The purpose of the attached ordinance prepared at the request of Councilmember
Subby Anzaldo is to prohibit the resale of tickets for events to be held at
Rosenblatt Stadium for an amount in excess of the face value of the ticket on the
grounds of Rosenblatt Stadium and the City of Omaha right of way surrounding
such facility.

1 AN ORDINANCE to prohibit the resale of tickets for events to be held at the Civic Auditorium,
2 Orpheum Theatre or Rosenblatt Stadium for an amount in excess of the face value on the •
3 grounds of such facilities or within a one-half mile radius of each such facility.
4 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
5 Section 1. That a new section be added to the Omaha Municipal Code as follows:
. 6 "Sec. 20- : Ticket Scalping prohibited.
7 (a) It shall be unlawful for any person to resell or attempt to resell a
8 ticket to an event to be held at the Civic Auditorium, Orpheum
9 Theatre or Rosenblatt Stadium for an amount greater than the face
10 value printed on such ticket on the grounds of such facilities or within
11 a one-halfmile radius of each such facility.
12 (b) For purposes of this section,resell or attempt to resell shall mean
13 to advertise or solicit for resale and shall include any sale or
14 attempted sale subsequent to the initial offer to the public."
15 Section 2. That such ordinance shall be in full force and take effect fifteen(15) days from
16 and after its date of passage.

Councilmember - Subby Anzaldo requests an ordinance be prepared for first
reading on the\June 18, 1996 City Council Agenda which would prohibit the sale
of event tickets for an amount greater than the face value printed on the ticket.
This prohibition would be confined to City of Omaha property at (and
immediately around) Rosenblatt Stadium, including City owned parking lots,
sidewalks, and open areas. The penalty would be the City of Omaha general
penalty of a $500 fine and/or six months in jail.
It is not Mr. Anzaldo's intent to prohibit the resale of tickets at or below the face
value.
