On October 19, 1994,a court ordered Decree quieted title in favor of the City of Omaha. The requested action to convey the property to Holy Name Housing Corporation has been approved by the United Stated Department of Housing and Urban Development. The non-profit agency will rehabilitate the home and market it for sale to a low or moderate income household. This use is consistent with the neighborhood and will help stabilize and improve the neighborhood. Your favorable consideration of this Ordinance is requested. '2Q AN ORDINANCE providing for the sale of a City owned Urban Homestead property; to provide that notwithstanding Article III, Chapter 27 of the Omaha Municipal Code to the contrary, the City is authorized to accept and receive the offer of Holy Name Housing Corporation, 3014 North 45 Street, Omaha,NE,to purchase the real property described as Lot 12, 13, & 14, Block 5, Lakeview, an addition to the City of Omaha, in Douglas County commonly known as 4526 North 39th Street,for a sum of$1.00 and to provide the effective date hereof WHEREAS, on October 19, 1994, the City of Omaha was granted fee simple interest and possession of this property commonly known as 4526 North 39th Street by virtue of a Quiet Title Action resulting from the default on a Homesteading Agreement between the Homesteader and the City of Omaha. Such Agreement contained a reversionary interest clause in the favor of the City of Omaha should the Borrower(Homesteader) default. WHEREAS,the property known as 4526 North 39th Street has previously been homesteaded and subsequent attempts at locating a successor homesteader have proven unsuccessful. WHEREAS,on April 4, 1995,Holy Name Housing Corporation proposed to take ownership of said property located at 4526 North 39th Street, rehabilitate the property, and then market the property for home ownership to an eligible applicant and assist the family obtain the necessary financing. WHEREAS, the United States Department of Housing and Urban Development approved this action on January 19, 1995. WHEREAS,the Urban Homesteading Program has since ceased to exist. Ordinance No. <335W Page 2 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. Such real estate is no longer needed for the Urban Homesteading Program and is surplus property and no longer needed for public use and funds for rehabilitation are no longer available through the HUD 312 Program. Section 2. It is in the best interest of the City of Omaha and the residents thereof that said property be sold to Holy Name Housing Corporation for the purpose of rehabilitating for home ownership to a low or moderate income household. This acting is a consistent use within4the neighborhood and will help stabilize and improve the neighborhood. Section 3. Such action has been approved by the United States Department of Housing and Urban Development through which this property was originally acquired. Section 4. Notwithstanding Article III, Chapter 27 of the Omaha Municipal Code to the contrary, the City is hereby authorized to sell Lot 12, 13, & 14, Block 5, Lakeview, an addition to the City of Omaha, in Douglas County,Nebraska, commonly known as 4526 North 39th Street to Holy Name Housing Corporation for the sum of one dollar($1.00). Section 5. The Mayor of the City of Omaha is hereby authorized and empowered to execute a Quit Claim Deed to said property, and the City Clerk to attest the same to Holy Name Housing for the sum of one dollar($1.00). Section 6. That the Director of the Planning Department of the City of Omaha is authorized to deliver said executed Deed to Holy Name Housing Corporation upon receipt of the purchase price of one dollar($1.00).
