Transmitted herewith is a Resolution approving an Interlocal Agreement between the City of Omaha
and Douglas County concerning the improvement of Blondo Street from 114th Street to 123rd Street
and 120th Street from Franklin Street to Rose Lane (also known as Miracle Hills Drive), which is
the jurisdiction of both entities.
The Program Agreement with the State of Nebraska Department of Roads concerning this
improvement is being submitted concurrently. The local share of the cost will be split between the
City and the County in accordance with the terms of the Interlocal Agreement. Since there are
different percentages for each of the different portions of the work, the cost breakdown for both the
City and the County is detailed in Exhibit "A" of the Interlocal Agreement.
Omaha will take the lead in this project and bill Douglas County for its share of the costs when they
are due. The estimated total local cost for Construction, Project Management and Right-of-Way for •
the City is $681,376.00. The estimated total local cost for the County is $1,099,624.00.
These amounts identified as the local share and other details in the Program Agreement with the
State are slightly different from what is shown in the Interlocal Agreement. This is because the
boundaries of the State project and the boundaries of the City/County project are slightly different.
The Program Agreement with the State includes 120th Street only as far south as Franklin Street.
The Interlocal Agreement with the County extends the work south of Franklin Street to Rose Lane
(also known as Miracle Hills Drive).

INTERLOCAL AGREEMENT
This Interlocal Agreement is made and entered into this 8 day of
r; / , 1997, by and between the CITY OF OMAHA, a Municipal
Co oration of the State of Nebraska, hereinafter referred to as "Omaha" and DO
UGLAS

COUNTY of the State of Nebraska, hereinafter referred to as "Douglas County".
WITNESSETH
WHEREAS, Omaha and Douglas County are desirous of entering into a mutual
endeavor to improve Blondo Street from 114`'' Street to 123`d Street and 120th Street from
Franklin Street to Miracle Hills Drive, which is in the jurisdiction of both entities; and,
WHEREAS, this project is know as Federal Aid Project STPC-5006(3), State Control
No. 21623, and City Special Project SP 92-11; and,
WHEREAS, both Omaha and Douglas County desire to describe and define the
responsibilities of the project, to enable them to jointly undertake the project in the manner
described as follows.
NOW THEREFORE, the following is agreed between the parties hereto:
1. The parties to the agreement shall each pay for their pro rata share of the cost not eligible
for Federal Funds on the project. The pro rata share of each party to the agreement is
defined in Exhibit"A" attached hereto and made a part hereof
2. The cost of the project shall include the construction costs, construction management costs,
right-of-way costs, testing costs, reimbursable utility relocation costs, and any other
miscellaneous costs required to construct this project that are not eligible for Federal Funds.
3. Right-of-Way costs will be initially paid for by Omaha. Omaha will then bill Douglas
County for the ROW costs in their jurisdiction.
4. Upon the acceptance of the contract for construction of the project, Omaha will bill Douglas
County for their share of the local costs as they come due. If, at the completion of the work,
said payments made by Douglas County are more than the actual cost, Omaha shall refund
the excess payments to Douglas County
5. No Change Order to the construction contract shall cause a contract increase exceeding Five
Percent (5%) of the contract price without prior approval of both parties.
6. This agreement shall remain in effect until construction and acceptance of the proposed
improvements of Blondo Street from 114th Street to 123`d Street and 120th Street from
Franklin Street to Miracle Hills Drive are completed. Amendments hereto shall be made in
writing.
7. Omaha and Douglas County shall not in the performance of the terms of this contract
discriminate or permit discrimination against any parties on account of race, national origin,
sex, age, disability, or political or religious affiliations in violation of federal or state laws
or local ordinances.
IN WITNESS WHEREOF, the parties hereto have caused these presents to be executed by the
proper officials hereunto duly authorized as of the dates below indicated.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS,both the City of Omaha and Douglas County are desirous of improving

(also known as Miracle Hills Drive),a portion of which lies in each jurisdiction; and,
WHEREAS,both the City and the County wish to agree as to the responsibilities of
each entity; and,
WHEREAS,an Interlocal Agreement,which by this reference is made a part hereof,
agrees to split the local share of the costs in the manner shown in Exhibit"A"; and,
WHEREAS,the City will be responsible for$681,376.00 of the cost and the County

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT,the Interlocal Agreement between the City and Douglas County to share the
cost of improving Blondo Street from 114th Street to 123rd Street and 120th Street from Franklin
Street to Rose Lane, is hereby approved.
BE IT FURTHER RESOLVED:
THAT, the Finance Department is authorized to pay the City's portion of the local
share, in the amount of$681,376.00, from the 1993 Street &Highway Bond, Organization 1509,
Fund 324.
