Bonds under this Ordinance may be issued for the purpose of providing funds for the payment of the cost of constructing, reconstructing, improving, equipping storm sewers, sanitary sewers, interceptor sewers, combined sewers,relief sewers, or combinations thereof, including necessary plans and specifications, and acquiring such land and right-of-way and easements as may be required, but excluding the cost of the City construction equipment and payment of salaries to City employees. The approval of this Bond issue will not incur any increases in the Bond Sinking Fund Levy of the City of Omaha over the 1996 tax levy as applicable to the 1997 tax collection year. Fitle City Attorney P:\FIN\1938.SAP • • 4 • ORDINANCE NO. 338C 1 AN ORDINANCE to provide that the City Council of the City of Omaha be authorized to issue and 2 sell, from time to time, but not later than May 14, 2004, without further vote of the 3 electorate, General Obligation Bonds of the City of Omaha in an amount not to exceed Six 4 Million and No/100 Dollars($6,000,000)for the purpose of providing funds for the payment 5 of the cost of constructing, reconstructing, improving, extending and equipping of storm 6 sewers,sanitary sewers,interceptor sewers,combined sewers,relief sewers,or a combination 7 thereof, and other related branch sewer main construction in the City of Omaha, as required 8 in the design and construction of sewer facilities, including necessary plans and 9 specifications,and acquiring such lands and rights-of-way and easements as may be required, 10 but excluding the cost of City construction equipment and payment of salaries to City 11 employees,and to provide for the submission of this proposal to the qualified electors of the 12 City of Omaha for their approval or rejection at a Special City Election to be held on 13 May 14, 1996; and to provide the effective date hereof 14 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA: 15 Section 1. That there be,and there hereby is, called a Special Election to be held in the City 16 of Omaha, Douglas County, Nebraska, on May 14, 1996 for the purpose of submitting to the 17 qualified electors at said Special Election for their approval or rejection a proposal to authorize the 18 City Council of the City of Omaha, without further vote of the electorate,to issue and sell General 19 Obligation Bonds of the City of Omaha in an amount not to exceed Six Million and No/100 Dollars 20 ($6,000,000) from time to time, but not later than May 14,2004,for the purpose of providing funds 21 for the payment of the cost of constructing,reconstructing, improving, extending and equipping of 22 storm sewers, sanitary sewers, interceptor sewers, combined sewers,relief sewers, or a combination • ORDINANCE NO. 33 O '. PAGE -2- 1 thereof, and other related branch sewer main construction in the City of Omaha as required in the 2 design and construction of sewer facilities, including necessary plans and specifications, and 3 acquiring such lands and rights-of-way and easements as may be required,but excluding the cost of 4 City construction equipment and payment of salaries to City employees. 5 Such bonds shall be payable from taxes upon all taxable property in said City, subject to 6 taxation by said City,in the amounts required to be levied by Section 5.07 of the Home Rule Charter 7 of the City of Omaha, 1956,as amended, for the payment of the indebtedness of said City. No other 8 election shall be required to authorize the issuance of such bonds. Bonds issued pursuant to this 9 authority shall mature in such amounts and at such times as the City Council shall determine but not 10 more than twenty (20) years from the date thereof. 11 The approximate cost to the taxpayers of the City that will be incurred if this proposal is 12 approved and the City Council authorizes, issues and delivers all the bonds for the purpose herein 13 provided is Six Million and No/100 Dollars($6,000,000)plus interest to be payable on such bonds 14 and the approval of this Bond issue will not incur any increase in the Bond Sinking Fund Levy of 15 the City of Omaha. That said proposition shall be submitted to the electors of the City of Omaha in 2 the following form: 3 STATE OF NEBRASKA 4 COUNTY OF DOUGLAS 5 CITY OF OMAHA 6 OFFICIAL BALLOT 7 SPECIAL CITY ELECTION HELD MAY 14, 1996 8 $6,000,000 SEWER BONDS 9 SHALL THE CITY OF OMAHA BE AUTHORIZED TO ISSUE AND SELL 10 GENERAL OBLIGATION BONDS IN THE AMOUNT OF SIX MILLION AND 11 NO/100 DOLLARS ($6,000,000)FOR THE PURPOSE OF PROVIDING FUNDS 12 FOR PAYMENT OF THE COST OF CONSTRUCTING, RECONSTRUCTING, 13 IMPROVING, EXTENDING, AND EQUIPPING OF STORM SEWERS, 14 INTERCEPTOR SEWERS, COMBINED SEWERS, RELIEF SEWERS, OR A 15 COMBINATION THEREOF, OR ANY OTHER RELATED SEWER 16 CONSTRUCTION,THE APPROXIMATE COST TO THE TAXPAYERS OF THE 17 CITY OF OMAHA. IF THIS PROPOSAL IS APPROVED TO BE SIX MILLION 18 AND NO/100 DOLLARS ($6,000,000) PLUS INTEREST PAYABLE ON SAID 19 BONDS TO BE PAID FROM THE FUND FOR PRINCIPAL AND INTEREST 20 PAYMENTS ON THE INDEBTEDNESS OF THE CITY OF OMAHA AS 21 PROPOSED IN THE NOTICE OF ELECTION WHICH ALSO PROVIDES THAT 22 THE APPROVAL OF THIS BOND ISSUE WILL NOT INCUR ANY INCREASE 23 IN THE BOND SINKING FUND LEVY OF THE CITY OF OMAHA. 24 YES 25 NO 26 Section 3. Under said question and proposition on the ballot shall be printed the word "Yes" 27 and the word"No". All ballots of qualified electors cast at the aforesaid election with an"X" marked 28 before the word "Yes" shall be understood to be, and shall be counted, in favor of the proposition 29 set forth in said question, and all ballots of qualified electors cast at the aforesaid election with an ORDINANCE NO. 33 Z?� PAGE -4- "X" marked before the word "No" shall be understood to be, and shall be counted, against the proposition as set forth in said question. Section 4. That said ballots shall be white in color and printed in black ink or other color designated in conformance with Section 32-419 of the Revised Statutes of Nebraska 1943, as amended. Section 5. The officer having charge of General and Special Elections of the City of Omaha shall conduct the election on the question herein provided for in all respects the same as other City elections and in the manner provided by law. Section 6. The City Clerk is hereby directed to transmit a certified copy of this Ordinance to the Election Commissioner of Douglas County,Nebraska,and to give public notice to the electors, as provided by law. Section 7. That this Ordinance, pursuant to Section 2.12 of the Home Rule Charter, is deemed to be administrative rather than legislative in character and shall be in full force and take effect immediately upon the day of its passage.
