The Subdivision Agreement covered the public improvements for Eagle Run and was approved by City Council on June 6, 1989 by Resolution No. 1351. The Amendment revises the Subdivision Agreement to provide for Bargstadt Addition, which is a replat of a portion of Lot 140 of Eagle Run. The Amendment provides for a refund of interceptor sewer fee of$4,515.10 to be paid by the City from the Interceptor Sewer Fund to S.&I.D. 328. All • other provisions of the original Subdivision Agreement remain the same. D'Ercole 7i'' 6ate M or's Office/Title Date Acting Finance Director P:\PW 1\5443.SKZ trr: AMENDMENT TO SUBDIVISION AGREEMENT (Bargstadt Addition, f/k/a Lot 2,Eagle Run Replat One, f/k/a Part of Lot 140,Eagle Run) This Amendment to Subdivision Agreement is made and executed this day of _, 1997,by and between Bargstadt Properties,L.L.C.,a Nebraska limited liability company / ("Subdivider"), Sanitary and Improvement District No.328 of Douglas County,Nebraska ("District")and The City of Omaha, a municipal corporation in the State of Nebraska ("City"), 32_VII1&51 111: WHEREAS,Subdivider is the owner of the land included within the proposed plat attached hereto as Exhibit"A"(the"Development Tract")which is outside the corporate limits of the City and within the City's zoning and platting jurisdiction; and WHEREAS,the Development Tract is a replat of Lot 2, Eagle Run Replat One as shown on Exhibit"B",Eagle Run Replat One being an administrative subdivision of Lot 140, Eagle Run, Eagle Run being an area shown on Exhibit"C"which was the subject of a subdivision agreement(the "Agreement") adopted by the City Council of the City of Omaha on June 6, 1989, via Resolution 1351 setting forth certain conditions; and WHEREAS,the Agreement needs to be amended to reflect the replatting of the Development Tract from part of Lot 140 Eagle Run to Lot 2 Eagle Run Replat One and in turn to Lots 1 and 2 of Bargstadt Addition; and WHEREAS,all public improvements,except sidewalks,necessary to service the Development Tract have been installed and special assessments levied; and WHEREAS,sidewalks will be installed as outlined in the Agreement; and WHEREAS,the Agreement needs to be revised to shown a reallocation on a pro rata basis in the interceptor sewer fees required from the District as a result of the replat, NOW,THEREFORE,in consideration of the above and foregoing recitals, it is hereby agreed by and between the parties hereto as follows: 1. Reallocation of Interceptor Sewer Fees. The City agrees to amend the Agreement to provide for reallocation on a pro rata basis of the interceptor sewer fee previously paid by Sanitary and Improvement District No. 328, computed as follows: Area to be Replatted: Lot 1,Bargstadt Addition(commercial- 1.708 acres x$3,878.16 per acre) = $6,623.90 Lot 2,Bargstadt Addition(commercial- 1.305 acres x$3,878.16 per acre) = $5.061.00 Total Interceptor Sewer Fee from Area to Be Replatted =$11,684.90 Previous Platting-Fees Paid for Interceptor Sewers: Easterly'/2 of Lot 140,Eagle Run(multi-family-60 Units at$270 per unit = $16.200.00 Total Previously Paid by SID 328 = $16,200.00 Total Due From City to SID 328 = $ 4,515.10 t ' 2. Amendment of Exhibit to Agreement. It is agreed that Exhibit"A"of the Agreement shall be amended to disclose the replat of the easterly %of Lot 140, Eagle Run, into Lot 2 of Eagle Run Replat One and the replat of Lot 2, Eagle Run Replat One into Lots 1 and 2,Bargstadt Addition as disclosed on Exhibits "A"and"B"attached hereto. 3. Private Improvements. The private improvements shall include a sanitary stub to serve Lot 2, Bargstadt Addition and a private joint use driveway to be constructed upon a joint use easement in accordance with that easement document presently filed of record, a copy of which is attached hereto as Exhibit"D". 4. Water.Gas and Electric Power. Water, gas and electric power are existing to serve Lot 1, Bargstadt Addition, and shall be extended at the cost of Subdivider to serve Lot 2,Bargstadt Addition. 5. Installation of Improvements. The cost for the private improvements installed on and for the benefit of Lots 1 and 2,Bargstadt Addition, shall be paid by the owner of Lot 1, Bargstadt Addition, and allocated on a pro rata basis between Lots 1 and 2. 6. Binding Effect. This Amendment to Subdivision Agreement shall be binding upon the parties hereto and their respective successors and assigns and shall run with the land as shown on Exhibit"A"attached hereto. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, the Amendment to the Subdivision Agreement between the City of Omaha, Sanitary and Improvement District 328 of Douglas County, Nebraska and Bargstadt Properties, L.L.C., as recommended by the Mayor, providing for the sewer connection to the City of Omaha sanitary sewer system and a refund of Interceptor Sewer Fees, is hereby approved.
