The attached Resolution has been prepared at the request of the City Clerk. The Resolution consents
to the Nebraska Fertilizer and Ag-Chemical Institute holding a raffle on January 30, 1997, during
the Nebraska Agri-Business Expo at the Civic Auditorium.
State law requires that organizations wishing to hold a raffle or lottery must obtain a permit from the
state and obtain the consent of the city in which the raffle will be held. The Omaha City Council has
passed a general resolution consenting to raffles and lotteries by any business with its principal place
of business within the City. The Nebraska Fertilizer and Ag-Chemical Institute does not meet this
criteria and has requested specific consent for its raffle. The Institute has received the necessary state
permits and has received the City Council's consent for its raffles in past years.

Nebraska Fertilizer& Ag-Chemical will once again be conducting a raffle in Omaha. In
accordance with the procedures we have followed in previous years, enclosed are copies of the
license issued by the Department of Revenue and a copy of the raffle ticket.
The raffle will be held on Thursday, January 30, 1997, at the Omaha Civic Auditorium in
conjunction with the Nebraska Agri-Business Expo. The price of each ticket is$10.00 and the prizes
to be awarded are listed on the ticket.
I understand the City Council meetings are generally held each Tuesday. We would
appreciate this item being placed on the agenda for the next City Council meeting or as soon as
possible.
If you have any questions or need any additional documentation or information, please
contact me. Please also let me know as soon as possible when this matter has been set for City

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: •
WHEREAS,current statutes prohibit any person from conducting a lottery,the gross
proceeds of which exceed$1,000,or a raffle,the gross proceeds of which exceed$5,000,within the
corporate limits of the City of Omaha without first receiving authority therefor; and,
WHEREAS,Nebraska Revised Statutes section 9-426 allows licensed organizations
to obtain a special permit valid for three(3)calendar months from the state and thereafter to conduct
one(1)raffle and one(1)lottery,for which prizes are not limited to at least sixty-five percent(65%)
of gross proceeds, and expenses may exceed ten percent (1.0%) of gross proceeds; and,
WHEREAS, the Nebraska Fertilizer and Ag-Chemical Institute has applied for and
obtained such a state permit and, pursuant to section 99-433(2) of the Nebraska statutes, has
requested the City's consent for a raffle to be held at the Omaha Civic Auditorium on January 30,
1997, in conjunction with the Nebraska Agri-Business Expo; and,
WHEREAS, no more than one special permit will be issued to this licensed
organization for any calendar year; and,
WHEREAS, it is the opinion of the City Council of the City of Omaha that the
Nebraska Fertilizer and Ag-Chemical Institute should be allowed to conduct a raffle in accordance
with such special permit.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the Nebraska Fertilizer and Ag-Chemical Institute is hereby authorized,
pursuant to section 9-433(2),to conduct one(1)raffle within the City of Omaha on January 30, 1997,
pursuant to the special permit issued in accordance with the provisions of state statutes.
