This property (402)444-5200 (402)444-5150 is located in a one block area bounded by Grand Avenue, 22nd Street, Larimore Telefax(402)444-6140 Avenue and 24th Street. The Saratoga Place Redevelopment Plan provides for the acquisition of these properties by the City of Omaha for new housing. The City has allocated . $350,000 in 1994 Community Development Block Grant funds to assist the acquisition of property and the relocation of residents. Five vacant lots, an industrial property and four houses will be acquired. The City of Omaha will have the property appraised and will offer just compensation to the owners. If the City is unable to negotiate the purchase price,the property will be acquired through eminent domain proceedings. Displaced occupants will receive moving and relocation assistance in accordance with the Federal Uniform Relocation Act and the Nebraska Relocation Assistance Act. AN ORDINANCE declaring the necessity of appropriating,for the use of the City of Omaha,certain hereinafter described vacant and improved properties located in the Saratoga Place Redevelopment Plan Area,in an area generally defined by Grand Avenue on the north, 22nd Street on the east,Larimore Avenue on the south and 24th Street on the west,for acquisition, relocation as appropriate,and subsequent use as a site for implementing the Saratoga Place Redevelopment Plan;provided that as to each specified parcel which cannot be obtained by negotiation,proceedings in eminent domain be undertaken and completed; and,providing for the effective date hereof. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: Section 1. That it is .proper and necessary, pursuant to the Nebraska Community Development Law, to appropriate vacant and improved properties generally located in an area bounded by Grand Avenue, 22nd Street, Larimore Avenue and 24th Street as outlined on the attached map, and that these vacant and improved properties necessary for such purpose are in Douglas County,Nebraska and are more particularly described as follows: 1. 4815 North 24th Street All of Lots 1, 2, 3, 4, 5, 6, 7, 8, and that portion of Lots 9, 10, 11, 12, 13 and 14, Roeder's Addition to the City of Omaha, as surveyed, platted and recorded in Douglas County, Nebraska, lying South of the center line of the abandoned Right of Way of the Fremont, Elkhorn, and Missouri Valley Railroad. 2. 2211 Grand Avenue Lots 9 and 10, Roeder's Addition to the City of Omaha,as surveyed,platted and recorded in Douglas County, Nebraska, lying North of the Fremont, Elkhorn, and Missouri Valley Railroad Right of Way; and, All that part of the abandoned Fremont,Elkhorn,and Missouri Valley Railroad Right of Way lying North of the centerline of said railroad within Lots 9 and 10, in Roeder's Addition to the City of Omaha, as surveyed,platted and recorded in Douglas County,Nebraska. • • • ORDINANCE NO. Section 2. That the City of Omaha is authorized, empowered and directed to negotiate, through either employees of the City of Omaha or through persons employed therefor or through any combination thereof, with the owners of the above described property for the acquisition of said • ORDINANCE NO. 3,,,3.5 j PAGE -3- property by the City of Omaha for the aforesaid purposes. Upon failure to agree to negotiation with the owner of any of the above described property for the acquisition thereof by the City of Omaha, the City is authorized,empowered,and directed,through the Law Department,to proceed forthwith to acquire such property not obtained by negotiation, by proceedings in accordance with the laws of the State of Nebraska, under the power of eminent domain. Any notice or notices in the name of the City of Omaha required to be given the owners of other persons having any interest in and to any of the above described property may be given by the Law Department of the City of Omaha. Section 3. That this Ordinance,being not legislative in character, shall take effect upon the date of its passage in accord with Section 2.12 of the Omaha Municipal Code.
