee in carrying out project work during
the term of this Agreement, or the amount of the federal share
indicated above, whichever is less .
Subject to the availability of funds from the National Park Service
and to successful completion of all project work, the Nebraska
State Historical Society agrees to pay the Grantee $15, 088 . 00 or
the maximum percentage (s) of allowable costs as specified above,
whichever is less, as follows:
A. Up to $12, 070 . 40 or 80% of the federal share in reimbursement
to be paid within 30 days of receipt, by the Nebraska State •
Historical Society, of a copy of an acceptable "Payment Request"
and auditable records as specified in the Payment Request. The
Grantee may elect to phase Payment Requests on a periodic basis,
but not more frequently than once a month. If phased Payment
Requests are requested, the Grantee may request no more than the
specified maximum percentage (s) of total allowable costs for that
period. Reimbursement to the Grantee may be retained pending
submission of any overdue "Progress Reports" or other materials
specified in the Project Work Program.
B. The Nebraska State Historical Society will reimburse $3, 017 . 60
or 20% of the federal share to the Grantee within 30 days of the
specified ending date of the project upon receipt and acceptance of
all satisfactorily completed project materials as specified in the
Project Work Program, a copy of an acceptable Payment Request and
all remaining auditable records. The Payment Request for final
reimbursement shall be submitted no later than 30 days after the
ending date for project work.
The Grantee agrees to maintain all financial and administrative
documents and records pertaining to this Agreement for a period of
three years after the specified ending date of the project or after
all other pending matters are closed. The Nebraska State
Historical Society, the State Auditor of Public Accounts, the
National Park Service, the Department of the Interior, the
Comptroller General of the United States, or any of their duly
authorized representatives, shall have access to any books,
documents, papers, and records of the Grantee which are directly
pertinent to this Agreement for purpose of making audit,
examination, excerpts, and transcription. The Grantee shall be

responsible for satisfactory resolution or recovery of disallowed
costs should any be identified in future audit or examination.
Provisions of the Single Audit Act of 1984, P.L. 98-502, define
audit performance by state and local governments that receive
federal aid. Office of Management and Budget Circular A-128
"Audits of State and Local Governments" sets forth OMB regulations
in implementing the Single Audit Act. Wherever applicable, the
Grantee as a recipient of federal financial assistance covered by
OMB Circular A-128 or OMB Circular A-110 "Uniform Administrative
Requirements for Grants and Agreements with Institutions of Higher
Education, Hospitals, and Other Nonprofit Organizations" shall
assure that prescribed provisions are met and that audits are
conducted under applicable period(s) conjointly with this
Agreement; and shall transmit to the Nebraska State Historical
Society in a timely manner copies of such audit reports made
pursuant to said Circulars .
IV. Allowable Costs
Allowable costs shall be those costs documented to the satisfaction
of the Nebraska State Historical Society in accordance with Office
of Management and Budget Circulars A-87 (or, for educational
institutions Circular A-21, nonprofit organizations Circular A-
122) , and the National Park Service' s National Register Programs
Guideline, NPS-49 which are determined to:
A. meet federal requirements for the program;
B. be necessary and reasonable to the completion of project
work;
C. have been incurred for project work during the period of
this Agreement.
V. Personnel
The Grantee agrees to provide and maintain personnel whose
qualifications have been reviewed and approved by the Nebraska
State Historical Society and identified in the Project Work
Program. The Nebraska State Historical Society will maintain
regular contact with the Grantee personnel, as necessary, and to
provide necessary and reasonable amounts of training, advice or
technical assistance as required for the successful completion of
project work.
VI. Progress Reports
The Grantee will be required to submit acceptable periodic
"Progress Reports" by the dates specified in the Project Work
Program. The Grantee shall contact the Nebraska State Historical
Society immediately if any situation should arise which will effect
the timely or successful completion of the project.

VII. Other Provisions
Any publications arising from this project must acknowledge the
assistance of grant support from the National Park Service, U.S.
Department of the Interior as administered by the Nebraska State
Historical Society under provisions of the National Historic
Preservation Act of 1966. The format of the acknowledgement will be
provided upon request. In addition, the Nebraska State Historical
Society will provide, upon request, National Park Service
requirements and regulations pertaining to reporting and patent
rights, if any, evolving from this Agreement involving research,
developmental, experimental, or demonstration work with respect to
any discovery or invention which arise or are developed in the
course of this Agreement and of National Park Service requirements
and regulations pertaining to copyrights and rights in data.
Federal historic preservation grant support may not be used to
engage in any activity designed to influence legislation pending in
Congress. Costs associated with "lobbying" are not allowable as
charges to this Agreement in accordance with 18 U. S.C. 1913: "No
part of the money appropriated by any enactment of Congress shall,
in the absence of express authorization by Congress, be used
directly or indirectly to pay for any personal service,
advertisement, telegram, telephone, letter, printed or written
matter, or other device, intended or designed to influence in any
manner a Member of Congress, to favor or oppose, by vote or
otherwise, ' any legislation or appropriation by Congress, whether
before or after the introduction of any bill or resolution
proposing such legislation or appropriation; but this shall not
prevent officers or employees of the United States or its
Departments or agencies from communicating to Members of Congress
at the request of any Member, or to Congress through the proper
official channels, request for legislation or appropriations which
they deem necessary for the efficient conduct of the public
business . "
The Grantee agrees to comply with all applicable federal and state
laws, regulations, policies, guidelines and requirements concerning
equal opportunity, affirmative action and fair employment
practices. The Grantee further agrees to comply with all
applicable laws, regulations, policies, guidelines, and
requirements of this federal grant program.
The Nebraska State Historical Society reserves the right to cancel
this Agreement and withdraw or recapture financial assistance
provided under this Agreement in the event of nonperformance on the
part of the Grantee. Nonperformance includes, but is not limited
to: (1) failure to execute and return this Agreement within 30 days
of receipt; (2) failure to report progress of the project when

requested by the Nebraska State Historical Society; (3) any action
or inaction not in accordance with this Agreement.
This Agreement may be terminated short of conclusion upon 30 days
written notice from the Nebraska State Historical Society. Should
this Agreement be terminated by the Nebraska State Historical
Society, except for reasons or nonperformance, the Nebraska State
Historical Society will reimburse the Grantee for up to a maximum
of the federal share for eligible costs incurred to the termination
date.
Should this Agreement be terminated short of conclusion by the
Grantee, the Nebraska State Historical Society may reimburse the
Grantee for up to a maximum of the federal share for eligible costs
incurred to the termination date, withdraw financial assistance, or
may require the Grantee to recapture any or all federal funds
transferred to the Grantee by the termination date, depending upon
the circumstances of the termination.
The Nebraska State Historical Society will not be liable for any
injuries, damages, or judgments ensuing as a direct or indirect
result of the actions of the Grantee in the performance of this
Agreement.
Certified Local Government (CLG) Provision
This project receives funding for Certified Local Government
historic preservation programs, under an Historic Preservation Fund
(HPF) grant from the U.S. Department of the Interior, National Park
Service and administered by the Nebraska State Historical Society.
The Grantee acknowledges the . conditions and requirements of the
effective CERTIFIED LOCAL GOVERNMENT AGREEMENT, Nebraska' s
Certified Local Governments: Procedures for Approved Local Programs
and Transfer of Funds, and all applicable Federal regulations and
guidelines referenced therein.
As a Certified Local Government under Nebraska' s Certified Local
Governments: Procedures for Approved Local Programs and Transfer of
Funds, and all other applicable instructions, Federal regulations,
standards and guidelines, the Grantee agrees to maintain Certified
Local Government status as per the effective CERTIFIED LOCAL
GOVERNMENT AGREEMENT and to bring to the attention of the State
Historic Preservation Officer any changes effecting the CERTIFIED
LOCAL GOVERNMENT AGREEMENT.

EXHIBIT "A"
Project Work Program
The contents of the Grantee' s "Funding Request and Application"
dated April 7, 1995 (revised form received April 26, 1995) are
hereby incorporated and made part of this Agreement, as well as the
"Funding Request & Application Addendum. " The Grantee also
acknowledges receipt of the "Grants and Contracts Manual" (Nebraska
State Historical Society, March 1988) and is familiar with the
terms and conditions of the Agreement, contract provisions, federal
historic preservation grant support, the requirements for
reimbursement, and the necessary documentation as discussed
therein.
Progress Reports
Mid-year progress report due September 30, 1995. Format shall be
consistent with Part III "Program Description. " The report shall
include, but is not limited to the phases of the above-referenced
work completed to date, discussion of follow-up required to
accomplish remaining phases, and any other special conditions or
circumstances relating to the Project Work Program.
End-of-year worksheet due February 29, 1996. Format shall be
provided by the Nebraska State Historical Society.
End-of-year report due no later than 30 days after the ending date
for project work or upon submission of final reimbursement,
whichever comes first. ' The report shall be consistent with Part
III "Program Description. " The report shall include, but is not
limited to, all actual accomplishments during the funding period
and a discussion of any follow-up required to accomplish remaining
phases (as applicable) .

I.Subcommittee on Cultural Diversity will proceed with property identification for Danish culture. Follow up with
survey, evaluation and possible nomination procedures. If time permits,continue same with next cultural group.
During FY94,ethnic/cultural groups were identified.Two groups,Czech and Danish were chosen for the
staff to begin identification of associated properties. Since a Czech property,Swoboda Bakery, is scheduled for
nomination later this year,focus has been on the Danish culture. Staff is working with the local Danish American en
group to begin to identify properties. Staff will begin meeting with Danish American contact map properties
associated with Danish culture;proceed with survey and evaluation of those properties;work with property owners
toward local and national register nomination, and possibly Part I certification. It is estimated that FY95
activities will entail mainly Danish property-related work.This process will continue with other ethnic/cultural
groups as completed.
II. Master Planning activities:
a. Following the establishment of"mixed-use areas", follow up with survey and evaluations.
b. meet with property owners/neighborhood groups for determination of Historic District possibilities
and/or Conservation overlays.
Note: It is highly possible, due to the political nature of the Master Plan itself, that work in this area will be

I. Cultural Diversity: A major part of the process(involving identification and possible registration of
ethnic/cultural related properties)will be to meet with local organizations(such as Danish Brotherhood)to help in
identification, to share information, to promote designation.
Objective: To provide/share with cultural organizations and public in general information. Goal is to promote
National Register nomination and Local designation esignation to a wider range of properties.

FY95 CERTIFIED LOCAL GOVERNMENT
FUNDING REQUEST & APPLICATION ADDENDUM
This document outlines a scope of work for specific activities and products to be performed under
Omaha's Certified Local Government(CLG)Funding Request&Application for FY95. The
scope of work shall include activities under five major program areas in the CLG Funding Request
&Application, including Survey, Evaluation, Registration,Planning, and Public Participation.
Upon completion of this year's project,we anticipate additional follow-up activities or products
performed under the program area of Public Participation/Public Education in next year's(FY96)
funding period.
SCOPE OF WORK(SECTIONS A-E)
A. The scope of work shall include the completion of a National Register of Historic Places
historic district nomination for a commercial warehouse area of downtown Omaha, Douglas
County,Nebraska. The Nebraska State Historic Preservation Office(NeSHPO), in consultation
with the Landmarks Heritage Preservation Commission staff, has determined that a section of
downtown Omaha is eligible for listing on the National Register. The proposed district is an
approximately twenty-six block area roughly bounded by 9th Street on the east, 16th Street on
the west, Jackson Street on the north, and the railroad tracks on the south. The proposed
boundary crosses the tracks on 10th Street south to Pacific Street. The proposed historic district
comprises approximately 64 contributing and 19 non-contributing buildings. Final district
boundaries, contributing\non-contributing building count,and period of significance shall be made
in consultation with NeSHPO staff. In the opinion of the NeSHPO,the district is eligible under
National Register Criterion A.
B. The completed National Register of Historic Places nomination form will include,but not be
limited to,the following: (representative program areas are shown in parentheses):
1) A contributing and non-contributing building inventory with construction dates,building
descriptions and building addresses(survey, evaluation, registration);
2) Nebraska Historic Buildings Survey(NeHBS)number assignments for all contributing
buildings not previously surveyed,if any(survey, evaluation);
•
3) Both USGS and appropriate historic district maps(survey, registration);
4) Computation of pertinent UTM coordinates(registration);
5) Black and white photographs and color slides processed and labeled in accordance with
National Register and NeSHPO standards, and in sufficient number to adequately
document and present the nomination in a public forum(survey, registration);
6) Historic context and narrative developed in association with the historic context report:
Wholesale Jobbing in Omaha, 1875-1941 (registration, planning);
7) Property description and significance narrative(registration);

8) A bibliography(registration);
9) Locational data including boundary description and justification(survey, registration).
All of the information shall be completed and compiled in accordance with National
Register of Historic Places bulletins 16A and 21.
C. Omaha Landmarks Heritage Preservation Commission staff will hold a public meeting to
publicize this nomination and to partially fulfill National Park Service requirements. NeSHPO staff
will participate in the public meeting, and assist in its organization(public participation).
D. The Landmarks Heritage Preservation Commission Administrator will present the nomination
to the Nebraska State Historic Preservation Review Board at the appropriate meeting.
E. The Landmarks Heritage Preservation Commission Administrator shall present to the
Commission members,at the appropriate meeting, a status report on Omaha's Master Plan. The
report shall include, but not be limited to, how the activities outlined in this addendum further the
goals and objectives of historic preservation as identified in the Master Plan(planning, public
participation).

WHEREAS,the City of Omaha's historic preservation program, administered by the
Planning Department, is mandated to carry out specific preservation duties under Chapter 24 of the
Omaha Municipal Code; and,
WHEREAS,the City of Omaha's historic preservation program is certified by the U.S. "
Department of the Interior,National Park Service; and,
WHEREAS, Certified Local Government programs are eligible for annual Historic
Preservation Fund grants; and,
WHEREAS, the City of Omaha has utilized Historic Preservation Fund grants for
supplemental funding for its historic preservation program; and,
WHEREAS,it is necessary for the City to enter into an Agreement with the Nebraska
State Historical Society, a copy of the Agreement is attached hereto and made a part hereof as though
recited herein.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT,the attached Agreement, as recommended by the Mayor,between the City of
Omaha and the Nebraska State Historical Society for a grant to supplement the City's historic
preservation program in the amount of$15,088.00,to be matched with City services in-kind,for the
period of March 1, 1995 until February 29, 1996, is hereby approved.
