The purpose of the attached Resolution is to approve the Subdivision Agreement between
Construction Sciences, Inc., Sanitary and Improvement District(S.&I.D.) 418 of Douglas County,
Nebraska and the City of Omaha. Costs of$138,900 for acquisition of Lot 253 of Arbor Oaks as
a public park by S.&I.D. 418 and$40,000 for construction of a sidewalk on Outlot A are included
in the general obligation amount of$1,293,770.00. Total improvement costs are $3,758,205.00.
This Subdivision Agreement was previously approved by the Council on April 22, 1997 by
Resolution No. 1015. However, the required notice of the public hearing before the City Council
was not published on behalf of the S.&I.D. less than five days prior to the hearing as required by §
31-740 R.R.S. Neb. R.S. Supp. 1996, so it is necessary to reapprove this S.&I.D. acquisition.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS,Construction Sciences,Inc.,proposes to build a subdivision to be known
as Arbor Oaks which will be located Northeast of 150th and West Maple Road; and
WHEREAS, Sanitary and Improvement District (S.&I.D.) 418 has been formed to
build public improvements in this subdivision; and
V«IEREAS,Construction Sciences,Inc.,and S.&I.D. 418 wish to construct a sanitary
sewer system and connect said system to the Sanitary Sewer System of the City of Omaha; and,
WHEREAS,the parties wish to agree upon the manner and the extent to which public
funds may be expended in connection with public improvements to be constructed within the area to
be developed for serving the area to be developed and the extent to which the contemplated public
improvements specifically benefit property in the area to be developed and to what extent the costs
of the same shall be specially assessed; and,
WHEREAS,S.&I.D. 418 agrees to pay$258,746.40 as a sewer connection fee to be
used for the construction of the sewers in the Papillion Creek Watershed; and,
WHEREAS, S.&I.D. 418 will acquire Lot 253 containing 4.63 acres as Park Property.
at a cost not to exceed$138,900.00; and,
WHEREAS, Construction Sciences, Inc. will donate Outlot "A" containing 0.973
acres to the S.&I.D. to be used as a Linear Trail Corridor; and,

WHEREAS, a Subdivision Agreement has been prepared setting forth all the
provisions mentioned above; and,
WHEREAS, on April 22, 1997, such Subdivision Agreement acquisition and
improvement costs were approved by the City Council with Resolution No. 1015; and,

WHEREAS, the notice of the public hearing before the City Council of the City of
Omaha for the aforementioned resolution was not published on behalf of the S.&I.D. less than five
(5) days before the public hearing as required by Nebraska Revised Statute Section 31-740 R.S.
Supp. 1996, so its is necessary for the City Council to approve another resolution after a public
hearing held no less than five(5)days after notice of the hearing has been published in an newspaper
of general circulaiion in the municipality in accordance with the aforementioned statute.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, the Subdivision Agreement between the City of Omaha, S.&I.D. 418 of
Douglas County, Nebraska, and Construction Sciences, Inc., as recommended by the Mayor,
providing for the public improvements, park acquisition, linear trail corridor donation and sewer
connection to the Omaha Sanitary Sewer System, is hereby approved.
