RES 1997-0422 - Variance from urban development policy for development proposal southwest of 168th and Blondo Sts C-25A CITY OF OMAHA

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, an application has been made for a variance from the City of Omaha's
Urban Development Policy to allow the submittal of a preliminary plat(Briar Hills)for single family,
multiple family and commercial development of land located Southwest of 168th and Blondo Streets;
and,
WHEREAS, the Urban Development Policy of the City of Omaha allows the City
Council to grant variances from the strict criteria of the AG-Agricultural District; and,
WHEREAS, the application for the proposed subdivision is being made prior to the
updated Urban Development Element, and should be considered in accordance with the current
regulations; and,
WHEREAS, the advantages of approving this variance are greater than the
disadvantages to the City; and,
WHEREAS, the Planning Board has recommended approval of the variance by
unanimous vote upon the recommendation of the Planning Department and assessment of the
developer's proposal.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the City Council of the City of Omaha approves a variance from the City's
Urban Development Policy adopted by Ordinance #34059, dated January 7, 1997, to allow
consideration of a development proposal for property located Southwest of 168th and Blondo
Streets,currently zoned AG-Agricultural District,provided the proposed development complies with
Articles 53 and 55 of the Omaha Municipal Code,and all other applicable laws,rules and regulations
of the City of Omaha and State of Nebraska.
