City of OmahaPublic Works Director Hal Daub,Mayor - Honorable President and Members of the City Council, The attached Resolution approves the Amendment to the Subdivision Agreement between David Paik Construction, Inc., Sanitary and Improvement District (S.&I.D.) 363 of Douglas County, Nebraska and the City of Omaha. This Amendment to the Subdivision Agreement covers the public improvement of Hillsborough Northeast, a subdivision located South of Browne Street at 134th Street. This Amendment to the Subdivision Agreement identifies additional interceptor sewer fees owed by S.&I.D. 363 due to the replatting. If S.&I.D. 363 is annexed by the City,any outstanding General Obligation Debt would be assumed by the City. The Public Works Department requests your consideration and approval of the attached Resolution and Amendment to the Subdivision Agreement. D'Ercole � Date ayor's Offi er Date Finance Director / �� • P:\PW\1413.SKZ • • 3 O • l • HILLSBOROUGH NORTHEAST AMENDMENT TO SUBDIVISION AGREEMENT This Amendment to Subdivision Agreement is made and entered into thisX day of //i/ -iv4 , 1997, by and between DAVID PAIK CONSTRUCTION, INC., a Nebraska corporation (hereinafter referred to as "Subdivider"), SANITARY AND IMPROVEMENT DISTRICT NO. 363 OF DOUGLAS COUNTY, NEBRASKA (hereinafter referred to as "District"), and the CITY OF OMAHA, a Municipal Corporation in the State of Nebraska (hereinafter referred to as "City"). WITNESSETH: WHEREAS, Subdivider is the owner of the land included within the proposed plat attached hereto as Exhibit "A", which parcel of land (hereinafter referred to as the "Area to be Developed") is outside the corporate limits of the City and within the City's zoning and platting jurisdiction; and WHEREAS, the area to be replatted is a replat within an area; area to be replatted is attached as Exhibit "B"; that the City entered into a Subdivision Agreement (hereinafter referred to as the "Agreement"), adopted by the City Council of the City of Omaha on 12/20/94 via Res. #3383 setting forth certain conditions; and WHEREAS, all the public improvements necessary (except 6 sanitary sewer laterals) to service the Area to be Developed exist or have been arranged for in the Agreement. Exhibit C is attached hereto to show the replat and the required sanitary sewer laterals. WHEREAS, Section IX of the Subdivision Agreement needs to be revised to show a reallocation on a pro rata basis in the interceptor sewer fees required from the District as a result of the replat. NOW, THEREFORE, the following is agreed between the parties hereto: 1. The City agrees to amend the Agreement to provide for a reallocation on a pro rata basis to the interceptor sewer fee paid by the District, computed as follows: Area to be Replatted: Lots 1 through 22, inclusive, Hillsborough Northeast (22 Units @ $673.20/Unit) _ $14,810.40 Previous Platting - Fees Paid for Interceptor Sewers: Lots 595 through 603, inclusive, and Lots 622 through 628, Hillsborough (16 Lots @ $673.20 per Lot) _ $10,771.20 TOTAL DUE TO CITY $ , ^ .20 O 2. The Subdivider agrees to pay all costs associated with installing sanitary sewer laterals, where required, to serve all lots within the area to be developed. 3. That Exhibit "A" of the Subdivision Agreement be amended to show the replat(Exhibit "A" attached hereto) of Lots 595 through 603, inclusive, and 622 through 628, inclusive, of Hillsborough(Exhibit "B" attached hereto). In all other respects, the Subdivision Agreement shall not be affected hereby and is hereby ratified and confirmed. OSD ro Nom 330-0300 00..000 1 C 25A. ,_ CITY OF OMAHA i t LEGISLATIVE CHAMBER Omaha,Nebr November 4, 19 97 RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: WHEREAS, David Paik Construction, Inc. proposes to build a subdivision to be known as Hillsborough Northeast which will be located South of Browne Street at 134th Street; and, WHEREAS, Sanitary and Improvement District (S.&I.D.) 363 will build public improvements in this subdivision; and, WHEREAS,David Paik Construction,Inc. and S.I.D. 363 wish to construct a sanitary sewer system and connect said system to the Sanitary Sewer System of the City of Omaha; and, WHEREAS,the parties wish to agree upon the manner and the extent to which public funds may be expended in connection with public improvements to be constructed within the area to be developed or serving the area to be developed and the extent to which the contemplated public improvements specifically benefit property in the area to be developed and to what extent the cost of the same shall be specially assessed; and, WHEREAS, S.&I.D. 363 agrees to pay an additional$4,039.20 as a sewer connection fee to be used for the construction of the sewers in the Papillion Creek Watershed; and, WHEREAS,an Amendment to the Subdivision Agreement has been prepared setting forth all the provisions mentioned above. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, the Amendment to the Subdivision Agreement between the City of Omaha, Sanitary and Improvement District 363 of Douglas County,Nebraska and David Paik Construction, Inc., as recommended by the Mayor, providing for the public improvements and sewer connection to the Omaha Sanitary Sewer System, is hereby approved.
