Purpose: To allow for development of the site with a mix of commercial and
residential uses.

Land Use
Designation(s):
The Future Land Use Plan designation includes a mix of low-density
residential and high-density residential.

Element of the City's Master Plan from High Density Residential to
Office/Commercial and to establish a Mixed Use Area for the
intersection of Poppleton Avenue and Park Avenue, 1303 Park
Avenue.

Applicable
Regulations:
The project will be required to comply with the base R7 and NBD zoning
districts and all other applicable regulations.
No building permits will be issued based on a site plan that does not comply with the
provisions of the Zoning Ordinance.
II. SPECIAL INFORMATION:
Site
Characteristics:
The overall site includes two separate areas totalling approximately 1.14
acres of vacant land. The west property (proposed Lot 1) includes
portions of four platted lots, previously developed with various residential
structures. The east property (proposed Lot 2) includes portions of three

platted lots, also previously developed with various residences, which
have since been razed.
Development
Proposal:
The applicant proposes to replat the site into two lots in order to redevelop
the properties with various residential and commercial uses. The
development plan for the west property includes a two-story townhouse
structure (8 units), a four-story multi-family structure with garage parking
(64 units), and a two-story commercial building (3,720 sf). The
development plan for the east property includes a 51-unit multi-family
building with garage parking and pickle ball courts.
The proposed zoning for Lot 1 is NBD-Neighborhood Business District.
The proposed zoning for Lot 2 is R7-Medium-Density Multiple-Family
Residential.
In addition to this plat and rezoning request, the applicant has also
requested approval of two PUR-Planned Unit Redevelopment Overlay
Districts (one for each lot) as well as an Amendment to the Future Land
Use Element of the City's Master Plan from High Density Residential to
Office/Commercial for Lot 1 to facilitate the overall project (Case #C11-23-
142, C11-23-143, C3-23-139).
Public
Improvements:
The corner node, on-street parking, and alley improvements are subject to
the City’s OPW public improvement review process.
Submit the 30% design report for the sanitary sewer to the Public Works
Design Division per Section 2.14 of the City’s Wastewater Collection
Systems Design Manual.
Grading and
Drainage:
The development must comply with all stormwater management
ordinances and policies, including no net increase in stormwater runoff
and treatment of the first half inch of stormwater for water quality.
Receive preliminary approval of the PCSMP from Public Works prior to
forwarding the subdivision agreement to City Council; upload the drainage
study and preliminary plans to Permix.
Utilities: OPPD has distribution equipment on/near the property. Coordinate with
OPPD on removal/relocation.
Land Use and
Planning:
Future Land Use: This request is accompanied by an application for
amendment to the Future Land Use Element of the City's Master Plan to
change the future land use designation from High Density Residential to
Office/Commercial for Lot 1. The applicant justifies the requested
amendment stating that the land use pattern and development for the
area has evolved since the original Concept Element of the Master Plan
was approved, and the proposed development is consistent with
surrounding uses and increasing commercial activity on this block of Park
Avenue. The Planning Department is supportive of the associated Master
Plan Amendment, which is explained in greater detail in the
recommendation report for related Case #C3-23-139.
The requested rezoning from R7 and R8 to R7 and NBD is consistent with
goals and objectives of the City’s Master Plan.

Development Plans: The proposed development plans have been
reviewed for compliance as part of the associated PUR requests (Case
#C11-23-142, C11-23-143).
Plat: The proposed subdivision and rezoning are consistent with the City’s
Master Plan.
III. ANALYSIS:
Conditionally, the proposed subdivision generally complies with the requirements of Chapter
53, Subdivisions, of the Omaha Municipal Code and the Omaha Master Plan.
IV. RECOMMENDATIONS:
Approval of the rezoning from R7 and R8 to R7 and NBD.
Approval of the Preliminary Plat, subject to the following conditions:
1. The corner node, on-street parking, and alley improvements are subject to the City’s
OPW public improvement review process.
2. Submit the 30% design report for the sanitary sewer to the Public Works Design
Division per Section 2.14 of the City’s Wastewater Collection Systems Design Manual.
3. Comply with all stormwater management ordinances and policies.
4. Receive preliminary approval of the PCSMP from Public Works prior to forwarding the
