The attached Ordinance is submitted for your consideration. The Ordinance
waives the prohibition on the sale of alcohol before 12:00 noon on Sunday. If
adopted,the ordinance would permit Leisure Lanes, Inc. to sell beer on Sunday
morning, May 5, 1996, commencing at 11:00 a.m.
Although Omaha Municipal Code section 15-2(b)prohibits the sale of beer in the
City prior to 12:00 noon on Sunday,Nebraska statutes provide that beer may be
sold prior to that hour if allowed by ordinance. This Ordinance exercises that
authority and waives the restrictions of Section 15-2 only with respect to this
specific liquor license holder on this specific day.
A Special Designated Liquor License application for this event will be presented
to the Council on the first reading of this Ordinance.

1 AN ORDINANCE to waive the limitations of Omaha Municipal Code section 15-2 pertaining
2 to the sale of beer before 12:00 noon on Sunday; to authorize sale of beer commencing at
3 11:00 a.m.on the licensed premises of Leisure Lanes,Inc.,4811 "L" Street,on Sunday, May
4 5, 1996; and to provide an effective date immediately upon passage.
5 WHEREAS, Nebraska Revised Statutes section 53-179 provides, in part, that, except as
6 provided for and allowed by ordinance,no alcoholic liquor, including beer, may be sold at retail or
7 dispensed between the hours of 6:00 a.m. on Sundays and 1:00 a.m. on Mondays; and,
8 WHEREAS, Omaha Municipal Code section 15-2 provides that alcoholic liquor, including
9 beer, may be sold only between the hours of 12:00 noon Sunday and 1:00 a.m. the following
10 Monday; and,
11 WHEREAS, Leisure Lanes, Inc., 4811 "L" Street, Omaha, Nebraska, has requested
12 permission from this City Council to sell beer on Sunday, May 5, 1996, commencing at 11:00 a.m.
13 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
14 Section 1.Notwithstanding the provisions of Section 15-2 of the Omaha Municipal Code,
15 the City of Omaha authorizes and consents to the sale and consumption of beer between the hours
16 of 11:00 a.m. and 12:00 noon on Sunday, May 5, 1996, on the licensed premises of Leisure Lanes,
17 Inc., 4811 "L" Street, Omaha,Nebraska.
