(402)444-5220 of Omaha and Cass Street Partnership. This Subdivision Agreement covers the
Telefax(402)444-5248 public improvement of Cass Street Replat of Douglas County,Nebraska located
Michael J.DeSelm,P.E. Northeast of 83rd& Cass Streets.
Acting Director
This Subdivision Agreement stipulates which public improvements will be built
by Cass Street Partnership in Cass Street Replat. The entire cost of
improvements made in this development will be paid by the Subdivider.
The Subdivision Agreement will benefit the City of Omaha and the Subdivider
in clarifying the responsibilities of the parties in building and maintaining the
improvements in the subdivision.
The Public Works Department requests your consideration and approval of the
attached Resolution and Subdivision Agreement.

SUBDIVISION AGREEMENT
his Subdivision Agreement, made this 7,'7 day of
r, 1995, by and between CASS STREET PARTNERSHIP, a Nebraska
Partnership (hereinafter referred to as "SUBDIVIDER" ) , and the CITY
OF OMAHA (hereinafter referred to as "CITY" ) .
WHEREAS, the Subdivider is the owner of the land shown on the
proposed plat attached hereto as Exhibit "A" (hereinafter referred
to as "PROPERTY"; and,
WHEREAS, the Subdivider proposes to build public improvements
on the Property; and.
WHEREAS, the Subdivider wishes to connect the system of
sanitary sewers to be constructed within the Property to the sewer
- system of the City of Omaha; and,
WHEREAS, the Subdivider and City desire to agree on the method
for the installation and allocation of expenses for public
improvements to be constructed in the Property.
NOW, THEREFORE, in consideration of the above the following is
agreed between the parties hereto:
1. Public improvements. Attached hereto as Exhibit "D" and
incorporated herein by reference are plats showing the
public improvements to be installed on the Property, i.e.
paving of public streets (hereinafter referred to as
"IMPROVEMENTS" ) . All improvements must receive the
approval of the Public Works Department of the City prior
• to construction.
The storm sewer and sanitary sewer servicing the property
as shown on Exhibit "D" are private.
2. Water, gas, and electrical power. The Subdivider agrees
to enter into an Agreement with the Metropolitan
Utilities District regarding all water and gas line
extensions on the Property, and into an Agreement with
the Omaha Public Power District for power lines to be
installed on the Property. Copies of all Agreements with
the Metropolitan Utilities District and the Omaha Public .
Power District will be provided to the City within four
months from the date ofthis Agreement.
3. Installation of improvements. The Subdivider agrees to
commence the timely and orderly installation of the
improvements following execution of this Agreement,
pursuant to Section 53-9 of the Omaha Municipal Code.
4. Payment for improvements. The Subdivider shall pay the
cost of all of the improvements, as well as all charges
by the Metropolitan Utilities District for water and gas
line installation and charges by the Omaha Public Power
District for underground electrical service or overhead
power installations.
5 . Sidewalks. The Subdivider shall cause sidewalks along
the north side of Cass Street and the east side of 83rd
Street within the area to be developed to be constructed
according to the following schedule:
( 1) Sidewalks shall be constructed as illustrated on
Exhibit "D" attached hereto.
(2) Sidewalks shall be constructed as soon after
development as weather shall permit.

(3 ) In any event, all sidewalks shall be constructed
within the Property within three years of the
recording of the subdivision plat.
(4) Subdivider shall grant an easement to the City of
Omaha to maintain and repair the sidewalks on the
Property as illustrated and noted on Exhibit "A" .
6. Right to connect to City sewer system. The City hereby
acknowledges that it has given the Subdivider the right
to connect the sanitary sewer system of the Property to
the City sanitary sewer system, subject to obtaining
proper permits and paying the regular fees.
Lot 1 of the Property is not currently in a sanitary
sewer district. Sanitary sewer connection fees of
$14, 235 . 65 ( 605 lineal feet at $23.53 per lineal foot)
shall be payable upon application for a building permit
on such lot. No sanitary sewer connection fees are
payable for the remainder of the Property.
7. Subdivider shall remove the retaining wall and regrade
the bank along the Little Papio Creek, do landscaping
near the Creek in accordance with the NRD specifications,
provide storm sewer outlets according to NRD
specifications, and provide a channel maintenance
easement agreement and ingress/egress easement to the
District, all as set out in Exhibit "H" , attached hereto,
which letter is dated January 26, 1995, from Papio-
Missouri River NRD. The easement agreement must be
provided to the District (an executed copy) prior to
final plat approval.
8 . Abandoned storm sewer. Subdivider shall remove the
existing storm sewer, as noted on Exhibit "D" .
9. Dedication for road improvements. Subdivider shall
dedicate to the City an area illustrated and noted on
Exhibit "A" for turn lanes and road improvements to be
completed by Subdivider.
10 . There are no Exhibits B, C, E, F or G in this agreement.
All Exhibits correspond with the Development Agreement
between Subdivider and the City dated March 3, 1995 .
11. Binding effect. This Subdivision Agreement shall be
binding upon the parties, their respective successors,
and assigns.

Dear Mr. Kulig:
This letter is to confirm our joint conclusions reached at a
January 26, 1995 meeting with you and Doug Walter, Kirkham, Michael
& Associates, about the referenced project. The District' s stance
on the referenced project, with respect to the creek area is as
follows :
1 . We have reviewed the project conceptual plan and it is
acceptable to ,the District. Specific details (e . g. sewer
profiles) are not available at this time.
2 . It was mutually agreed that an existing wood retaining
and stone wall that are located parallel to the creek
should be removed. . It is our understanding that KVI
would be willing to remove these walls and regrade the
wall area to match. existing channel slopes (about 2 :1) .
The District would be willing to assist with the disposal
(hauling/landfilling) of these walls .
3 . It was mutually agreed that tree/bush plantings should
not be planted in the 10' landscaping buffer from Station
.10+50 .(Cass Street) to 14+00 , as it will be needed for
Little Papio Channel operation/maintenance. In addition,
trees should not be planted immediately adjacent to this
buffer to prevent limb overhang obstructions . Bushes
would be acceptable in the area west of the buffer and in
the buffer zone north of Station 14+00 , It was noted
that the City would need to waive their landscaping
buffer requirements in this area (first 350 feet north of
Cass Street) to make this concept work.
4 . It was mutually agreed that the landscaping plantings
(e .g . trees) could be made in the excess channel project
right-of-way from Station 16+50 to 19+00 . It was noted
that the creek right-of-way will not be transferred from
Douglas County to the District until July 1, 1995 .

5 . It was agreed that KVI would grant a channel maintenance
easement to the District on the 10' landscaping buffer
from Station 10+50 to 14+00 and ingress/egress across
adjacent land (driveways) for the Little Papio channel
operation/maintenance. This should be done prior to
final approval of this project by the City.
6 . The proposed storm sewer locations are acceptable to the
District. It was mutually agreed that the flow line of
four pipe outlets would be located 1 to 3 feet above
normal creek water level, rock riprap would be placed
around these outlets and wood pile supports would be
installed at each pipe outlet .

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Cass Street Partnership proposes to build a Subdivision, Cass Street
Replat, which will be located Northeast of 83rd& Cass Streets; and,
WHEREAS, Cass Street Partnership wishes to connect to Omaha's sewer system, the
system of sanitary sewers to be constructed by Cass Street Partnership within the area to be
developed; and,
WHEREAS, the parties wish to agree upon the manner in which public improvements
will be built by Cass Street Partnership and to clarify the responsibilities of the parties in building and
maintaining the improvements in the subdivision; and,
WHEREAS, a Subdivision Agreement has been prepared setting forth all the
provisions mentioned above.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the Subdivision Agreement between the City of Omaha and Cass Street
Partnership, as recommended by the Mayor, providing for the public improvements and sewer
connections to the Omaha sewer system, is hereby approved.
