and Members of the City Council,
The purpose of the attached resolution is to authorize the donation of
approximately 100 used, out of warranty ballistic vests to the Douglas County
Sheriff's Office for use by its reserve law enforcement officers. Such donation is
permissible under Section 5.21 of the City Charter, upon favorable
recommendation of the Finance Director and upon a finding by the Purchasing
Agent that the vests are no longer useable for any City purpose. I have been
advised by the Finance Department that the vests are surplus and unusable for
City purposes.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS,the City possesses approximately 100 used ballistic vests which are out
of warranty and have been replaced with newly purchased vests; and,
WHEREAS,the Douglas County Sheriffs Office and other law enforcement agencies
have inquired as to whether such used, out of warranty ballistic vests might be available their use;
and,
WHEREAS, pursuant to Section 5.21 of the Omaha Home Rule Charter, 1956, as
amended, the Purchasing Agent has determined that such used, out of warranty ballistic vests are
unusable for any City purpose;and,
WHEREAS,such Charter provision permits the City Council,upon recommendation
of the,Finance Director, to authorize disposal by donation to any organization to be used for the
public good; and,
WHEREAS, the Finance Director has recommended disposal by donation of such
used, out of warranty ballistic vests; and,
WHEREAS, such use by the Douglas County Sheriffs Office or any other certified
law enforcement agency is for the public good; and,
WHEREAS,by copy of this resolution the receiving law enforcement agencies are
hereby put on notice that such approximately 100 ballistic vests are used,out of warranty and may
not provide the protection for which they were originally warranted and acknowledge and accept such
vests in their"as is"condition; and,
WHEREAS,it is in the best interests of the City of Omaha to donate such used,out
of warranty ballistic vests to the Douglas County Sheriffs Office for use by its reserve officers.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, pursuant to Section 5.21 of the Omaha Home Rule Charter, 1956, as
amended,the donation of the approximately 100 used, out of warranty ballistic vests to the Douglas
County Sheriffs Office or other law enforcement agency for its use by its reserve officers is hereby
approved; and,
FURTHER THAT, the City Clerk shall forthwith provide a copy of such resolution
to the receiving law enforcement agency.
