ORDINANCE NO. 339.5
1 AN ORDINANCE to amend Section 23-362 of the Omaha Municipal Code, entitled "Maximum
2 accumulation."; to provide that the maximum accumulation of sick leave for fire
3 management employees assigned to 40 hour shifts shall be increased from sixteen hundred
4 (1,600)hours to two thousand(2,000)hours and those employees assigned to 24 hour shifts
5 shall be increased to 3,000 hours; to repeal Section 23-362 as heretofore existing; and to
6 provide the effective date hereof.
7 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
8 Section 1. That Section 23-362 of the Omaha Municipal code is amended to read as follows:
9 Sec. 23-362. Maximum accumulation.
10 (a) Any regular or probationary employee classified as functional
11 (Class EE),as provided in section 23-176, who are not covered by a
12 collective bargaining agreement, may accrue sick leave to a
13 maximum of two thousand (2,000) hours; provided that any such
14 employee who shall maintain eight hundred (800) through and
15 including two thousand (2,000) or more of accrued sick leave shall
16 receive (2) additional hours of annual or vacation leave for each
17 semimonthly pay period of service. Notwithstanding the increase in
18 accumulated sick leave provided for herein, the payoff of
19 accumulated leave provided for in Section 23-369 shall be limited to
20 a maximum of sixteen hundred (1,600) hours. The benefit herein
21 described shall be retroactive to December 20, 1992, as it applies to
22 functional employees (Class EE).
23 (b) Any regular or probationary employee classified as Civilian
24 Management (Class A) or administrative and executive (Class AA)
25 may accrue sick leave to a maximum of two thousand(2,000) hours;
26 provided that any such employee shall maintain eight hundred (800)
27 through and including two-thousand(2,000)hours or more of accrued
28 sick leave shall receive two(2)additional hours of annual or vacation
29 leave for each semi-monthly period of service.

1 (c) Any regular or probationary employee classified as police
2 management (Class D), as provided in section 23-176, who are not
3 covered by a collective bargaining agreement, may accrue sick leave
4 to a maximum of two thousand (2,000) hours; provided, that such
5 employee who shall maintain sixteen hundred (1,600) hours of
6 accrued sick leave shall receive two(2)additional hours of annual or
7 vacation leave for each semimonthly pay period of service. Any
8 employee promoted from a union position to a police management
9 position on or after June 17, 1990, who immediately prior to said
10 promotion had accumulated to the maximum allowed sick leave shall
11 continue to ear two (2)hours of annual leave so long as the employee
12 maintains the maximum allowed accumulation of sick leave.
13 (d) Any regular or probationary employee classified as fire
14 management (Class C), as provided in section 23-176, who are
15 assigned to a twenty-four hour shift may accrue sick leave to a
16 maximum of three thousand (3,000)
17 hours;provided,that any such employee who shall maintain twenty-
18 four hundred(2,400) hours of accrued sick leave shall receive three
19 (3) additional hours of annual or vacation leave per semimonthly pay
20 period to a maximum of seventy-two (72) hours in a calendar year.
21 Any regular or probationary fire management employee assigned to
22 a forty-hour work week may accrue sick leave to a maximum of
23 aixtccn hundred (1,600) two thousand (2,000) hours of sick leave
24 shall receive two (2) additional hours of annual vacation leave for
25 such pay period of service. Any employee promoted from a union
26 position to a fire management position on or after August 20, 1989,
27 who immediately prior to said promotion had accumulated to the
28 maximum allowed sick leaver shall continue to earn two (2)hours of
29 annual leave so long as the employee maintains the maximum
30 allowed accumulation of sick leave.

36 Employees subject to the 1995 amendment to this ordinance shall be
37 required to earn hours above the maximum accumulation in effect at
38 the time of this amendment.

1 Section 2. That Section 23-362 of the Omaha Municipal Code as heretofore existing is
2 hereby repealed.
3 Section 3. That this Ordinance, not being legislative in character, shall be in full force and
4 take effect immediately upon the date of its passage.
