The Subdivision Agreement covered the public improvements for Huntington Park and was approved by City Council on July 2, 1996. The Amendment revises the Subdivision Agreement to reflect to new lot line configuration for Huntington Park Replat 3, which is a replat of Lots 375 through 379,inclusive,of Huntington Park. All other aspects of the original Subdivision Agreement are not affected. The Public Works Department requests your consideration and approval of the attached Resolution and Third Amendment to the Subdivision Agreement. D'Ercole D to Mayor's Office/Title Date Acting Finance Director P:\PWl\5545.SKZ HUNTINGTON PARK REPLAT 3 THIRD AMENDMENT TO SUBDIVISION AGREEMENT This Third Amendment to Subdivision Agreement is made and entered into this da of g �-' Y u� , 1997, by and between ROYAL HOMES, INC., a Nebraska corporation (hereinafter referred to as "Subdivider"), SANITARY AND IMPROVEMENT DISTRICT NO. 374 OF DOUGLAS COUNTY, NEBRASKA (hereinafter referred to as "District"), and the CITY OF OMAHA, a Municipal Corporation in the State of Nebraska (hereinafter referred to as "City"). WITNESSETH: WHEREAS, Subdivider is the owner of the land included within the proposed plat attached hereto as Exhibit "A", which parcel of land (hereinafter referred to as the "Area to be Developed") is outside the corporate limits of the City and within the City's zoning and platting jurisdiction; and WHEREAS, the area to be developed is a replat within an area, attached Exhibit "B", that the Subdivider, the City, and the District, entered into a Subdivision Agreement (hereinafter referred to as the "Agreement"), adopted by the City Council of the City of Omaha on July 2, 1996, via Res. #1718, setting forth certain conditions; and • WHEREAS, the Subdivision Agreement needs to be amended to reflect the replat of Lots 375 through 379, inclusive, of Huntington Park; and WHEREAS, all the public improvements necessary to service the Subdivision exist or have been arranged for in the Agreement. Exhibit C of the Agreement is amended to show the Replat and the revisions to the Sanitary Sewer (Exhibit C attached hereto). That Exhibit "A" of the Subdivision Agreement be amended to show the replat (Exhibit "A" attached hereto) of Lots 375 through 379, inclusive, of Huntington Park (Exhibit "B" attached hereto). In all other respects, the Subdivision Agreement shall not be affected hereby and is hereby ratified and confirmed. IN WITNESS WHEREOF, the executing parties, by their respective duly authorized agents, have entered into this Third Amendment to Subdivision Agreement effective on the day and year first above written. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, the Third Amendment to the Subdivision Agreement between the City of Omaha, Sanitary and Improvement District 374 of Douglas County, Nebraska and Royal Homes, Inc., as recommended by the Mayor, providing for the sewer connection to the City of Omaha sanitary sewer system, is hereby approved.
