City of Omaha Public Works Director Hal Daub,Mayor Honorable President and Members of the City Council, The attached Resolution approves the amendment to the Subdivision Agreement between"Harrison Square, Inc., Sanitary and Improvement District(S.&I.D.) 399 of Douglas County,Nebraska and the City of Omaha. This Subdivision Agreement, approved by City Council on March 28, 1995, covers the public improvement of Vintage Oaks, a subdivision located Northeast of 168th and Harrison Streets. This amendment to the Subdivision Agreement revises lot lines and stipulates which public improvements will be built by S.&.I.D. 399,those which will be paid for by special assessment and those to be paid for by General Obligation of S.&I.D. 399. The estimated total cost of improvements is $211,413.00 of which$18,703.00 will be paid by General Obligation. If S.&I.D. 399 is annexed by the City, any outstanding General Obligation Debt would be assumed by the City. The Public Works Department requests your consideration and approval of the attached Resolution and amendment to the Subdivision Agreement. AMENDMENT TO "VINTAGE OAKS LOTS 1-15" SUBDIVISION AGREEMENT FOR "VINTAGE OAKS REPLAT I" THIS AMENDMENT, made and entered into thisk-day of //v / , 1997, by and between HARRISON SQUARE, INC. (hereinafter referred to as "Subdivider"), and SANITARY AND IMPROVEMENT DISTRICT NO. 399 of DOUGLAS COUNTY, NEBRASKA, (HEREINAFTER REFERRED TO AS "SID"), and the CITY OF OMAHA, a Municipal Corporation in the State of Nebraska (hereinafter referred to as "City"). WITNESSETH WHEREAS, Subdivider is the owner of the land included with the proposed plat attached hereto as Exhibit "A", which parcel of land (hereinafter referred to as the "Area to be Developed") is outside the corporate limits of the City within the City's zoning and platting jurisdiction; and, WHEREAS, the area to be developed is a replat of Lots 1 through 11, inclusive, also all of Lots 13 and 14, Vintage Oaks, a platted and recorded subdivision in Douglas County, Nebraska for which the Subdivider, the City, and the SID, have previously entered into a Subdivision Agreement (hereinafter referred to as the "Agreement"), adopted by the City Council of the City on March 28, 1995, via Resolution No. 823 setting forth certain conditions; and WHEREAS, Exhibits "B" and "C" show the public improvements necessary to service the subdivision; and WHEREAS, all provisions of the original Agreement are valid and shall remain in effect except the following paragraph which is revised as follows: Section IX, Paragraph A. U W 3nv—s�� ,CViG9l o--s—� wit; I �' CO Q �� -N. a P !Y , w if, L 5 133dIS 41891 h Li o �5" la ^ 2 Y g T, C-25A CITY OF OMAHA LEGISLATIVE CHAMBER Omaha,Nebr November 4, 19 97 RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: WHEREAS, Harrison Square,Inc. proposes to build a subdivision to be known as Vintage Oaks Replat I which will be located Northeast of 168th and Harrison Streets; and, WHEREAS, Sanitary and Improvement District (S.&I.D.) 399 will build public improvements in this subdivision; and, WHEREAS,Harrison Square,Inc. and S.&I.D. 399 wish to construct a sanitary sewer system and connect said system to the Sanitary Sewer System of the City of Omaha; and, WHEREAS, Vintage Oaks Replat I is a replat of Lots 1 through 11, 13 and 14 of Vintage Oaks; and, WHEREAS, the Subdivision Agreement for Vintage Oaks was approved by City Council on March 28, 1995 by Resolution No. 823; and, WHEREAS,the parties wish to agree upon the manner and the extent to which public funds may be expended in connection with public improvements to be constructed within the area to be developed or serving the area to be developed and the extent to which the contemplated public improvements specifically benefit property in the area to be developed and to what extent the cost of the same shall be specially assessed; and, WHEREAS, the replat reduces the Interceptor Sewer fee by $2,754.31, which will be reimbursed to S&ID 391 from the South Branch Papillion Creek Interceptor Fund; and, WHEREAS,an amendment to the Subdivision Agreement has been prepared setting forth all the provisions mentioned above. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, the amendment to the Subdivision Agreement between the City of Omaha, Sanitary and Improvement District 399 of Douglas County,Nebraska and Harrison Square,Inc., as recommended by the Mayor, providing for the public improvements and sewer connection to the Omaha Sanitary Sewer System,is hereby approved.
