Transmitted herewith is a Resolution approving an Interlocal Agreement between the City of Omaha
and the Omaha Public School System, District 001.
The City is rehabilitating streets in the area of Marrs Middle School under contract RSR 97-1. The
low bidder for this project is being presented to the City Council along with this agreement. OPS
would like to have additional work done to improve the safety for school children while being picked
up or being dropped off in front of the school.
The work primarily includes constructing a bus pull-off lane on the west side of 19th Street between
"U" Street and "W" Street. A sketch is included as Exhibit "A" of the Agreement. The cost of this
additional work is estimated to be $32,708.00. OPS agrees to pay for the actual cost of the bus turn-
off lane upon completion of the project.
The Public Works Department requests your consideration and approval of the attached Resolution
and Agreement.

INTERLOCAL AGREEMENT
This Agreement is made and entered into this day o ,
1997, by and between the CITY OF OMAHA, a Municipal Corporation of the State
Nebraska, hereinafter referred to as the "CITY" and Douglas County School District 001, a
Nebraska Political Subdivision, hereinafter referred to as "OPS".
WITNESSETH
WHEREAS, the CITY is rehabilitating the streets near Mans Middle School as
Residential Rehab Project RSR 97-1 which includes work on 19th Street from "Q"to "Y"
Streets; "S" Street from 19th to 21 s` Streets; and "W" Street from 19th to 21 s` Streets; and,
WHEREAS, OPS has requested that a bus pull-off lane be incorporated into this project
along 19th Street from "U"to "W" Streets to improve the safety for children while being picked
up or dropped off in front of the school; and,
WHEREAS, OPS has agreed to pay for the cost to add a bus pull-off lane to RSR 97-1;
and,
WHEREAS, both the CITY and OPS desire to describe and define the responsibilities
of the project.
NOW THEREFORE, the following is agreed between the parties hereto:
1. The CITY shall incorporate a bus pull-off lane in the plans for RSR 97-1. The location
shall be approximately in accordance with the sketch attached as Exhibit"A".
2. The cost to construct the bus pull-off lane is estimated to be $32,708.00. Actual costs to be
charged to OPS will be based on the low bid unit prices calculated with the actual quantities
used. OPS will be billed when construction is completed.
3. The CITY will pay the cost of the curb & gutter along the bus pull-off lane, any new asphalt
placed on the existing street, reconstruction of the storm inlets, any handicap accessible
ramps, engineering, and inspection costs.
4. Upon completion of the construction of RSR 97-1, the CITY will bill OPS for their share of
the cost which shall be immediately due and delinquent in 40 days.
5. Neither the CITY nor OPS shall, in the performance of this Agreement, discriminate or
permit discrimination against any parties on account of race, national origin, sex, age,
disability, or political or religious affiliations in violation of federal or state laws or local
ordinances.
6. Pursuant to Section 8.05 of the Home Rule Charter, no elected official or any officer or
employee of CITY shall have a financial interest, direct or indirect, in any CITY agreement.
7. No changes may be made to this Agreement or any attachments thereto except in writing
and agreed to by the parties. The Public Works Director of the City of Omaha shall have
the authority to administer this agreement on behalf of the CITY and to exercise discretion
with respect to those matters contained herein so long as the project proceeds in general
accord with the design and schedule referenced herein.
IN WITNESS WHEREOF, the parties hereto have caused these presents to be executed by the
proper officials hereunto duly authorized as of the dates below indicated.

WHEREAS, the attached Interlocal Agreement, which by this reference becomes a
part hereof, states that the cost of the additional work is estimated to be $32,708.00; and,
WHEREAS, OPS agrees to pay for the actual cost of the bus turn-off lane upon
completion of the project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the Interlocal Agreement between the City and the Omaha Public School
System,District 001,to construct a bus turn-off lane during the rehabilitation of streets near Mans
Middle School is hereby approved.
