ORDINANCE NO. 896
1 AN ORDINANCE to amend Section 22-78 of the Omaha Municipal Code to provide language
2 descriptive of the medical benefits payable to disabled annuitants; to repeal Section 22-78
3 of the Omaha Municipal Code as heretofore existing; and to provide for the effective date
4 hereof.
5 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
6 Section 1. That Section 22-78 of the Omaha Municipal code is hereby amended to read as
7 follows:
8 Sec. 22-78. Accidental Disability pension; injuries in the line of
9 duty.
10 (a) Any member of the system who, while in the line of duty, has
11 sustained or shall sustain injuries or sickness, arising out of the
12 immediate or direct performance or discharge of his/her duty, which
13 immediately or after a lapse of time permanently unfit such annuitant
14 for active duty in his/her department, shall receive a monthly
15 accidental disability pension as long as such annuitant remains unfit
16 for active duty in such member's department equal to fifty (50) per
17 cent of such member's average final monthly compensation. In
18 addition thereto, such annuitant shall be paid all mcdical, surgical,
19 and hospital cxpcnscs medically necessary covered services which
20 may be incurred as a result of such sickness or injury;. The payment
21 for medically necessary covered services pursuant to this section shall
22 be determined by reference to the health insurance in effect for
23 current City employees at the time the services are rendered to the
24 annuitant. Mit
25 tThe pension and other benefits, bcing in excess of benefits under the _
26 workmen's workers' compensation act, shall be in lieu thereof
27 (b) The disability annuitant may be required by the board of trustees
28 of the city police and firemen's retirement system to undergo a
29 medical examination to determine if such annuitant is still qualified
30 to receive a disability annuity.

1 (c) Nothing contained in this section shall be construed as limiting,
2 altering, repealing or affecting the authority of the city council to
3 grant full salary payment; provided however, any member receiving
4 full salary payment shall not be entitled to the benefits of this section
5 during the period full salary payments are authorized and paid.
6 (d) Any provision in this section, or in any other provision in
7 Chapter 22, providing for the payment of medical, surgical and
8 hospital expenses shall exclude experimental medical treatment as
9 that term is defined and interpreted under the City's health insurance
10 program at the time said services are rendered.
11 Section 2. Section 22-78 of the Omaha Municipal Code as heretofore existing is hereby
12 repealed.
13 Section 3. This Ordinance shall be in full force and take effect fifteen (15) days from and
14 after the date of its passage.
