This Agreement covers the public improvements for Lot 33 of Pinetree Subdivision of Douglas County,Nebraska,located Northwest of 103rd Avenue and Hamilton Street. This Agreement stipulates which public improvements will be built by MLP L.L.C. in connection with The Pinetree Apartments,a planned unit development located in Lot 33 of Pinetree Subdivision. The Agreement states the City of Omaha will reimburse the developer for the cost of the public storm sewer installed with the paving project. The estimated cost of this storm sewer is $55,373.00 which will be reimbursed not later than December 31, 1999 from the Intersection and Storm Sewer Construction Organization 1446, Fund 324. The entire cost of all other improvements made in this development will be paid by the Developer. The Public Works Department believes that this Agreement will benefit the City of Omaha and the Developer in clarifying the responsibilities of the parties in building and maintaining the improvements for the development. The Public Works Department requests your consideration and approval of the attached Resolution and Public Improvement Agreement. WHEREAS, the Developer is the owner of the land shown on the site plan attached hereto as Exhibit "A" (hereinafter referred to as "Property"); and WHEREAS, the Developer proposes to build public improvements on and adjacent to the property; and WHEREAS, the Developer and the City desire to agree on the method for the installation and allocation of expenses for public improvements to be constructed in this area. NOW, THEREFORE, in consideration of the above, the following is agreed between the parties hereto: 1 . Public Improvements. Attached hereto as Exhibit "B" and incorporated herein by reference is a drawing showing the public improvements to be installed in connection with The Pine Tree P.U.D., i.e. extending 103rd Avenue west and north from Hamilton Street and public storm sewers. (hereinafter referred to as "IMPROVEMENTS). All improvements must receive the approval of the Public Works Department of the City prior to construction. The City will install a left-turn lane for 103rd Street at Blondo as shown on Exhibit "B"; the Developer shall reimburse the City $5,200 for said work within 30 days of payment request. 2. Installation of Improvements A. The Developer agrees to commence the timely and orderly installation of the Improvements following execution of this Agreement, pursuant to Section 53-9 of the Omaha Municipal Code. A certified check, letter of credit or a licensed corporate surety bond will be delivered to the city prior to the issuance of a building permit to guarantee the timely installation of the Improvements. B. That no certificate of occupancy be granted until such time as the public improvements have been installed and accepted by the Public Works Department. 3. Payment for Improvements. The Developer shall pay the cost of the Improvements as shown on Exhibit "B". Prior to December 31 , 1999, the City will reimburse the Developer for the cost of public storm sewer, provided the paving of 103rd Avenue and related storm sewer work as shown on Exhibit "B" have been completed by the Developer and accepted by the Public Works Department. The Engineer for MLP L.L.C. shall prepare plans and specifications for the storm sewer, and shall publicly bid this portion of the project. The reimbursable costs will be determined from final as-built quantities plus 12% for design, inspection and testing. The maximum amount to be paid by the City will be $55,373 as itemized on Exhibit "C". If the work has not been completed by the above date, this provision of the Agreement shall be void. O '4. Sidewalks. A sidewalk located as shown on Exhibit "B" abutting the Property • shall be constructed by the Developer in conjunction with the private improvements on Lot 33, Pine Tree. 5. Binding Effect. This Public Improvements Agreement shall be binding upon the parties, their respective successors and assigns and shall run with the land shown on Exhibit "A" known as Lot 33 of Pine Tree Addition. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT,Public Improvement Agreement between the City of Omaha and MLP L.L.C., as recommended by the Mayor,providing for the public improvements and sewer connections to the Omaha sewer system is hereby approved. BE IT FURTHER RESOLVED: THAT,the City of Omaha will reimburse MLP L.L.C.for the cost of the installation of the public storm sewer, in an estimated amount of$55,373.00,from the Intersection and Storm Sewer Construction Organization 1446,Fund 324,not later than December 31, 1999.
