The original Agreement provided partial financing in the amount of$980,000.00 from the HOME Investment Partnerships Program for the construction of 48 multi- family residential units at 36th and Orchard Streets and the subsequent rental of each unit to qualified low-income households. All of the units were designed to house persons with a hearing impairment and three units were handicapped accessible. Section 3, Paragraph 3.10 of that Agreement states that 100%of the units shall be occupied by low- income families whose annual income does not exceed 60% of the median income by Family Size. The Owner has placed an over-income resident manager in one of the units who works extremely well with hearing impaired persons. For this tenant to continue to occupy this unit, a Supplemental Agreement is necessary to reduced the number of units assisted with HOME funds from 48 to 47. By approving the attached Supplemental Agreement, this project would be in compliance with the HOME Regulations which requires ninety-percent lower-income occupancy. With the exception of this change, all other terms and conditions would remain unchanged. Your favorable approval of this proposed Resolution would be appreciated. O • SUPPLEMENTAL AGREEMENT THIS SUPPLEMENTAL AGREEMENT is to the Agreement between the City of Omaha and Orchard Manor Limited Partnership, a Nebraska Limited Partnership, General Partner: Orchard Manor Corporation, a Nebraska Non-Profit Corporation, approved by the City Council on August 23, 1994, by Resolution No. 2367, and is entered into by and between the City of Omaha and Orchard Manor Limited Partnership.
