City of Omaha Public Works Director Hal Daub,Mayor • Honorable President and Members of the City Council, The attached Resolution approves the Second Amendment to the Subdivision Agreement between Royal Homes,Inc., Sanitary and Improvement District(S.&I.D.) 374 of Douglas County,Nebraska and the City of Omaha. The Subdivision Agreement covered the public improvements for Huntington Park and was approved by City Council on July 2, 1996. The Amendment revises the Subdivision Agreement to reflect to new lot line configuration for Huntington Park Replat 2;,which is a replat of Lots 320 through 372, inclusive, of Huntington Park. The Amendment provides for an increased interceptor sewer fee of$6,732.00 to be paid by S.&I.D. 374. All other aspects of the original Subdivision Agreement are not affected. The Public Works Department requests your consideration and approval of the attached Resolution and Second Amendment to the Subdivision Agreement. D'Ercole D to Mayor's Office/Tit Date Acting Finance Direc r • P:\PW 1\3434.MAF 17K.' f ' HUNTINGTON PARK REPLAT 2 SECOND AMENDMENT TO SUBDIVISION AGREEMENT This Second Amendment to Subdivision Agreement is made and entered into this 25 day of .-p r y , 1997, by and between ROYAL HOMES, INC. , a Nebraska corporation (herei after referred to as "Subdivider"), SANITARY AND IMPROVEMENT DISTRICT NO. 374 of DOUGLAS COUNTY, NEBRASKA (hereinafter referred to as "District") , and the CITY OF OMAHA, a Municipal Corporation in the State of Nebraska (hereinafter referred to as "City") . W I T N E S S E T H : WHEREAS, Subdivider is the owner of the land included within the proposed plat attached hereto as Exhibit "A", which parcel of land (hereinafter referred to as the "Area to be Developed") is outside the corporate limits of the City and within the City's zoning and platting jurisdiction; and WHEREAS, the area to be developed is a replat within an area, attached Exhibit "B", that the Subdivider, the City, and the District, entered into a Subdivision Agreement (hereinafter referred to as the "Agreement") , adopted by the City Council of the City of Omaha on July 2, 1996, via Res. 01718, setting forth certain conditions; and WHEREAS, the Subdivision Agreement needs to be amended to reflect the replat of Lots 320 through 372, inclusive, of Huntington Park; and WHEREAS, all the public improvements necessary to service the Subdivision exist or have been arranged for in the Agreement. Exhibit "C" of the Agreement is amended to show the Replat and the revisions to the Sanitary Sewer (Exhibit "C" attached hereto); and WHEREAS, Section IX of the Subdivision Agreement needs to be revised to show a reallocation on a pro rata basis in the interceptor sewer fees required from the District as a result of the replat. NOW, THEREFORE, the following is agreed between the parties hereto: 1. The City agrees to amend the Agreement to provide for a reallocation on a pro rata basis to the interceptor sewer fee paid by the District, computed as follows: Area to be Replatted: Lots 1 through 63, inclusive, Huntington Park Replat 2 (63 units @ $673.20/unit) = $42,411.60 Previous Platting - Fees Paid for Interceptor Sewers: Lots 320 through 372, inclusive, Huntington Park, single-family lots (53 lots @ $673.20 per lot) = $35,679.60 TOTAL DUE TO CITY = $ 6,732.00 • .M• That Exhibit "A" of the Subdivision Agreement be amended to show the replat (Exhibit "A" attached hereto) of Lots 320 through 372, inclusive, of Huntington Park (Exhibit "B"' attached hereto) . In all other respects, the Subdivision Agreement shall not be affected hereby and is hereby ratified and confirmed. L : ,..... ------___/ 4-c sA CITY OF OMAHA LEGISLATIVE CHAMBER Omaha,Nebr 19 RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: WHEREAS, Royal Homes, Inc., proposes to build a subdivision to be known as Huntington Park Replat 2 which will be.located South of West Maple Road at 161stAvenue; and, WHEREAS, Sanitary and Improvement District (S.&I.D.) 374 will build public improvements in this subdivision; and, • WHEREAS,Royal Homes,Inc.,and S.&I.D. 374 wish to construct a sanitary sewer system and connect said system to the Sanitary Sewer System of the City of Omaha; and, WHEREAS,the parties wish to agree upon the manner and the extent to which public funds may be expended in connection with public improvements to be constructed within the area to be developed or serving the area to be developed and the extent to which the contemplated public improvements specifically benefit property in the area to be developed and to what extent the cost of the same shall be specially assessed; and, WHEREAS, S.&I.D. 374 will pay$6,732.00 to be used for the construction of sewers in the Papillion Creek Watershed; and, WHEREAS, the parties entered into a Subdivision Agreement approved by City Council on July 2, 1996; and, WHEREAS,Huntington Park Replat 2 is a replat of Lots 320 through 372, inclusive, of Huntington Park; and, WHEREAS,the Second Amendment to the Subdivision Agreement has been prepared setting forth all the provisions mentioned above. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, the Second Amendment to the Subdivision Agreement between the City of Omaha,Sanitary and Improvement District 374 of Douglas County,Nebraska,and Royal Homes, Inc., as recommended by the Mayor, providing for the sewer connection to the City of Omaha sanitary sewer system and an additional Interceptor Sewer Fee, is hereby approved.
