On June 25, 1991,the City Council of the City of Omaha adopted Resolution No. 1507 appointing
Subby Anzaldo, and on June 22, 1993, adopted Resolution No. 1481 appointing Frank Christensen,
and on June 7, 1994, adopted Resolution No. 1607 appointing Lormong Lo, members of the City
Council,to assess damages, if any,to the owners and parties affected by the vacation of a street or
alley within the City of Omaha.
This Resolution is relative to the proposed vacation of the east/west alley between Evans Street and
Pratt Street from John A. Creighton Boulevard.to 33rd Street. The requirements provided in Section
14-375, Reissue, Revised Statues of the State of Nebraska 1943, states, "Whenever the Planning
Board recommends vacating a street or alley without petition, a Board of Appraisers will assess
damages, if any,to owners affected by the vacation".
This vacation will consolidate the right-of-way with the adjacent property to assemble a new church
site. .
The Public Works Department requests your consideration and approval of this Resolution.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS,Resolution No. 1507,adopted June 25, 1991,appointed Subby Anzaldo,
Resolution No. 1481,adopted June 22, 1993,appointed Frank Christensen,and Resolution No. 1607,
adopted June 7, 1994, appointed Lormong Lo, members of the City Council,to act as a Committee
to assess damages, if any,to such owners and parties affected by the vacation of any street or alley
within the City of Omaha; and,
WHEREAS, Section 14-375,Reissue,Revised Statutes of Nebraska, 1943, provides
"Upon recommendation of the City Planning Board, the City Council may, by Ordinance or
Resolution,vacate any street or alley within any such City without any petition being filed." It further
provides that, "Before any such street or alley be vacated,the City Council shall appoint a committee
of at least three members thereof who shall faithfully and impartially and after reasonable notice to
the owners and parties interested in the property affected by such vacation,assess damages, if any,
to such owners and parties affected;" and,
WHEREAS, it is hereby declared proper and necessary to vacate east/west alley
between Evans Street and Pratt Street from John A. Creighton Boulevard to 33rd Street; and,
WHEREAS,on January 8, 1997,the City Planning Board recommended to the Mayor
and City Council that the above described street or alley be vacated and that the three member
Committee be assigned to appraise damages,if any.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, Councilmembers Subby Anzaldo,Frank Christensen and Lormong Lo shall
assess damages, if any,to owners and parties affected by the vacation of east/west alley between
Evans Street and Pratt Street from John A. Creighton Boulevard to 33rd Street. Said Committee
shall give reasonable notice to the owners and parties interested in the property affected by such
vacation.
