WHEREAS, the Douglas County Board of Commissioners has requested the vacation
of the northerly 33.35 feet of Birch Drive from 132nd Street east approximately 275.77feet; and, _�:`s
WHEREAS,the subject vacation is outside the corporate limits of the City of Omaha,
but is within the zoning jurisdiction of the City of Omaha; and,
WHEREAS, Section 23-108 Reissue Revised Statutes of 1943, requires that a City
Council recommendation concerning such vacation shall be received by the County Board prior to
the County Board taking action on any such vacation petition; and,
WHEREAS, the City Planning Board of the City of Omaha and the Public Works
Department of the City of Omaha has recommended approval of the vacation of the northerly 33.35
feet of Birch Drive from 132nd Street east approximately 275.77 feet.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the City Council of the City of Omaha recommends to the Douglas County
Board of Commissioners the vacation of the northerly 33.35 feet of Birch Drive from 132nd Street
east approximately 275.77 feet,pursuant to Exhibit "A",.a copy of which is attached hereto and made
a part hereof by this reference.
BE IT FURTHER RESOLVED:
THAT, the City Clerk is authorized to file a certified copy of this Resolution in the
Office of the County Clerk.
