It creates a separate library fund and credits all fees and fines collected by the Omaha Public Library to that fund. The fees and fines would thereafter be used exclusively for the Omaha Public Library. The Resolution is not effective until January 1, 1996. It will have no effect on the present year's budget. Councilmember Frank Christensen requests a resolution be prepared for the October 31, 1995 City Council Agenda which would require the Finance Department to create a separate fund for library fees and fines. All library fines and fees would be credited to this separate account and the funds would be available for the exclusive use of the Omaha Public Library. An accompanying fund transfer ordinance will request the transfer of $185,000 in 1996 to offset the loss of this amount to the General Fund. CITY OF OMAHA LEGISLATIVE CHAMBER Omaha, Nebr 19 RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: WHEREAS,the Omaha Public Library collects fees and fines as part of its operations in providing library services to the citizens and residents of Douglas County; and, WHEREAS, Section 51-209 of the Nebraska Statutes provides that funds acquired for the erection, maintenance, or support of a public library shall be kept for the use of the library separate and apart from all other funds of the city, village, county, or township; and, WHEREAS, presently no separate library fund exists into which the Omaha Public Library fees and fines are credited; and, WHEREAS, it is the desire of this City Council that effective January 1, 1996, a separate library fund be created into which will be credited fees and fines collected by the Omaha Public Library; and, • WHEREAS,it is the desire of this City Council that these fees and fines shall be used exclusively for the purposes of the Omaha Public Library; and, WHEREAS,this City Council finds it is in the best interests of the citizens of the City of Omaha that this separate library fund be created. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, the Omaha Finance Department is hereby directed to create a separate library fund into which will be credited fees and fines collected by the Omaha Public Library,which funds shall be used exclusively for the purposes of the Omaha Public Library.
