City of Omaha Public Works Director Hal Daub,Mayor • Honorable President and Members of the City Council, Transmitted herewith is a Resolution approving an Interlocal Agreement between the City of Omaha and Douglas County concerning the hiring of HWS Consulting Group, Inc. to design the improvement of 144th Street from "F" Street to Stony Brook Boulevard, which is the jurisdiction of both entities. The Program Agreement with the State of Nebraska Department of Roads concerning this improvement is being submitted concurrently. The local 20% share of the cost will be split between the City and the County in accordance with the terms of the Interlocal Agreement. The City will pay for 75%of the local portion of the professional services cost and Douglas County will pay for 25% of the local cost. Omaha will take the lead in this project and bill Douglas County for its share of the costs when they are due. The estimated total local cost for the County is $17,250. The estimated total local cost for the City is $51,750. The City's share of the cost will be paid from the 1993 Street and Highway Bond Organization 1509, Fund 331. The Public Works Department requests your consideration and approval of the attached Resolution and Interlocal Agreement. This Agreement approves the hiring of HWS Consulting Group to prepare preliminary and final plans and studies for improvement to 144th Street between "F" Street and StoneybLwk Boulevard, State Project No. M-5001(12) , Douglas County Project No. C-28(310)A, copies of which are attached hereto and incorrated herein by reference. The cost for this service is estimated to be $327,587.52 with Douglas County's share to be $17,250.00. WITNESSETH WHEREAS, Omaha and Douglas County are desirous of entering into a mutual endeavor to improve 144th Street from"F" Street to Stonybrook Boulevard,which is in the jurisdiction of both entities; and, WHEREAS,this project is know as Federal Aid Project STPC-5001(12), State Control No. 21884, and City Special Project SP 93-21; and, WHEREAS, it is necessary to obtain a preliminary and final design in order to determine more exact costs and identify the unique requirements of the project; and, WHEREAS, both Omaha and Douglas County desire to describe and define the responsibilities of the project,to enable them to jointly undertake the project in the manner described as follows. NOW THEREFORE,the following is agreed between the parties hereto: 1. The purpose of this agreement is to share the costs for hiring HWS Consulting Group to prepare preliminary and final plans and studies for improvements to 144th Street between "F" Street and Stonybrook Boulevard. HWS has agreed to do the work in the"scope of work"included in Exhibit"B"of the agreement with HWS,which by this reference becomes a part hereof, for a fixed fee of$327,587.52. 2. This project is eligible for Federal funds in the amount of 80% of the eligible project costs. Of the remaining 20% local share, 75% of which will be paid by the City and 25% of which will be paid by Douglas County. The estimated cost to each is $51,750 for the City and $17,250 for Douglas County. 3. Upon the acceptance of the contract for design of the project, Omaha will bill Douglas County for their share of the local costs as they come due. If, at the completion of the work, said payments made by Douglas County are more than the actual cost, Omaha shall refund the excess payments to Douglas County 4. No change order to this contract shall be made without prior approval of both parties to the agreement. Any amendment to this contract which taken alone increases the original bid price as awarded(a) by ten percent, if the original bid price is $150,000 or more, or(b)by $75,000 or more, shall be approved by the City Council in advance of the authorization of • any additional work in excess of such limits. However, neither contract nor purchase amendments will be split to avoid advance approval of the City Council. 5. This agreement shall remain in effect until the design work has been approved and accepted by the City. Amendments hereto shall be made in writing. 6. Omaha and Douglas County shall not in the performance of the terms of this contract discriminate or permit discrimination against any parties on account of race, national origin, sex, age, disability, or political or religious affiliations in violation of federal or state laws or local ordinances. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT,the Interlocal Agreement between the City and Douglas County to share the cost of engineering services for the improvement of 144th Street from "F" Street to Stony Brook Boulevard, is hereby approved.
