On July 29, 1997, by Resolution No. 2118, the City of Omaha entered into an Agreement with
Family Service, a Nebraska Non-Profit Corporation,to provide $100,000 in FY 97 CDBG funds to
be used in the improvement of the Family Service North Office at 6720 North 30th Street. This
funding would provide for renovation of the building facade and improvement of the parking lot and
play area. The legal description in the Agreement does not include the parking lot and play area.
This Resolution approves an amendment to the Agreement with Family/Service approved July 29,
1997, by Resolution No. 2118, which will modify the Family Service project's legal description.
Except for this change, the remaining terms and conditions of the original 1997 Agreement would
remain the same.

AMENDMENT
This Amendment is to the Agreement approved by the City Council on July 29, 1997 by Resolution
No. 2118 and is made and entered into by and between Family Service, a Nebraska non-profit
corporation, and the City of Omaha,Nebraska, a municipal corporation, and it is the intention of the
parties that this Amendment relate back to the original Agreement.
RECITALS:
WHEREAS, on July 29, 1997, by Resolution No. 2118, the City of Omaha entered into an
Agreement with Family Service, a Nebraska Non-Profit Corporation, to provide $100,000.00 in
FY 97 CDBG funds to be used in the improvement of the Family Service North Office at 6720 North
30th Street. This funding would provide for renovation of the building facade and improvement of
the parking lot and play area.
WHEREAS,the legal description in the Agreement does not include the parking lot and play
area; and,
WHEREAS,this Resolution approves an Amendment to the Agreement with Family Service
approved July 29, 1997, by Resolution No. 2118, which will modify the Family Service project's
legal description to include the parking lot and play area; and,
WHEREAS, except for these changes, the remaining terms and conditions of the original
Agreement would remain unchanged.
NOW, THEREFORE, IN CONSIDERATION OF THESE MUTUAL AGREEMENTS
HEREIN CONTAINED, THE PARTIES HERETO AGREE AS FOLLOWS:
SECTION 1. DEFINITIONS -ABBREVIATIONS
Section 1,Paragraph 1.10, shall be deleted in its entirety and the following Paragraph 1.10
shall be substituted in its place and stead:
1.10 "Property" or"Subject Property" shall mean-the property described as Lots 1,2,and
3,Husker Replat of the West 105 feet of Lot 11,Upland Terrace Addition to the City
of Omaha, as surveyed, platted and recorded in Douglas County,Nebraska; and
the East 45 feet of the West 135 feet of Lot 11, Upland Terrace, an Addition to the
City of Omaha, as surveyed,platted and recorded in Douglas County,Nebraska.

WHEREAS,the remainder of the Agreement approved by the City Council on July 29, 1997,
by Resolution No. 2118, shall be and hereby is in full force and effect.
IN WITNESS WHEREOF, the parties executed this Agreement as of the date indicated
below.

Family Service, a Nebraska Non-Profit Corporation, 6720 North 30th Street, Omaha, Nebraska
68104, incorporating into the Agreement the corrected legal description, is hereby approved.
