RES 1995-3285 - Replat, Orchard Hilltop Commercial Replat I C-25A

LEGISLATIVE CHAMBER

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Section 14-116 of the Revised Statutes of Nebraska authorizes the City
of Omaha to regulate the subdivision of land within three miles of the corporate limits of the City but
not within the City; and,
WHEREAS, the owners of certain real estate lying within Orchard Hilltop
Commercial, a subdivision as surveyed, platted and recorded in Douglas County, Nebraska, have
petitioned to have a portion of said plat vacated and replatted as ORCHARD HILLTOP
COMMERCIAL REPLAT I; and,
WHEREAS,the owners proposing said replat have also requested a waiver of Section
53-7(4)(c) of the Municipal Code of the City of Omaha which requires the Douglas County
Treasurer's signature on said plat prior to City Council action; and,
WHEREAS, the Planning Department has recommended approval of the vacation,
replat and waiver.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the replat transmitted herewith entitled ORCHARD HILLTOP
COMMERCIAL REPLAT I, is hereby approved along with a waiver of Section 53-7(4)(c) of the
Municipal Code of the City of Omaha requiring the Douglas County Treasurer's signature on said
replat prior to City Council action; and concurrently a portion of the existing plat entitled Orchard
Hilltop Commercial,and described on said replat,is hereby vacated.
