MOTION BY COUNCILMEMBER HERD
I hereby move that Council Document No. c 2 (39 , Current Series, be amended as
follows:
•
1. By deleting the final paragraph and inserting in lieu thereof the following:
THAT,the Budget of the City of Omaha for the year 1998 as submitted to the
City Council by the Mayor and the Finance Director of the City of Omaha
together with revisions evidenced by resolutions attached hereto and adopted
by the City Council at the Council Meetings of August 26, 1997 and
September 9, 1997, be and the same is hereby adopted as the Budget of the
City of Omaha for the year 1998, and the City Council hereby confirms it
does not agree that it is within the line-item veto power of the Mayor, under
the Omaha City Charter,to reduce the 1998 sales tax estimate adopted by the
City Council.

confirms it does not agree that it is within the power of the Mayor,
under the Omaha City Charter, to Reduce the 1998 sales tax estimate of
the City Council .

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS,Section 5.06 of the Home Rule Charter of the City of Omaha, 1956, as
amended, provides that after a public hearing on the Budget,the City Council may revise the same
except that it shall not reduce the appropriations for debt service; and,
WHEREAS,certain revisions have been made in the Recommended 1998. Budget of
the City of Omaha where they are evidenced by copies of revision resolutions attached hereto; and,
WHEREAS,Legislative Bill 299,enacted by the Ninety-Fourth Legislature,Second
Session,provides that for fiscal years beginning on or after July 1, 1997, and before July 1, 1998,no
governmental unit shall adopt a budget containing a total of budgeted restricted funds more than the
prior year's total of budgeted restricted funds plus population growth expressed in dollars plus the
amount of unused restricted funds authority carried forward from previous budget years.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
•
THAT,the Budget of the City of Omaha for the year 1998 as submitted to the City
Council by the Mayor and the Finance Director of the City of Omaha together with revisions
evidenced by resolutions attached hereto and adopted by the City Council at the Council Meetings
